  7. Your case will not go to court but you will have to issue summons which means that you will get the 8% interestanyway when Halifax write back to you a couple weeks from now with their snivelling little 'with no admission of liability' standard letter offering you all your cash back. Enjoy!
  8. Loving it! The generous people at Halifax` have just sent me my fortnightly pay slip for another £883.99. It is so nice of them to let me have my own money back. Still another five grand to go. All you people in England are sooo lucky. Up here we have only got a £750 no fee limit so we have to do the whole process every two weeks. But hey it stops me spending it all at once! Merged threads, please keep to the same one.
  9. Just remember that you are liable for costs with a summary cause. Not that I think for one minute that a lwyer from the Halifax would turn up to Kircaldy court but better safe than sorry.
  10. Yes open a new account just in case althogh there is talk of their threatening behavior being unlawful too. You can still progress without the manual intervention information. Its sounds to me like time to send them the good news. Get your moneyclaim forms filed and wait for the cash to come rolling in. The tone of thier letter is a very familiar one by now and basically means they are waiting for you to make the next move. They will not give you any more until you file an action. So you only have to answer yourself as to whether or not you want the money back.

  13. Hi Gary, Do try to phoning the bank for your statements first though as the halifax do seem to send them out quickly and you will not have to wait the 40 days for the dpa request to expire. I think that if you go in strait away with a dpa request they will drag their heels.
  14. Hi Scotia, firstly the staute of limitation for us up here is only five years so you are only going to be able to claim your charges back during this period. I am now in my third claim with Halifax and have severed the claims by date and the sheriff officer doesn't seem too worried about this. I have pointed out to the Halifax that they can if they wish settle the whole lot now as it would actually cost them less as they would not have to incurr charges. They did not seem too interested in this and said that they were not going to refund charges end of storey. Odd that they had just paid out over a grand to me four days earlier !!! So the fact is that they will not refund anything without a court action. I told them that thier arrogance astounds me and I will now pursue every charge inividually so it will cost them £39 in court costs for every £30 action I raise against them. I am looking for about another £4800!! so lets see how long it takes them to pay up the lot. I may drop in the odd £750 claim here and there if I get short of cash but I am now very prepared to be a pain in thier corporate ass just for the hassle and discomfort they have caused me. So press on and sever the claims however you like as they will pay you up however you do it as long as you take them to court. It really is a shame that we are only aloud to claim the £750 up here. Any problems let me know.
  15. I know it is odd, they didn't even say they were going to defend. The cash was put into my account the day that the letter arrived saying blah blah. Seems they have been caught on the run and have not yet established a consistant policy. Or maybe they are trying to work out who we all are on here from the response sto our cases then they get an idea of our next move? Bloody hell i sound like i've been watching Xfiles or some conspirisy theory nonsense btu hey just a thought. I wouldn't put it past them. Like i said theyr'e cheeky F@*@*@*s!   17. Hi Scotia. I have two cases at down the road in Cupar in about four weeks (see litigation section). I'm waiting for acknowledgement from Halifux but wholly expect a judgement by default. I am pursuing £alot in total and have worked out a stratagy for getting through this with regard to the 750 limit. I would say that pretty much all the info you need you'll find here with a bit of trawling around, but if you have any speciific questions with regard to the Scottish small claims system then I would be happy to answer them as I have now had a good look through the Act of Sederant (small claims rules).   19. I hope lot's of people read this and realise that the bank employees at the end of the phone are human too and that they should not always be spoken to as if they are the policy makers. You are very welcome here and i look forward to hearing what to have to say.

  22. Big smiles in my house this morning as a nice cheque from the directors office of Amex Europe came through the door. £509.60! They made me an offer last week £446 but said that by accepting the cheque and continuing to use the card that this meant that I accepted the terms as fair and reasonable. I called them back to explain that this would not be the case and they had not calculated the interest properly plus as they had dragged thier heels the interest had increased too. I told them 'I have always accepted your t&c and will continue to do so but reserve my right to challange you again with regard to unfair charges. I told them how much i actually wanted and 'OK i'll inform the company lawyers' the nice lady said and the cheque came today. I like many people was a little sceptical about taking on these institutions six weeks ago but it works. If you have any doubts remember we ARE in the right and it IS our money. Big thanks to Dave and Bankfodder ( voucher on the way) without whom this would not have been possilbe. I'd like to thank my Mum and Dad and everyone who has supported me thruogh this long and tirsome struggle with the opressive ...............................................
