  3. We wouldn,t chance going to court just in case we get lumbered with the costs,so not much choice but to go down the FOS route,probably not get anywhere with it but at least we've nothing to lose,Kind regards angnnig

Hi I sent an email to the ombudsman and it took them all of a day to review my appeal and knocked it back , saying that mobile money are allowed to send out 2 letters a month and charge £12 for each letter and that mobile money have provided them with information that shows the charges applied to our account are representative to the of the true costs to mobile money of the admistering our accounts when payment was late or not recieved at all. We have until the 5/07 to disagree with them. Is it worth appealing? kind regards angnnig

Hi In march of this year I sent a letter of appropriation to the CO-OP bank to ask them to leave our child and working tax benefits alone as we need the money from them to pay our mortgage and priority debts. They have finaly sent us a letter back saying that they have the second right of appropriation (that means that the bank will deduct amounts on a first come first served basis with money deducted from the customers account in date order until there is no money left,or more is paid in. To request your first right of appropriation, you need to write to us at least seven days before a benefit payment is due to credit your account and specify what priority debts you require us to pay and when they are due. We did tell them in the letter that we need our benefits money to pay our mortgage and priority debts so how can they say we haven,t . They also liked to remind us that we are very lucky that they are still providing us with there banking services as they have sent out 13 direct debit default letters out and we cant continue to run our account in this way. They are so kind. I can post the letter up on here as its quite a lenghty one. Basically they are saying "get stuffed" . Can anyone advise on this please . regards angnnig
  8. Hi Maroondevo, Thank you for your reply, I will state what the OFT says in our appeal. Mobile money have also charged me 4 lots of £12 in one month when the payments are due to be paid monthly. so hopefully this will show the FOS how unfair they are treating us. kind regards angnnig

Finaly got a reply from the FOS they have said they have asked mobile money to provide information to establish whether the level of its charges reflect the true cost to it of administering an account when a payment is received late or not at all they say that the information they have recieved from mobile money is commercially sensitive and has asked for the information be kept confidential. Having reviewed the information the fos say they don't believe that mobile money,s charging regime is unfair or excessive so therefore they are unable to uphold our complaint. Just wondering whether it's worth appealing or not. kind regards angnnig

Thanks for the info scotgal.I have decided to ask the local MP for help .I have sent a letter to her and she has agreed to help ,she has now sent the bank a a letter and is awaiting a reply.Hopefully the bank will refund the charges.I don,t have much faith in the court system and if all else fails will go down the FOS route but at least thats free and wont cost money if we lose .Regards angnnig

  14. Hi ,We recieved a letter from the co-op bank today and they have refused to refund the charges based on the high courts decision on bank charges.Are we waisting our time going to the FOS with this? kind regards angnnig
  15. Sounds like you,ve been to hell and back with them,but good on you for keeping strong ,when a lot would have given up. Nig my partner is a taxi driver and we,ve had a bad year on takings and a lot of car repairs ,which has set us back again,We,ve informed Acenden in writing every time but they have still charged us £115 litigation management fees every month,we have only been a couple of days late for some of the months but they have still nailed us and the small print that they send you about how late you are allowed to be until they charge a late payment fee is just so hard to get your head round and you don,t even know were you stand with the sh****ts .and how do they divine litigation management fees and arrears managment fees ,I would have thought they were all the same to me .Thats, that lot of my chest lol.They really do make my blood boil but its good to be able to let of steam on here and a relief to find out were not on our own.Any way enough of me ranting on, Merry christmas xX

Well done for beating the shower of sh****ts.I cant believe how hard faced they are and keep getting away with it.a few years back we got forced into paying £340 a month off the arrears on top of our normal mortgage payment and because my partner fell ill and couldn,t work,we sent them a few letters asking them to lower the payments but they refused and we ended up nearly getting reppossed a few times the last time they tried we finaly got the court to help us and they had to accept £100 to be paid off the arrears ,which they should have accepted in the first place but they wanted blood and kept on adding the ridiculous charges.I just wished I could find something that we could get them on ,i think we are just gona have to keep on with the fact the the charges are extortionate and that they are profiting from peoples hardship.kind regards angnnig

  19. Yes you,re right Crapstone ,my head must be really done in to miss that:|, thanks. At least its a good thing in a way though, that Acenden won,t be able to repposses our home on the other amount( charges),Hopefully not anyway.Were gona get xmas out the way and try again for a third time with the FOS,really struggling on how to go about this .Kind regards angnnig

Well it wouldn,t be a good thing for us as Acenden have put our charges down as £1116.7 and this amount is wrong, they now owe us over £3000 in charges fees.I do understanding what your saying could be a good thing,but Acenden are now trying to look as though they are being fair in the FOS eyes by seperating them, thus making it harder for us to claim the charges back as the FOS see that Acenden is not classifying charges as arrears.regards angnnig
