  1. Hi You will get these charges back if you follow the step-by-step instructions. Have a read through the FAQ section so you have an idea of the process. http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/ The letters you will need are posted here: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ The first thing you need to do is the Data protection act - Subject access request letter, enclosing the £10 fee so you can get a copy os all transactions/charges to see what they owe you. Also have a read of other peoples posts to watch their progress and it will all become clearer. Good Luck!!
  2. Good Luck getting them. They went passed the 40 days with me and I phoned the number you phone also. Twice I got told they were getting copies and I would receive them within 1 week. My 40 days were up on 7 July. I phoned again and was told that they have been requested twice and if I havent received them tough, they are too busy to do another copy. I have sent the non compliance to dpa letter and also got a complaint lodges with IC. Good Luck!!!!

Hi All the letters you will need are here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ If you need statements to see your charges it is the DPA - Subject Access Request letter you need. If you know your charges and want to ask for them back it is the Preliminary letter you need. Hope this helps.
  4. I sent my Data Protection Act on 26 May. The 40 days were up on 7 July and I was told on two occasions I had been sent them. I still havent recieved them so I sent the non commpliance of Data Protection Act letter to halifax (see here, letter 3) http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.html I had also called the Information Commissioner for some advice. Basically they arent complying with the DPA if they dont supply the information. IC sent me a complaint form to fill in and send back and they will get on to Halifax to send this information to me. You can fill it in and print it off and sent it along with any document between you and halifax requesting DPA. http://www.ico.gov.uk/eventual.aspx?id=16318 You really need your statements to see what they have charged otherwise you are guessing. Best to go along the above route to get your statements, it may take a little longer, but at least the amount you will be asking for is fact and not just an estimate. The 40 days arent working days, just 40 days from when they receive the request along with payment. Good luck!!
  5. If you think you have been charged other charges over the last 6 years. Send the DPA. You can either send it to head office or take it into your local branch. Yes you have to enclose £10 fee, either cheque or postal order. If sending by post either send it recorded delivery or special delivery for proof of posting. Good luck
  6. My advice is dont do it. Me and my partner applied to them for a loan before Christmas, We paid £48.50. 8 months later no loan and they refuse to give us back our money because they say they have other databases they can check to see if we can get a loan. We have given up on the idea. I have also read on the internet a few people in the same position as myself. Applied and no loan and no refund of money. Up to your cousin but I wouldnt advise it, would be a waste of £38 IMO.
  7. I have just sent off an LBA for a closed account I used to have with the Halifax. I dont think it matters that the account is closed. They have still applied these charges. I am sure I have read somewhere that someone got their charges returned on a closed MBNA account. Worth a try I say.
  8. Hi I sent the DPA letter on behalf of my step dad to Intelligent Finance. This morning he got a letter back saying there are no charges on his account and they will return the £10 cheque. The DPA letter didnt mention wanting a list of charges it was transactions. Where do I go from here?
  9. Could someone please clarify a point for me please. Have read about the forums but there seems to be 2 different answers. Does the 40 days for the DPA start from when they recieve your request with your payment or from when they actually cash the payment? I sent my DPA with a cheque which was received on 26 May. They lost the cheque but debited my account of £5 fee but not until 23rd June. Some people on here are saying it starts from when they receive the request as long as payment is included and others are saying it doesnt start until they cash the payment :S Someone please clarify this as if it is the first one then their time is up and non compliance letter will be on its way.   10. Good Luck!!! My charges from Halifax go back to 1998. Total amount is £1218, amount before 5 year period (am in Scotland) £410. Hope I can get these back.

  12. Need some advice please. Sent my DPA and received my statements this morning. Totalled up my charges to £290. However on the last statement they have refunded £160 charges, so I assume I can still claim for the other £130, also what charges do I not include? Can I choose what ones not to include or does it have to be e.g the first charges they charged me. Another thing confusing me is this debt was passed to Capqeust ( I have made a seperate post) the amount Capquest was chasing me for was only £536 but my total owe to BOS was £2088. On my final statement it has the following: 10 JUL REFUND OF LATE CHARGES 80.00CR 10 JUL REFUND OF LATE CHARGES 80.00CR 10 JUL CHARGE OFF ACCOUNT - PRINCIPALS 1682.74CR 10 JUL REFUND OF INTEREST 246.06CR Hope this is clear what I am asking. Still early in the morning and already am confused.......
  13. Thanks for the letter, will send it to them, weird thing is I got my statements from BOS this morning, this is the account cap quest were dealing with. On my final statement on July 2003 it has: 10 Jul REFUND OF LATE CHARGES 80.00CR 10 JUL REFUND OF LATE CHARGES 80.00CR 10 JUL CHARGE OF ACCOUNT - PRINCIPALS 1682.74CR 10 JUL REFUND OF INTEREST 246.06CR Now am really confused becaus ethe initial debt that capquest was chasing me for was only £536 :S I have double checked and its exactly the same account number as my BOS cc. not sure really what to do next regards claiming back charges from BOS. Going to post that letter today though to Capquest. Thanks again.

