  2. Got a call off this lot today. Didn't recognise the number so phoned it back. They say they are a debt collecting company. Obviously didn't give any details to them but: does anyone know who they are? are they part of someone else? Any info would be great thanks
  3. Hi Donkeyb Are you saying they can offset the charges without a cca? I think you are right in in adding the interest etc as they would probably owe me money (but can't they charge me interest for an unpaid loan that isn't in dispute?). Ida, won't be going the hardship route, seems arkward to me. How would i prove i am in financial hardship? Again any help much appreciated. Thanks guys

  5. Just a quick one. I cca'd Halifax for a credit card last month and their time run out for a copy of the cca on the 26th OCT. I have since put the account in dispute, but yesterday i recieved a letter stating they are charging me £12 late fee and reducing my limit. Don't know if this is me being thick here or something, but how can they charge me a late payment fee when the account is in dispute. I thought they can't put charges and interest on whilst the account is in dispute. Are they just chancing their arm or am i missing something. Thanks for reading guys

  8. So in theory your debt is not in dispute so they had a right to offset the charges to your loan/card. Hopefully mine will be in dispute so can they offset the charges against a disputed account?:-?
  9. If you don't send letters recorded, they will deny recieving them. Send the letter again, this time recorded
  10. But had you already cca'd them. If i cca the bank and they can't come up with an agreement that's when i'll throw my charges in. They surely can't offset the charges then can they?

If you owe a bank for a loan etc but they owe you for bank charges and they both near enough amount to the same price, but you cca the bank and they have no agreement, can they offset your charges against the loan? I ask this as i am now in this position. Haven't a clue on this one so any advice really helpful thanks!!!!
  14. Depending on who your phone supplier is, you are entitled to a change of number once a year free of charge (pain in the a**e i know). Failing this don't answer any security questions if a dca phones you and tell them to do everything in writing only.
  15. I got a screenshot off the council, i didn't pay a penny for it. Every council has its own guidelines on what bailiffs should adhere to so i asked my council for a copy of their guidelines. They sent it to me, and one of the guidelines was that the bailiffs must send the case notes to the council once a complaint has been made about the bailiffs direct to the council. I made a complaint about the bailiffs to the council so the bailiffs had to send the case notes to the council within 7 days. I then asked the council to send me a copy of the case notes (which they did) and low and behold the casenotes did not reflect what the bailiffs where stating. I proved them to be liars!!!

Just to remind everyone out there who claims housing benefit and has kids, you're entitlement should go up from the 1st November as your child benefit (family allowance) is no longer classed as an income. Your Council should automatically change your claim for you, but if they don't make sure you go down to your local council and have the child benefit taken off as an income. You are entitled to more so make sure you get it!!!!!!!!!!!!!

  18. Thanks cerberusalert. What is the next course of action now for me please? Is the 'in dispute' letter the best bet or could you guide me to a more 'refined' letter so to speak. Thanks again;) By the way, would i place the account in dispute from today or from when the actual time limit for them is up ie Friday
  19. Why does it matter? In short they have messed me around somewhat. What do you think i am trying to achieve?
  20. Sorry to be a pain. The letter they sent me doesn't say it is a true copy. My mistake. They say they have enclosed a reconstituted version of the executed agreement, a copy of the current terms and conditions and a signed statement of my account. Firstly shouldn't the terms and conditions be on the same agreement and shouldn't the statement of account have my signature on it? It has a senior managers signature on it!!
  21. What i have been sent are Halifax Credit Card-conditions of use and a Credit Card agreement. neither of these have a signature box, only a right to cancel box. I am somewhat confused over what exactly they have sent me:confused:
  22. So anybody who wants a true copy of their cca should now be subject access requesting the banks for a tenner rather than a one postal order for a cca?
  23. By the way should i stop paying as the account is now in dispute!!! They also sent me a statement of account, it wasn't on letter headed paper, it wasn't signed by me but a senior manager and it looks like a five year old has done it

On the letter they sent to me they state The copy of the agreement enclosed with this letter complies with the requirements of the consumer credit (cancellation notices and copies of documents) regulations 1983 (the 'Reegulations'). Regulation 3 (2) (b) provides that a copy can omit any signature box, siganture or date of signature. In summary we are not required to produce a copy with your signature on it. By providing a copy of the agreement complying with the requirements of the regulations of the agrement remains enforceable. Any advice on what to send them please as the above statement seems somewhat rubbish
