  3. Thanks guys. Caro court date was set for next week. The first case they sent the cheque with only 2 days to court action. They were even resorting to frantic phone calls to say the cheque was on its way. Funny when I phoned them back with one day to go, in order to agree in ending the court action. The lady on the other line had the nerve to claim she would make sure the lawyer and witness would not attend court the next day(Yeah right!!). Hopefully this will encourage more people to hang on eleviate(edit) every penny out of these people(edit). Good luck to all and a Happy and prosperous New Year Liam PS Survey and donation to be sent soon
  4. I have successfully claimed back charges from YB twice(including costs and intrest). They seem to be in the habit of folding in the last week before the court case(the first time it was 2 days before my court case). I guess they think if they hold on for as long as possible most of us will give up or accept a lower offer. Where are you upto in the process? My charges were well below £5000 so I went through the small claims. Perhaps you could have claimed in a series of smaller claims? Someone with more experience will no doubt jump in and help before you have to seek a solicitors opinion. Good luck Bigz
  5. Recieved a cheque this morning for full amount including court fees and intrest. It will certainly be a merrry Christmas for my family and I this year. Cheers to everyone for their help and donation will be sent ASAp. Please could you move this thread to won cases. Many thanks Liam
  6. Its been a while since I last posted round 2 the VISA charges looks soon to end. YB has just sent a letter to say they will pay charges and court fees but not the intrest. Am going to wait for the intrest. You would have thought they have learnt their lesson by now. Merrry Christmas and a Happy New year to everyone. BAH Humbug to YB.
  7. Thanks Caro. Yes I recieved charges, intrest and costs plus an additional £100.
  8. Bankers draft arrived today for FULL amount. Talk about last minute. Will send donation as soon as draft clears. I have a court date in January for the VISA. Role on round 2. Thanks to everyone. Liam
  9. Thanks for the advice Caro. They haven't tried phoning since. I will make a visit to the courts tommorrow for reasearch and will make sure all my documents are orderly this weekend(am not the most organised of people). Any advice on attending court would be appreciated.
  10. I am going to hold out. Thanks. Recieved a letter yesterday offering to pay for the bank charges plus charges on VISA(seperate case) and court fees but no intrest. They wanted an answer by noon of today!!!! While I was at work they contacted my home??? They would not say who it was only that they would contact me at work(Thank goodness for 1471). What do you make of that? 1 week to court. Liam
  11. YB has offered to pay charges + court fees but not intrest. Undecided on accepting or taking this Pain in the A@$E bank to court. Liam
  12. Sent Small Claims Allocation questionnaire of for my VISA account.
  13. Your thoughts on this rejection letter would be appreciated. Dear Ms Ross Thank you for your recent offer of £750 , I must inform you that I will not be accepting this offer. As outlined in my earlier correspondence I explained that the charges you have applied to my account constitute a penalty and therfore contrary to the Unfair Terms in Consumer Contracts Regulations 1999. To halt legal action and any further costs being incurred, it will be in your best interest to refund in full the total balance including bank charges, court fees and intrest totaling £1100.30 forthwith. Yours sincerely BigZ
  14. Recieved letter from YB this morning. They are offering a settlement of £750 for both my VISA and bank account. Am going to hold out for the £1100.30 they actually owe me in total. But its good news it seems like their starting to crack.
  15. Hearing date for the 30th October. It looks like YB's 2 witnesses and lawyers, are going to be busy if they ever show up to all these hearings?
