  2. lol thanks for all the replies. Just been to my mums and got her to sign the letter about harrassment She still isnt convinced but I have told her and she knows about this forum, just she doesnt have access to the internet. I am going to re-write another letter telling them basically £10 is all she can afford and also about them freezing interest and charges. I told her after they have received this letter about harassment if they do phone her to refuse to talk to them, advise them of the letter she sent and hang up, then inform me and i will report them. I aint gonna let them bully her and stressed to her tonight to not let them bully her. She did laugh when she read the letter and said MBNA will be wondering when she got so clever about all the acts. Makes me wonder if they have recived DPA request yet, wish I was a fly on the wall when they see we are claiming back her charges. thanks again and will keep you posted.

  4. Hiya This is just for a credit card, she has been making sure her mortgage gets paid every month. She went to payplan who advised her to offer £1 per month, they worked out she could actually afford £10 per month and all her other creditors have accepted this. She has been paying MBNA the £10 also so they couldnt say she was ignoring the debt but they want different amounts each time they phone her from anything between £50 - £150, which she has told them on numerous occasions she cant afford. She has also been to CAB who to be honest wasnt really helpful. their advice was for her to get rid off her 2 dogs so she will save money on dog food, get rid off their car (both parents are disabled) and sell her home. I am in the middle of sending dpas off to her and my credit cards/bank. Have just copied the above harrassment letter to send MBNA and am also gonna send them a letter asking them to freeze interest and charges. Dunno if it will work but as the saying goes "Shy bairns get nowt" I wont give up and will do everything possible so she doesnt have to sell her home. it hasnt got that bad yet.
  5. Thanks for quick response. They are intimidating my mum but they wont intimidate me and i will keep going til I get back what is rightfully hers. Spent about 4 weeks now reading over this site and have started several claims. Fingers crossed and once I recive MY money back there will be a donation on the way.
  6. I was looking for some advice please. I am doing this on behalf of my mum who, to cut a long story short has got into some debt problems. She has contacted all her creditors who are accepting payment of £10 per month. All except MBNA. They phone her all the time telling her the £10 is not enough and if she doesnt increase the payments they will apply for a charge to repossess her house. Last week a manager phoned and told my mum they would only accept £150. My mum has advised them on several occasions she can only afford £10 per month. She posted a letter to all creditors which she got given from payplan. Also the manager advised my mum she has had £2000 worth of charges since March this year (dont worry dpa has been sent for statements). She even had the cheel to ask my mum to sell her house to pay back the debt she owes them, which is march was £4900 and it now up to £6738. Am I right in thinking we can send them a harrassment letter asking for correspondence in writing only. My mum aint well health wise and sitting worrying that her house might be repossed by MBNA aint doing her any favours. Any advice would be grateful.
  7. I sent it off on 25th May to: Lloyds TSB 71 Lombard Street London EC 3BS I got a letter back stating since I moved house I would need to pick up the statements from a local branch. I assume they have redirected internally. My experience so far with them has been quite good compared to other banks I am dealing with. A women called Gail called me to ask for my cc number and the number I posted was the number she gave me direct. Hope this helps.
  8. Here is a direct telephone number for TSB, it is the department dealing directly with issueing copy statements. I got a phone call from them yesterday to advise my statements were getting printed but they were very busy, so busy I think this department has just been set up because of people claiming back charges No is 0121 633 5411.

  10. Yes it is the same template and still £10. Just reword the letter slightly for your credit card.
  11. I am a sky employee and have heard this happen to a few customers. From my experience most of them has had it sorted out by going direct to a manager in the installations department. Without seeing your details its impossible to explain on here what has actually happened. What I can do though is at work tomorrow have a look about for a manager in installations or the correct department that can get this sorted for you. Hope this helps.
  12. I also wasnt on the electoral roll, I phoned my local council and they put me through to the correct dept who sent out the forms for me to fill in. Filled them in and posted them back.

  14. Well after spending about 1 week reading about this site(which I think is great) I thought i would give it a go Sent DPA letter today requesting statements. Will keep you posted on progress.
  15. Hiya Thx for info. I was gonna cancel the direct debit for their payment but am too scared to in case the bailiffs turn up at my door. I also have proof on bank statements that I have been paying them each month. I will write to them enclosing copies of these and see what happens. One thing am not sure of, does it have to go to court before they can send round bailiffs? Dont want that to happen.
  16. Hiya wondering if anyone can help me. I had a credit card with bank of Scotland which ended up going to a debt collection agency called Cap Quest Debt Recovery. Last Oct I agreed to pay it at £10 per month which at the time was all I could afford. The letter I got confirming these payments advised that they could review the accout at anytime and increase/decrease my payments. Well today I get a letter telling me it is getting passed to bailiffs. Starts of with: We not with regret that you have chosen not to deal with this matter despite our numerous communications to you endeavouring to assist you in coming to a satisfacrory arrangement to settle this account without the need for legal action. The last letter I got from this company was comfirming my agreement to pay £10 pm last Oct. I phoned up the company to discuss this but they wouldnt have any of it. Just said I have to pay it in full and its going to their pre-litigation system. Any advice on what to do with this? Am angry that they agreed my £10 pm and havent wrote to me since to ask me to increase my payments. They are saying I havent dealt with it? Any help or advice would be gratefully appreciated.
