  1. nothing's been sent to me in writing yet that's the confusing bit and i'm told my directions are delayed because they've been changed is going to the court in person of any use? it's another £100 and a lot of work that I'd really appreciate not having to do in my current situation
  2. saintly - that Statement of Evidence you direct us to is different to the one in the court bundles thread - which should we be using? the latter seems more polished initially, is it no longer recommended and if so could the court bundles thread be amended to reflect this It's DEEPLY confusing

This morning I started preparing my court bundle and phoned the court to ask why I hadn't recieved my directions yet They told me all cases are being stayed until the test case is resolved and that I shouldn't try and pay my AQ fee or do my bundle yet, just wait for the letter. Somehow this is slightly scary and I asked the gentleman on the phone to reassure me I didn't have to do anything now and he did but still - should I stop and twiddle my thumbs now? ps. tunbridge wells county court for interest's sake
  4. I'm busy preparing a bundle as well - should that be used instead of or in conjunction with the new POC letter in the sticky above?
  5. Thanks very much! I've had my preliminary hearing for directions and am now preparing a court bundle for the 10th - would there be any value in sending this to the court now in case Barclays are busy applying for a stay as we speak?
  6. SO is there any kind of draft of letter that we should send to our courts to request that they do not allow for a stay? For some of us this has already dragged on for months and months, another 6 months and I'll be within reach of financial disaster. Seeing as they have been paying everyone off and just delaying it as long as possible it is surely even more unfair to allow them a further 6 months or more delay before they do what they have done in thousands of other cases and pay up
  7. thanks for the reply - that's what i figured, the schedule of charges, all the statements refered to and the details in the basic court bundle are the right things yeah? the instructions refer to me having to provide all evidence i will be relying upon in court
  8. Well I emailed Dino and he said I'd just have to wait and they weren't bothered if it cost them more. Such is. Kinda wondering if this thread is on ignore
  9. well was preliminary hearing today here in tun wells - barclays did send someone, a poor flustered girl lawyer who kept it together and said she actually enjoyed it all! gave them the standardised directions from this forum and the judge decided to change them rather a lot on the defences' side removing all the requirements save the evidence they will rely upon in court but kept the sequential nature (i.e. claimants full details and evidence first) due to the lack of details in the MCOL claim details. sadly they got given three whole weeks to prepare their pap and then the court date will be sometime after the 7th sept. my god this drags on... phoned Robert Saunders again to offer settlement without having to pay the extra for the AQ fee and extra charges I am recieving in the meantime but he had little to say save they have so many cases going through at the moment they are just busy firefighting the actual final hearings going on each day what to do.... prepare court bundle i guess, or should I try phoning or writing to other members of the litigation team offering settlement before they have to add another 10% onto the payout?

  13. sorry to quote myself but I have a question: from what Dar3n has said on here I'm starting to think I should be phoning back tomorrow demanding immediate settlement and all my more recent bank charges refunded too... should I? please help as that's a very appealing idea.
  14. Robert Saunders - not evil ditto Thomas Hickey who was helpful and friendly getting me transfered directly to the right person. The call went well, and he started chuckling strangely by about the 6th word of that little script on post #24 - I think they've heard it a fair few times Apparently they're now working on claims up to the 19th and getting onto the next week's which includes mine and I should expect a letter within a week or call back. That was worthwhile