  16. Can someone please help me out about overdraft interest? I went to fill in the spreadsheet but i dont have a note of my balances when the interest was applied as they have only sent me a list of charges not actual statements. Does this mean i shouldnt claim the overdraft interest back?

  18. Well after many emails sent to a very helpful man at TSB he told me today that my statements had been sent on 22nd June. I had to collect from a branch as my address was diffferent as it was on my account. Anyway went to the branch and all they gave me is a list of charges from 2003. No actual statements. I assume this is all the charges I have been charged on my account or should I get back in touch and request full statements? Also on the charges there is a few overdraft interest deductions, nto sure exactly what this is and can I calim that part? read someone you can claim a partial amount back but I got confused. Thanks in advance for any help.
  19. Hi Glen What you need to do is fill in the spreadsheet in the bank template library. It will automatically work out the interest for you, however you cant claim back interest til you file the claim in court. Once you have input all your charges and the dates, hide the colums for interest and days since charged, print it out and attach this with your prelim letter. Good luck

I told him about this site but he doesnt have any charges, hes been good since we split Shouldnt see it being a problem if I need his consent. Will keep you posted!!
  21. Recieved letter yesterday saying about the £5 charge to come out of my account first. Phoned them up as I had sent a cheque for £10, gave them permission to debit the £5 and my cheque seems to have got lost in their office. Waiting on postman now, quite excited!! I could also use some advice please. I also had a join bank accoint and mortgage with the halifax when I was with my ex husband. Both accounts are now closed and were at a previous address. I have been trying to get these statements for both accounts. Went to my branch and they werent able to give me account numbers. I have nothing with accounts numbers on them. I had emailes Jean Graham about my statements and she advised they need account number, sort code and roll number before they can proceed. I was under the impression the DPA is a request on information they hold on you and not on a specific account. Any advice would be great.
  22. I wouldnt let them get away with this. With anything like this you have a cancellation period. Also you said when you booked it and they put it on your mums account they didnt ask to speak to her. I work in a similar call centre and know if I had to add something to someones account withotu speaking to the main account holder I would be dragged over the coals as this is breaking data protection. Only time we are allowed to do this is if the main account holder has given permission to anyone else and also provided a password which must be verified. I would try calling them up and ask to speak to a manager. The person who booked it for you has been naughty in adding it to your mums account. Good luck!!!
  23. Hiya I work for Sky (dont hate me ) only in the sales department though for new customers. Im looking into it to see if I can find you a direct number you can call to find out about your warranty. I know with any sky boxes we sell they only come with 12 month warranty then after that you have to pay if you want extended warranty. Can you remember exactly where you got it from? was it skybuy? Am not in work til friday but I will see what I can find out for you Dunno exactly how everything works with the different acts that there are, but i know from my experience with sky they will prob reply saying it was stated in your T&Cs that warranty was only for 12 months. Good luck with it though!!!!
  24. Start by sending the DPA letter in bank templates to them with the fee of £10 and get a copy of all your statements from them and take it from there. Not sure about interest but I know you can claim back any charges e/g late payment and over limit charges. Good luck!!!
  25. Well have started to claim off BH, I phoned up the other day as I couldnt find an adress to send the dpa to. The person on the phone said they would request statements free of charge and I will receive them shortly. Not convinced by this I phoned them again yesterday and was advised the statements are being printed and I should receive them within 7 days. Just a case of waiting for the postman now. Out of all the people am claiming against I hate these people the most. I had car finance with them and me and my fiance moved from newcastle to scotland and things were a bit tight to start with. During that time we missed a couple of payments and tried to make arrangements for payment. We received a letter with almost £200 of charges for one missed payment, phoned them up and got told " You have to appreciate Mr Anderson, chargin people is how we make our money" it got my back up so cant wait to get my money back off them.
