I have had a look and think that may just do the job...I would have to take out the bits saying they have not supplied any paperwork as they sent me the complete set of statements dating back to 2022 when the account was started, but alongside the application form, thats it!! The exhibit numbers you have given, are they just 1,2 etc shuch as ex1? Thanks for all your help

Hi all, Could someone please help me with my defence letter, as it is due in very soon and as I have to do this by post, I would need a few days for the postal system to get it there. Perhaps I could use alot of the things said in post 31. The courts have received my form, and the n/w have to date not responded in writing to my last letter, but they did try to contact me by fone...I was not in!!..lol

Hi, can I send this even if the company has not stated any of the documents requested in their court papers?...the court papers just say it is a credit card debt.

Hi Emma, Thanks, you really are a great help to me, I am a little more possitive as I am also fighting N/W and have had some really good responces so maybe things might change alittle for me....the 2 cards taking me to court are I think, just the start of a long list, but I am trying to do them one at a time...I noticed that you won with the n/w but cant find any threads for it, I know it is a topic on another thread I have going, but any information you can share would be great.. I am still considering BR, as this may put an end to all the problems...but really dont want to do that and have found out that HE wont be automatically offered first refusal on my share of the house, they say I should find someone willing to buy it...so that will stuff him up anyway..

Thats great, I hope someone can help me with that, and I am going to look at the other cca's I have received so far, one of them was applied for on line, do you think that this would be the same for that one, as it is with the HFC bank and they are really nasty...I have put in my defence for that one, but I could maybe say all of that in court!

Wow, thanks for that CCM, the rest of the application form is standard so I hope they will not fight me...should I write to them and point this out, or will they know this and hopefully not preceed? I must say, you have been a great help to me, I was really depressed last night, but am in a fighting mood today, hope it lasts...lol

Hi CCM, I have scanned the bottom part and blown it up abit..it says that I am asking you to issue me with a credit card and that your conditions, which I have read, will apply.... but does not say anything about them being attached...it does say the t&C form part of the agreement. http://i534.photobucket.com/albums/ee344/gangsta_caz/LastScan-3.jpg it does not say page 1 of 2 or anything else.

I also notice on the agreement (prioity application)that it has my name and address pre-typed, this tells me that it was one of the application forms that companies sent through the post to apply for their card, so the terms and conditions that they sent me along with the copy of the cca would not have appeared on the form, these would only appear on an additional agreement....or am I mistaken?... Could some one please take a look at the cca I have posted and let me know what they think of it.

Hi again CCM, I have read the CPR letter you posted, and as far as I am concerned, they have not issued a default notice and have not mentioned this in their court doc's...they have already sent a copy of the agreement, should I still send the letter to them? I have sent the paperwork back to the court today, but I also notice that the date on the court paperwork is the 9th and the envelope is dated the 16th, so when does my responce date start from? as there is 7 days between them!

Hi again Questioning and Emma, sorry it's been a while, but I am struggling a little and am depressed....but I had a thought today, that is when I send the letter to the solicitors requesting all of the paperwork, he replied that I was not intitled to it and referred to me using a forum, should I mention this in court? All i have for the court case, when it comes, is the few statements they sent and the copy of the agreement, it may help me if I can show the judge that they have not tried to help me in the situation. They can say that I didnt reply to the first solicitors letter, b ut this was passed to GP and they should have replied on my behalf, this shows that I was trying to sort things out and even paid for help that never came.

Hi CCM, thanks for that..They have sent me their copy of the agreement, which is an application form and stamped approved, is this classed as a legal agreement as I think that is all they will send me again. I will send the letter and take out item 2, this will go of today. Thanks for your help.

Hi again, I have attached a letter that they send along with the paperwork.. The cca is an application form, but does not say there are other pages with it although they have send 3 pages of t&c + all the statements from 2002 to date. Hi emma, thanks for that...I am struggling with the x boyfriend..I cant afford to leave at the min as I have 2 daughters just started uni and have no money to rent a house..and if I leave, he owns half the property and will not put it up for sale...and even if he does, he will offer to buy me out at a silly sum...just enough to pay all of my debts and I still will loose everything..so he wins and I am really stuck and mite as well go BR..I loose all ways now. He is a money grabber, and I found out to late..he was very cleaver!!
