  1. Thanks for your reply DX,They have never sent us a bill since having the meters put in .If we ask for a breakdown of all the payments that we,ve made over the past 18 months , hopefully this might give us the tarriff rate.kind regards angnnig

Hi All , I recently noticed that Southern electric have been taking a couple of pence for debt on our prepayment meter , I complained to them and i gave them all the readings from the meter , They then admited that they owed us £28 as the meter was set to take a debt we didn,t owe. We had paid our debt up about 18 months ago now and the meter has been taking pence for debt each time we topped up our gas card. I,m wondering if because the meter has been set to take a debt, has the meter been set to a higher tarrif than what it should have been on , the reason I am asking this is, the engineer from sse came out to reset the meter and said its back to standard tarrif again and shouldn,t be costing as much as it was before . I know prices have gone up ,but its been taking £5 a day from us for long time now and we only live in a bedroomed terrace house . If the meter has been set to high all this time would we be entitled to any compensation for the meter being set to high? Kind regards angnnig

Hi guys , Had a letter today from Acenden and not sure what they're playing at but they,ve split our arrears charges up into two sections a)payment arrears balance £1618.36 and b)other amounts due balance £1116.7 and says payment arrears: We will now refer to all missed payments as arrears and Other amounts :this includes arrears fees and other fees. I do hope there not trying to get out of paying us arrears fees back and i hope it doesn,t affect the way the FOS are going to treat our complaints about arrears charges. Has anyone else had a letter like this? Kind regards angnnig
  4. Hi there. We have recently fallen on hard times financially and our bank (Co-op) have recently charged us £45 in 3 missed direct debits I think the first dd came out too early , as soon as we had recieved the letter informing us of this they were going to take the money on the 22nd of this month, We opened an account with another bank, as soon as that was open we phoned tax credits to tell them to put money in our new account. They said they would sort out the child benefit too and make sure all our benefits would be put in our new bank account. They manged to put the child and working tax credits in but put the child benefit in the co-op bank and they have just took all this in charges. We are fuming as that was money for our childrens food not to mention xmas coming up as well and still really struggling . Can anyone advise on what we can do about this . Thanks .Regards angnnig

  6. Do we ask the FOS to open the old case or do we start a new one .Acenden have been putting interest on arrears charges on our arrears balance ,but theses are not arrears they are all charges ,this could be another reason to start the claim,Any advice please , regards angnig
  7. Ok Thanks guys,Apart from them adding more charges on to our arrears amount,We only have the same argument again about the charges being way to high,but i suppose it,s worth a try and we,ve nothing to lose.Regards angnnig.
  8. Hi ,It was about june last year that we first complained to the FOS,so well over a year now.Think it went to an adjudicator,so can we take this further with them?We will go as far as it can go .Regards angnnig

Hi all,Finaly received a reply from Acenden,and are baffled by thier response, they are saying that our compaint is now being investigated by the FOS so therefore any queries on this matter should be referred to them and if we wish our complaint to be handled by Acenden ,we will need to withdraw our complaint from the FOS service and are saying that there investigation will only take into consideration fees applied after the 26th october 2010. We complained to the FOS a while back now and got turned down and asked them to look at our complaint again and again got the same response,so we just left it at that.So not sure why Acenden think the matter is still under investigation with the Fos.Were still undecided about going to court yet.such a hard decision when there is a chance we could lose our house.Regards angnnig

Iv,e just looked at the OFT link and it states that it doesn,t deal with individual cases,maybe we should all get together and see if they will deal with it then:shock:.Then it goes on to say contact consumer direct,Would this apply to our case with Acenden or should we just go back to the FOS:| again.Thanks for any replies ,Regards angnnig
  12. Hi Ellen ,Thanks for the info, I Think we will call him as well.Acenden should be exposed ,named and shamed for how they treat people.Have you any advice on complaining to the OFT and do you know if they actualy deal wuth cases like this?Kind regards angnnig

Hi DOTCOM, We are unsure what to do as well.We are begining to to think that the risks are to high in taking Acenden to court for £3,500 and could get lumbered with thier costs if we lose and if that happends we will certianly lose our home as we are only just able to afford the mortgage as it is and we also have a reppossesion order on us with them.The FOS were completly useless and and said that Acenden are quite within there rights to charge us £95 late payment fees every month that we were late paying and all the other charges they add on.We are thinking of complaining to the OFT about Acenden passing the arrears amount off as charges and seeing if they will force Acenden to put the charges on to the overall mortgage balance and then at least Acenden wouldn,t have a hold over us with the reppo order and we would save paying the £100 of the arrears /charges of every month
  14. Hi all, If our claim for charges is less than £5000, are we liable for charges if we lose in court? We are on a low income and would be claiming a fee remmision to get it into court in the first place,so if we lost and had to pay thier costs, we could end up homeless,but it may never get to court and Acenden could settle of of court ,I haven,t seen many sucsessfull claims on here against acenden and being such ruthless******* that they are, something tells me they are not going to give in.Can anyone advise us please?Regards angnnig
  15. Hi We have decided to take the mobile money claim for charges through the FOS first. Not sure what we can put in the complaint section , Do we just use the bank charges argument in thier?. They have charged £12 a time for late payment fees, Thanks for any replies. Regards angnnig
  16. Just wondering if there are any more links to people that have won against Acenden (spml),I know about crapstone .I have just been reading about the maroonfox court case and the costs they had to pay,really very scared and having second thoughts about taking Acenden to court now

Hi Thanks for the link DX.Can we try to claim restitutionary damages on the basis that Acenden tried to evict us and charged us solicitors costs, as the money we so called owed them was made up entirely of charges? Upon what i have read they have to have deprived us of the money for us to be able to claim restitutionary damages.Regards angnnig
  18. Hi we have jusy asked mobile money to refund £144 of late payment fees. They have just sent us a letter refusing to refund any charges . We are not sure whether to just take this to court or go through the FOS. They are saying that £12 late payment fees are fair. We owe them £250 and they have threatened to take the car of us if we dont pay. Thanks for any replies . Regards angnnig

Hi i,m not sure how to work the interest out with the mortgage charges, Do i use the same calculator that i used for the bank charges? and I,m not sure how to work out the restitutionary damages? . About the POC is that all that is needed for our claim? or do we have to put down the way they have treated us personally as well. Thanks for any replies angnnig

  21. Just had a letter from acenden.They have said that if we dont send proof of the taxi repairs within 7 days from the 7th of this month then they are going to evict us.We only recieved the letter today ,that gives us 2 days to send it to them.regards angnnig
