  2. Hi people, Latest update: Phone call from Emma Mole today at 14:40 We would like to settle this account.......gob smacked, what do I say. Anyways, the short story is, I need to draw up a letter to send to Emma, stating the total fee pain, and INTEREST....I was not going to do the interest, till she suggested it at 24.9%, so what the hell =). So any ideas please people, on drafting up such a letter, also I did ask Emma if I can use her name in the correspondence to verify the TOTAL amount I am claiming 941+540(24.9% interest...WOW almost as much as they have charged me). Any help would increase the % I give to the forum =) (might be one way to get people to come up with some nice letter ideas) Just a few more notes, on what has happened so far, well more like read the signature part of my post, as it does not always come up, as it tells you when letters were posted, and amounts received, and when LAB was issued, and to confuse things even more, it is the "Properly Executed Agreements", which nobody has relied to =(

  13. When I first came to this site, I found it very confusing. It took me a while to understand about the Announcement, and the BUMPs in each forum...maybe it was just me, I can only suggest on the welcome page, something which informs people regarding the 3 diffrent area's....another colour for BUMP's maybe?

    hi ya, Thiis just a heading they give to items you have purchased, as far as I am aware, you can not claim these back, it is only Overlimit, and late paymeent fees etc

    it is just a standard letter, depending on how much you want to claim back, as the offer is normally 1/2 the amount you can claim, most people send a rejection letter, which you can get from here If you have not done so already, I would also suggest you read the Faqs here This is also a very good step by step thread

  18. hi icepop55, Yes they do chop and change things, as I think it is down to the agreement they make at the time, with their client, in my case Virgin. I am going to bank the cheque they sent me originally, to see if it clears, if it does then I have almost got all my charges back. I am also going to send them a reminder about the last few days on the LBA, so I hope I can get the interest back on the charges they have made against me...might even try a higher rate than the 8%, just to reduce the amount of debt out standing. I have also been reading the thread regarding "Properly Executed Agreements" which I noticed you also participated in, I add a few questions on the bottom of the thread, as some things were puzzling me. Thanks again for your words, and help.
  19. Very interesting and long read, I have a question or 2 might even be 3 Does both signatures have to be on the same form? to make it a Proper Executed Agreement? As my signature is on the T&C's in the normal little box, and theirs is on a print off from an Internet application, top left with a date stamp. Also some of the information they have supplied is incorrect, as the present address has the wrong house number on it, they say for example 456 and it should be 556......but all correspondence does go to the correct house number 556. Regards

Hi icepop55, The account is from 04-05-03 I sent a CCA to Fredrickson's solicitors (Bryan Carter & co) on the same day I sent one to MBNA, a CCA (very bad photocopy, but you can make out most of it, with a magnifying glass)came back from MBNA, I have had nothing from Bryan Carter & co. T&A? sorry, I do not know this abbreviation, unless you meant T & C's, in which case as above.

Thanks icepop55 I am as cool as a cucumber in the salad tray in a fridge =) What is confusing me, is MBNA have never brought up the Fredrickson part before, why now? also I never had a formal letter from MBNA stating it has been passed over to them, till this letter today. below is a snippet from the signature box on what has happened, so you have a better idea. MBNA - £941 from 04-05-03 till 28-02-07 CCA and S.A.R - (Subject Access Request) sent 26-02-07 Statement and CCA arrived Prelim and fee charge sent Cheque for £430 arrived reject to settlement sent plus Request for full repayment on charge LBA sent 15-05-07 signed 19-05-07 The above is before todays letter, which I will add to the signature. Another thing bothering me, clause 3b states £20 and not £25 as they said in the letter - this came from a CCA request I think, at the time I was informed by a friend on what to send, and I had no clue on what was what, but I understand a lot more now thanks to CAG.
  23. Hi icepop55 I have done all 3 parts over the past few months:D .....damn it, the signature part is not displayed, it would have shown you the actual status;) . Fredrickson is a collecting agency, I sent a letter to their solicitor Bryan Carter & co(who were chasing me) on the same day I sent one to MBNA back in February, informing them it is now "in Dispute".
  24. Hi one and All, On 16th May I sent a LBA to MBNA, the singed on the 19th (thought they did not work weekends), I received a letter today, with the following response. The funny thing is, they sent me a cheque on 30-04-07 (same amount as above), which has not been banked. Do I rip it up? or keep it for now and see what the outcome will be, as I am claiming for just over £900. Do I just send a reminder that I am accepting this as a part payment, and they still have 7 days left from the LBA for full payment? Do I send anything to Fredrickson's? Regards
