  1. The response from Barclaycard that I mention in the above post, was received over a month ago, and I have not corresponded with them since, yet I received another letter from them yesterday! They saying they have nothing more to add to their final response and if I'm still un-happy, I should complain to the FOS. How strange!!! Their letter is dated 26/07/08, 2 days after my above post! I doubt this is a coincidence, I can only assume the following....... Barclaycard monitor this forum! They seem very keen for me to pursue this with the FOS .
  2. Thanks for the response Reinet. How did you get on? Did you win? Norton say they were not regulated at the time and that they supplied the PPI on an 'Information only' basis (They say in accordance with FSA guidlines???), so what would my angle of attack be? Would it be that they are in breach of CCA 1974, where a company must be fit to be involved in the activities the licence covers? and/or a breach of Unfair Terms in Consumer Contract Regulations 1999?

I recently complained to First Plus regarding the mis-selling of two PPI policies on two loans, and subsequently received a refund for the 2nd policy (see here: http://www.consumeractiongroup.co.uk/forum/payment-protection-insurance-ppi/137511-bog-first-plus-ppi.html ), but the 1st was refered to the Broker (Norton Finance). I now need some advice on how to progress this, as they are blaming each other for the mis-selling at the moment! So here's the story so far….. 1. Applied for 1st loan with Norton in October 2004. 2. Call from First Plus to set up loan from Norton referral - 5 year cash back discussed, no other discussion re PPI. 3. May 2008 Complained to First Plus re two PPI policy's 4. First Plus referred complaint re 1st loan to Norton, as they sold and set up the policy. 5. First Plus agreed 2nd loan PPI mis-sold and refunded. 6. Norton responded by saying they do not believe they mis-sold the 1st policy, as they set it up on an information only basis in accordance with FSA guidelines - They say the policy was explained to me at the time and documents would have been sent out to me. I never got them! 7. Wrote again to Norton with S.A.R - (Subject Access Request) request, specifically asking for the recording / transcript of the original call. 8. Norton responded by sending my £10 back saying the enclosed info is all they have on file. They enclosed a copy of my loan agreement and a First Plus branded PPI Policy document (both faxed from FP). The policy document I had never seen before! The also included a call log (Date, time & brief details of the call), but stated they have no transcripts or recordings on any of my calls! 9. I called Norton today questioning who underwrites the policy and they called me saying they do not set up policies, they only refer clients to loan companies via a referral form - they put a tick in the box if clients want PPI. The loan company then set up the loan and the PPI. Norton then receives a commission for the Loan and PPI. I know I never had any conversations with Norton re PPI and by there own admission they only put a cross in the PPI box on there referral form. When First Plus first called me after receiving the referral from FP, they advisor briefly talks about the PPI in terms of the 5 year cash back, but does not go into any more detail! (I have the recording from my FP SAR) Neither First Plus or Norton fully explained the PPI and the costs involved or exclusions that may apply. So who is to blame here? Who should I go after? In my opinion, First Plus are to blame as they provide the PPI policy and did not check it was fit for purpose. They have also taken the premium and all subsequent payments! Any advice on how to pursue this would be welcome.
  4. I got my £10 back when I claimed my bank charges back from First Direct. I think the logic is along the lines of, if they had not had stiffed you in the first place, you would have had no reason to SAR them! Restitution I suppose

  6. I agree with Braveheart, SAR the broker. I'm in the same position as you with First Plus and Norton Finance (Broker). FP have said that Norton sold it and passed my complaint to them. Noton have denied mis-selling, so I have sent a SAR to them. I want to know who to go after?

Hi Love Bug, Good luck with your claim It will probably be a long fight, as Barclaycard will stall at every hurdle -they will not send ALL of your SAR documents and then fob you off with standard letters.   8. Update: I finally got a response to my formal complaint letter from these idiots! After months of writing to them and escalating the complaint, they send a basic computer generated final response letter and another FOS leaflet! (I must have about 10 of them from BC lol). They have subsequently sent a formal demand for payment of the account and threatened to take me to court! BRING IT ON YOU BARCLAYCARD IDIOTS! Seriously, I'm just debating what to do now - I doubt they will take me to court, so I will take them! I think I will claim for the PPI first and then when that's done get them for harassment and get the defaults removed for the un-enforceable credit application (which they seen to think is a credit agreement) Or should I do both in one big case?

Why on earth would I take the time to put together a spreadsheet to help other forum members just to get their IP address, If someone wanted our IP addresses, I assure you they would have no problem in getting them! I would happily upload it to the Forum if someone tells me how! Only trying to help, especially when the most common question on the forum is how to calculate the refund amount.

  15. I'll send it through to you, as I would welcome the feedback. I'm far from an expert on these calculations, but if between us we can create a spreadsheet which other CAG users can use (If relevant to their circumstances)
  16. ????? If you are guessing your figures then yes, but if you do your SAR and get the actual figures from the lender, then it is possible to calculate!
  17. I have actually done a spreadsheet, which gives a fairly accurate figure and helped me with my sucessfull calim with First Plus. It's not perfect, but my figure was very close to what First Plus refunded ( I have sent it to a couple on Mods for review and upload to the site, but no one has come back to me
  18. I'd like clarification on this one too! First Plus have forwarded my claim to Norton Finance, yet I have had my payments taken by First Plus!

  20. Right, bit the bullet and submitted my claim on MCOL- the way I see it, I can't see I Judge deciding in First Plus's favor as they have already admitted the PPI was mis-sold! If it had gone to court before their admission, and I had won, First Plus would have had to pay interest!! I supose now it's just a matter of how much! I will keep you updated on my progress, hopefully FP will not defend and pay up! If not, I'm up for the fight out of principle
  21. No I agree, the reason I asked was to get some clarity. Also, I assume First Plus have not gone bust, but just stopped opening new accounts??
