  2. Hi All, Thanks very much for your inputs so far on this. I will dig through my paperwork and find out the answers to your questions Zoot and post again. I the meantime, all I want is for Asset link to demonstrate to me that they have the correct paperwork and provide a statement of account so I can see what my position is before I will enter into any negotiation. How can I be expected to negotiate anything when all I have is letters stating you owe £11k to us and how do you intend paying this back? From a company, until last week, I had no knowledge existed. The origianal creditor has not informed me of their decision to sell the debt as I recall but I will check.
  3. Hi All, I don't think any of us are not prepared to face up to legitimate money owed. However, I am of the opinion that if a said company cannot follow their claim to the letter of the law and try to deceive people into thinking they have the uperhand then thats wrong. It seems to be he who shouts and threatens the strongest should get paid the quickest. Well we will see!! thanks again pj41
  4. Hi Alan, I "googled" the law of property act 1925 and it really didn't seem relavent to an unsecured loan. Although there wasn't much I could find about section 136. Thanks for your help and promp post. As I have already sent the CCA request as previously stated. I will do nothing for 12 days + one month and complete any court papers arriving on my mat before then accordingly. Cheers pj41

  7. Hi all, In breif I had a personal loan with GE Capital. I have recently recieved a letter from the above company giving me notice or intimation that they have been assigned the benefit of the debt. I wrote back with a CCA request and my quid requesting a true copy of the agreement and the deed of assignment etc. Asset link wrote back stating - Section 77 and 78 of the CCA 1974 do not apply to them as it only applies to matters arising during the currency of agreements since the account with GE has been terminated the agreement is no longer current. Is this correct? I then recieve another letter stating You have been served a notice. The recent letter from Asset link was a legal requirement under Section 136 of the Law of Property Act 1925. Ring us immediately on 0207 etc What the heck is the law of property act anyone help? Cheers PJ41
  8. Hi Keren, chaps and ladies, (is that pc?) My "telephone Hearing" with Citi is in January, due to pressures of work I can't get in here as much as i would like too. Can I object to a telephone hearing? I have previously won by default, and then issued a warrant of execution. Then they apply for a set aside "we didn't get the documents" and "Kissick v citi" is one of first instance only and thus persuasive according to mr Travis and he thinks we have a good chance of winning. Would one of you educated folk pm me with whats happening (please). Donation on its way! Cheers Pj41
  9. This bank must have all it's licences revoked. They consider themselves above the law and to be honest, in my opinion, the various district judges don't seem to be offering much to the impending collapse of their overall argument. We must be able to do more to stop this bank. Any thoughts? Paul

  16. Hi Acestealer, Don't panic. If you've lodged a mcol for the full amount, the follow up paperwork from the court will allow you to inform the court of any part payments since the date of your claim. Court proceedings are slow but effective and efficient. Just let the paperwork catch up. Hope this helps Cheers Paul

  18. Hi Martin, Yes, you are correct. There is an opportunity to file a counter claim. However, the timings allowed were not ideal, 40 days to respond to a SAR - only 28 days to file a defence!! Anyhow, I have had letters from Hillesdens entitled: 48 HOUR RESPONCE REQUIRED. Pay us etc etc. They are a company with resourses and dedicated departments etc I am obviously an individual so 7 days is all i will and have given them. I'll keep you posted with any developments.   20. Hi Martin, Fair point. My letter basically said you have deceived and harrased me into paying you and I have now become aware that you have not got the correct docs. So, send me a cheque refund within 7 days or I'll commence court action. What do you think? Cheers Paul
  21. Hi Martin, I ran up a Credit Card (CITI) bill of about £5.5K I couldn't keep up the payments, they defaulted me and sold the debt to Hillesdens for £1100. Hillesdens agreed to £50 a month (before I found this site) I paid them £550. Hillesdens issued a court claim against me after they demanded £ 125 per month and I refused. Hence their claim in May. I found this site, did a SAR to Citibank found out the above info and my charges from Citi were about £850. I have a MCOL "saved" on the site whilst I save up the £120 to go for Citi bank. In the meantime my defence to the court claim from Hillesdens was to send a SAR and a CCA request £10 for one plus £1 for the other. After 12 days no paperwork court action Stayed. I was going to let it rest then I thought Oh s*d it if you aint got the correct docs you are not entitled to collect the money either. So i wrote demanding my money back. Co-incidently they ( Hillesdens) have written to me today basically sying "the docs are on order" we will get back to you. So, come Monday I will issue a MCOL for the £550 I paid plus the £11 for the SAR and CCA request. Just because I can, and I detest Hillesdens. No doubt the Docs will appear eventually.But in the meantime I want my cash back. Cheers Paul

  23. Hi All, Why pay by Derict Debit? Ok some bills add a couple of quid on for not paying by DD I'd rather pay via internet banking when I have the funds available and not be stood in a pertol station with a full tank of fuel and no means to pay!! DD's are a way for banks to make extra cash due to all that you have just mentioned. Variable amount on varying days SOD that. Cheers Paul
