  1. I don't mean to be negative, but I think Norton are too arrogant to ever consider they have done anything wrong. I have written 3 (good IMO) letters to them and they still reject the claim. I'm now just preparing my POC, because I think court action is the only way they may pay up.   2. Their not that hard to beat, some people have had some quick results (me included ). They are a bit random on how they deal with their complaints, but you will win in the end. The sales tactics leave a lot to be desired and they know it - all they are try to do is drag out having to refund for mis-selling
  3. First check they have actually got it. I know you did not give them a timescale and most companies complaints proceedure response time is 8 weeks, but I always ignore that and give them 14 working days. If feel this is more than enough time for them to investigate (and print out there standard fob off letter ). I try to dictate the time, not let them - not easy but it puts you in control.
  4. Not sure why being a broker and receiving commission would change anything? But your assumption is right for the initial premium. You also need to consider you have been paying Paragon interest on that premium within your loan's monthly repayment, so that needs to be refunded (+8% interest) for each and every payment made to Paragon. If the FOS has upheld your complaint and Capital have to refund you, what happens to Paragon? As it is they who have your money and have been benefiting from it! Do capital have then try and recover it or are Paragon just quids in? It would be interesting to find out!
  5. First Plus are terrible at providing you with detailed break downs of figures! Did they include settlement figures in your S.A.R - (Subject Access Request) for the first loan? Did you get one when you opend the second account? If not, ring them (or write) and get them to send it to you - I rang them and they sent it out within a couple of days! This settlement letter/summary is not as detailed as it could be (as I said, First Plus like to keep you in the dark!), but it has the numbers on there to work out what you are owed - It was the most usefull document for my claim.
  6. It just gets better and better..... Barclaycard have sold the account to a debt collection company despite impending court action (N1 Filed), despite the account being in dispute and despite the fact they do not have a properly executed credit agreement! Why do they insist on digging bigger holes for themselves?? Just wrote a nice letter to the Debt Collectors informing them they have been stitched up by BC and have been sold a debt they can't legally enforce . BTW don't report BC to Northampton Trading Standards! I called to chase my complaint and was told in not so many words they do not tend to pursue complaints about BC as the are a major employer in the Northampton area .
  7. I, like you, get very angry the more I think about how these organisations behave and IMHO, I belive it is fraud! BUT..... please follow the advice on here and follow the process for reclaiming. That way, when you do get your money back, the satisfaction will be that much greater and would not have caused yourself extra stress! These companies will get there come uppance one day - just look at the amount of PPI claims now being won - this is going to snowball like the bank charges and hit them where it hurts - their profits! Yes, they will try to get there money back in other ways, but now they have a problem... Sites like this and consumer knowledge! Good luck with your claim!
  8. Yep, that's excactly the angle I took and when they reviewed the tape, the said they were 'un-happy' with the way it was sold (Note they don't like the term mis-sold) amd refunded the PPI. It's seems they are settleing some claims and fighting others (even though they must know the dont have a leg to stand on!) Good luck and dont give up!
  9. Keep going - thats a fairly standard response from Barclay's It's up to you on what to do next..... 1. Write to them again with a stronger letter with more evidence. 2. Refer your case to FOS or consider legal action (If you feel you have v. strong case and want a quick resolution) Whatever you decide, please don't give up! - we can't let these b**stards win!
  10. I'm just about to send off my allocation questionaire, but have a couple of questions...... 1. Should I attach the schedule of charges as I was unable to do so when starting the claim on MCOL? 2. Should I attach a more detailed POC, again due to the limitations of MCOL? Perhaps including the following text: 'Please find attacted a more detailed POC than submitted on Money Claim Online, which provides the basis of of my claim' Any thoughts??
  11. Norton will respond, but they will completely wash their hands of it! They are a very arrogant company, so I look forward to taking then to court!
  12. Why are Blackhorse starting court action, is it because you have stopped payment due the account being in dispute? The reason I ask is I am in a similar position with Barclaycard and want them to start action!
  13. Well FP are defending and I have recieved a copy of their defence - what a joke! All the seem to say is that I never requested interest to be refunded (Yes I did and it's clearly in the letters I sent!) and that they don't understand the legal arguments I put forward! Well I do, so it looks like it's gonna be fun in court! They also say that the line in their letter that states 'We are not happy with the way the PPI was applied to your account' is not admission that the PPI was mis-sold! Well to me it is and the fact they refunded the premiums cleary suggests they know the were in the wrong!

  15. I would also send the SAR and the £10 and if they ignore it or try to charge you more report them to the information comissioner!
  16. This may be obvious, but I just want to check my assumptions...... When calculating a refund figure for Credit Card PPI, do you add contractual interest (APR divided by 12 - not an accurate way of calculating monthly interest, but close enough) to the monthly PPI payments and then add 8% statutory or contractual on top. My logic being that the lender would have charged compound contractual interest on the balance, which includes the PPI at the end of the month and so on, so we should be able to get that back. Then we should be able to claim additional interest on top for being deprived of that money due to mis-selling. I suppose the only issue is what APR you apply, as it may have varied during the time you had the account. Would you use the initial advertised rate or the lenders current advertised rate? I welcome your thoughts...

I have just found out that Norton did not follow any of the codes of practice laid down by the Association of British Insurers (ABI), the General Insurance Standards Council (GISC) or the Finance and Leasing Association (FLA). They claim that prior to 2005, they were only following FISA guidelines. FISA has only one reference to insurance..... Does this help my claim for mis-selling as they did not follow any insurance industry codes of practice? And that they did not even follow the FISA guidelines, by not checking for any restrictions or exclusions? .

  19. Barclaycard will try anything (legal or illegal!) In my case they sent a copy of the original application form with it clearly saying I did not want PPI, so now they are saying I agreed on the phone a year later! yet they can't provide proof (recordings, transcripts or letters! WTF will they do next - forge documents!
  20. I would write back specifically asking for them to send the CCA or confirm in writting they have lost it.
  21. Be aware Barclaycard will not make it easy and will fob you off in the hope you will go away. The first hurdle you will come up against is their reluctance to supply ALL of you SAR data.
