  9. *does a little dance* I won! Just like to add my heartfelt thanks to my hubby Stonelaughter for helping me through all of this. Couldn't have done it without him.
  10. I received a letter from Barclays this morning. They still contend that I would lose the case if it should go to court, but taking into account the "small amount" of the claim and the time and money involved in going to court etc, etc. They made me a full and final offer of £1088, which I have accepted. They originally tagged on a confidentiality agreement as a condition of the offer. I faxed an acceptance letter to Keith Jeremiah this afternoon, stating that I did not accept the confidentiality clause. I've just had an email from him - they are prepared to forego that in order to bring a swift end to the case lol. Cheque's in the post lol. Just as well, we were going to court on Monday!
  11. That doesn't alter the fact that the RIGHT to silence has been taken away. You may be well advised to do as suggested and say nothing before speaking to counsel, but the right to silence was removed by the Criminal Justice and Public Order Act of 1994. There was a huge contoversy at the time, but the media focused mainly on how it would curtail the raves popular at the time.   12. Barclays have entered their defence, and I am completing the allocation questionnaire now (it has to be erturned by Weds 2 August). I don't know what to put in the "other information" area. Can someone tell me what I should write here? I've used the template to complete the rest, but this is the bit I need help with and it doesn't tell you what to put in there! *breathe* any help greatly appreciated.
  13. ok, bit of updating needed here. Wrote to TS in Bromley and Nottingham. Bromley came back saying they had no record of a company by that name in Bromley and as I had written to my local TS they would leave it at that. Nottingham came back to me yesterday and I've spoken to them today. They are not, at the moment, going to persue AK about not supplying the information, because as it stands the debt is uneforceable. If they go after AK and get the information supplied, then they can come after the debt again. However, that's not the end of it. I got my credit file from CallCredit last week and found a CCJ on there, which I believe is from AK. I never received any information about this, as it all seems to have gone to an address 2 years out of date. TS have suggested I start proceedings to have that set aside. They are not sure if, once that is done, AK could re-issue their claim. Obviously the debt is unenforcable at the moment, but could they reissue the claim on the basis that it was enforcable at the time fo the original claim - 2002? If they do try and re-issue, then I have to call this guy back at TS and he'll see what he can do then. I'm also still waiting on info from GE Capital to see whether I will have grounds to try and get the default removed from my credit file. If I do, and AK refuse, TS have suggested exploring the issue of AK being fot to hold a credit license. For the record, I was told that TS are not best pleased with the credit reference agencies either, as they are not fussy about the information they put on file - such as people being given "grey" marks for paying off agreements early - a flag to lenders that they won't make as much in interest out of this customer.

Well, according to the reply from the Information Commissioners Office that Seminole got, a formal complaint about the Information Commissioners Office is made to .... the Information Commissioners Office .... who investigate themselves .... Stonelaughter, when's your meeting with the lovely Mr Geoffrey Hoon? Perhaps this should be added to the list of topics for conversation over Earl Grey and Rich Tea biccies.
