  2. no.. barclays barrister = inexperienced trainee, who probably knows less than you do. however, get all you paperwork together just in case.
  3. hi raz it's REALLY frustrating i know, but... i realistically wouldn't expect to get any money from them until approx. 7th sept your claim will be on a list according to 'court date' order, and as long as they schedule to pay you around that time, and with no major extra costs/increased claims, it will go through , and they will be considered to be doing their jobs well..... until it changes, unfortunately that's their strategy, as crazy as it is....

  6. OK so this is the conclusion, finally... received full settlement into my personal account today. Tom Hickey didn't actually promise it until thursday, so it came a day early, credit to him / them i thought i would mention this, as there is a lot of bad stuff going round at the monent about B's not paying people (understandably,.....and I was one of them until today !), so i suppose i have to provide information if i have it, that balances the story out. i have had no real problems with tom hickey from the start of my dealings with him, he has been fair and stuck to his word, albeit a bit slow, however, we must all take the responsibility for the speed of these claims as we are all constantly bombarding them with emails and phone calls all day long..... something has to give somewhere unfortunately, and again it's the luck of the draw as to who slips.. anyway, again thanks to everyone, i will continue to do anything i can for others on this site, as i still beleive in the cause wholeheartedly, and wish everybody to get their money back !!! :D btw, money goes to - four fifths for TAX BILL due end July !!, the rest - small holiday sometime next year (no time this year) it does make me MAD, particularly as i've just heard on the news that the government are spending millions of my (our) hard-earned TAX money on paying out drug addicts as compensation for 'trying' to stop their habit !!!!!!! i think i'm going to go and live on a desert island somewhere, and eat bananas and coconuts all day, life would be so much easier !....
  7. hi catscash & mazza i hate to p*** on anyone's bonfire, but (just for your ammunition against barclays) i recieved my money into my account today, in fact tom hickey didn't promise it until thursday , so it was early. i know thats just kind of annoying to you guys, but i suppose it is all information thats helps us put a clear picture together of whats going on with the Lit team.....(a random shambles, i guess) not sure ? sorry.... still, fingers crossed..
  8. hi following katscash and mazza's threads, both have had settlement agreed and gone to court, but no money, i'm in the same position, court date is monday coming. got e-mail from TH this morning saying should be in my account thursday, well,, we will see ! my question really is, do you think that your problems getting the money may have something to do with putting money back onto a card account that isn't barclays directly?? similarly with mazza, the account is closed, and a cheque has to be raised. mine is straight to my personal account which is still open, so i'm hoping that that might make it easier to go through, or am i dreaming ?? fingers crossed for all of us...............

  11. he's ok to talk to not a hotshot lawyer or stubborn or anything sounds quite young, but reasonable... i dont think anything you say on the phone will ruin your case, as long as you dont get too angry.

  16. Well, it's been a long(ish) battle, but finally got SETTLEMENT AGREED today !!!..................... Received offer letter in post yesterday, for the full amount of my claim. However, a couple of weeks ago I realised that I had wrongly just added 8 % interest on to the total amount of charges. After using VAMPs interest calculator, the interest accrued from the first penalty (2001) made the total claim some £600 more, i sent the new information through to Barclays and the court, knowing it was really too late.. Anyhow, called TOM HICKEY today, he said that if i persued the full interest, then it would probably warrant them sending a barrister to my case to argue the extra costs. We haggled and I agreed to £5000 (£200 more than my claim) but told him i would be starting another claim for new charges + costs. He seemed to think that was the best way of getting what i wanted. money should be in my account by tuesday, I will crack open the rum only when i see those figures in my account. HOWEVER, just as an aside, unfortunately i have a large tax bill to pay end of July, so most of it goes to paying that anyway, back into the capitalist system !!! oh well, life's a bitch....etc... THANKS to everyone for helping me, particularly daren & saintly on the barclays forum, i will be making my donation, and starting up my next claim soon.... you don't get rid of me that easily !! :D :D In the words of QUINCY JONES: " It's not about your acheivements in life, it's all about the journey getting there...." . . . .
  17. in my opinion (for what it's worth !) re-jiggling your claim for large amounts of money is a bit risky, it's unlikely that B's will settle with this interest, particularly if it takes it to a high value claim, (say) over £5000, and we don't know how the judges are going to be reacting to these cases in september/october ? your swapping a certainty for an uncertainty, and comes down to whether it's a risk worth £1000 , possibly it is, and I'm sure you'll get loads of help from people on this forum, as we all love a good bunfight !, but , is it easier to just take the money, and get on with your life, without the stress ? of course only you can answer that............. good luck anyway

  20. me thinks it's 'land ahoy' mateys ! would appreciate one last peice of advice from you guys, maybe darren or saintly could help.... i recieved my settlement letter today, ok, hoorray at last, however, when i first put in the claim via MCOL, i added simple interest @ 8%, and afterwards i came across the calculator and realised that i stupidly didn't add the accruing interest since the first penalty. i just added 8% on to the total amount. so original claim was wrong (idiot). by using the calculator, the interst is £846.55 more, i did amend the claim with the court and with barcl's, however, the settlement offer, surprisingly, is the lower figure. my gut feeling is to hold out for waht i asked, but in your opinion could i fall at any hurdle by doing this...... nearly there....

  22. im no expert as i've not got my settlement yet, in my (dubious) opinion unless you have dotted every i etc... and you are sure that they or the judge can't get you on any technicallity, then continue to push, however, I'm a bit of a coward, and i just want the money owed to me as quickly as possible, so i used the calculator for simple interest of 8% if it goes to court it could still be weeks before you get any money, for a variety of reasons...... i'm rooting for ya anyway....
