    well, I took my 2 copies of the N1 form down to the local County Court today. The clerk had no idea what to do with the claim, as other people have said. Luckily, I went armed with the info alanfromderby gave in the Library section. She wanted to put it on other forms and all sorts. I eventually persuaded her that this was correct and just take the fee and file it please lol! So, claim filed, will see what happens now. Should I expect threatening letters in the post as per Seminole's case I wonder, or do you think they will have learned their lesson?

  4. Barclays acknowledged the claim today. They now have until 17 July to file a defence.

    regarding the particulars of claim for this DPA. Looking at the costs in addition to court costs - what should I be claiming? Just the approx £6.50 spent on postage, or should I also be adding in a figure for my time? If so, how do I calculate/quantify/prove this amount?

  7. and what will you do about the "order as to costs"? I think they should be paying the court costs, for making you get this far in the first place. After all the bluff and threats in the letter sent previously, they obviously sent the info to get out of going to court. As far as I can see, despite their statements to the contrary, they are not as sure of their ground as they would have us think. I'd want me thirty quid back too! I shall be filing form N1 tomorrow unless the postie has a parcel from Abbey for me
  8. Seminole, I'm sending the letter to Trading Standards tomorrow, just writing it now. I was about to copy it to Bromley TS, when I noticed that the address I've written to AK at has been in Chester. This is the address I've had correspondence from in the past. Does that make a difference? Is it their main office in Bromley, and should I go ahead with that particular rocket?
  9. yes you can claim them back. GE Capital are a nightmare. I suspect they owe me a fair amount in charges but since they haven't bothered to respond to my DPA request, I can't be certain. I'm filing a claim tomorrow.
  10. I didn't shout. I pointed out your error, which was important because it may have meant a mistake in someone's claim. No-one has asked you to keep your mouth shut. However on a site such as this, where the issues are at times complex, it may be best to do some reading around the issues before offering advice on a subject you, by your own admission, know very little of.

  12. all seems to be par for the course. It's the same defence listed elsewhere from barclays, and similar to those from other banks, also posted on this site. the fee is standard and can be claimed back from barclays when you win or they settle.
  13. "Come in number 6, your time is up" Aktiv Kapital's one month deadline is up today. Not only have they defaulted on my CCA request, they have now committed an offence. The debt is unenforceable until they do something about that
  14. Today is the deadline I gave GE to comply with my DPA request. I have not head a word from them since I sent the original request. They've had an LBA giving them 7 extra days, and no acknowledgement of that either. Off to the court this afternoon to file an N1 form to get an order to comply. edited: actually the deadline is tomorrow .. will file then.

  16. That's appalling. Have just sent the link to my Dad. They have a house (the house I grew up in) which is empty at the moment, although they've had tenants on and off for a few years. It's empty because they have to live elsewhere. My Mum is a priest and they have to live in the Rectory that comes with the post. They kapt the other house on so that they would have somewhere to retire to. Not sure how these new powers would affect them.

If there's another posta bout ti somewhere, can you dig it up and post all the info in the same thread? If there isn't another thread about it somewhere, can you give us some more info?
  18. to add to this, see my thread about an unwanted card from Capital One. I already have a credit card with them and last week they opened a new account and sent me a card for it - without my authorisation or signed credit agreement. I have no idea why it's suddenly appeared - and neither do they. When I called to complain about it, they tried to tell me I was breaking their T&Cs by having two accounts!
  19. See now when I tried to use my Capital One credit card recently, thinking I had more credit available than I actually did, the transaction was declined because I had only £9 credit available and I was trying to pay a bill of £15 or so - it's mad isn't it?
  20. I imagine, with the delays on some payouts, someone will eventually go through all of these before they get their money - and still get their money before the bank enters the courtroom lol
  21. Assuming he knows the correct amount - they haven't sent a final bill.
  22. I can't help but wonder what the shareholders might think if they wait until extra charges are added to a significant amount of claims.
