How do they word the letter ?
-
It wouldn't be the first time they had put the wrong court on the demand, it should certainly be something you should mention to the judge...
-
You should show the judge just how angry and annoyed you are at having to deal with this, don't be bullied and try and understand what is being written in your 6.5, providing you get a reasonable judge and you are prepared to fight your corner, did you mean to say that they put the wrong court on the demand ?

telephone calls for someone else on my landline and mobile
42man replied to Sally7216's topic in Debt Collection Agencies
In the past when I have had texts and telephone calls (which have now stopped) I have reported the company name and telephone numbers and frequency to the Ministry Of Justice - consumer@claimsregulation.gov.uk (without the space) -
Using one of those 'quick sell' companies will only realise 70% maximum of the value of the house....putting it up for sale would realise its 'truer' value....tell him to get it on the market asap. Is he/are they in negative equity ?

You may like to have a look at these threads - http://www.consumeractiongroup.co.uk/forum/showthread.php?381778-LOwell-Statutory-Demand-old-Egg-debt&highlight=lowells And this one - http://www.consumeractiongroup.co.uk/forum/showthread.php?380607-lowells-statutory-demand-i-am-panicking&highlight=lowells Try and read through and do your best to understand what is being said, I can only presume it is Lowells / BWLegal or possibly Connaught / 1st Credit. Please shout if you aren't sure what to do...

I wish I could have had a look at your 6.5 witness statement
-
I'm very, very sorry to read this, it sounds like you had a poor judge.....are you able to post up the agreement (minus personal details) ? Did it have your name and address on it by chance ? Do you know if the interest on the agreement corresponds with the amount in the statements ?
-
If you pay £50 it will restart the statute barred clock for another 6 years....
-
If it was me in your position I wouldn't be paying £50, you are setting aside the demand, due to a number of significant disputes, no agreement, potentially missold insurance, no statements for the duration of the account (to check the agreement matches with the interest rates) no compliant default notice etc etc... - Have you had a read in here ? - http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?190-DCA-Legal-Successes

Thank you queenplum, interesting that he tried to use the Waksman ruling.. -
Don't interrupt, but do backtrack on points raised that you are not happy with. Don't be bullied...let us hope you get a decent judge too

Call the judge sir / madam
-
If they do, then be cautious, say that you will listen to what they say, it has been known for things said in the waiting room to be carried over to court, and a person who seems nice and friendly in the waiting room can turn in the court room. Be polite but firm, speak a little louder than normal, puff out your chest and show the judge just how angry and upset you are at having to deal with this....good luck.
-
Send this email back. Dear Sir Many thanks for you email (dated). For the record I will only communicate by writing. I do not think that this is an unreasonable request bearing in mind the circumstances. Yours faithfully

Funeral arrangements for Martin - 14th Feb - 1.45pm
42man replied to BankFodder's topic in Martin3030
A wonderful service extolling the helpful, caring and kind qualities of Martin. The Eulogies were read by the Deacon, the hymns included Abide With Me, The Lord's My Shepherd and the recessional music was Frank Sinatra's My Way. Rest in Peace Martin -
