My partner are i went to our local Tesco Store on Saturday afternoon, after mooching about and getting what we need, we headed for the busy tills, we loaded our shopping up and it came to £33.67, i handed over my Electron Card to the cashier for her to swipe, entered my pin and waited, the cashier said an error message had come up saying 'Use another method of payment' she said to me i'll swipe it again and the same error message came up again, so feeling a little embarassed i went to the cash machine with the same card and took the cash out, on my return i said to the adviser there must be a problem with there terminals at which she grinned as if to say 'I dont think so' it was most humiliating as i knew there was more than enough money in my account! In checking my online banking the next day (Sunday) i notice the balance on the account was wrong, yep you guessed it the 2 times they swiped my card and said it hadn't gone through it had basically i paid for my shopping 3 times, in contacting the bank they advised that they had put it through twice and to go to Tesco with the codes the bank gave me and get my money back, on going to Customer Services and speaking with a TL giving him all the info he went off in search of my money only to come back and say it was only taken once blah blah blah, which wasnt good enough by this time the manager had come down and told him to ring the Merchants who confirmed it had been taken twice so it was put back on my account straight away...... I have to add aswell that Tesco said they have been having a number of problems processing Solo and Electron payments so if you use your card in there i would keep a close eye on your bank balance or you will be giving the A LITTLE BIT EXTRA !!!!!!!!!!!!! NOT EVERY LITTLE BIT HELPS!

We moved into our 1 bed apartment in April 06, due to the fact we have an apartment there is no gas in the building so everything is electric encluding the heating, we currently have Economy 7 heating which is a law to itself and we have been recieving really high bills for this, we only have 3 heaters one in the bedroom, lounge and bathroom, we used to pay £30 per month which we didnt think was bad until we got a bill through saying we were in debt by £400, we called to be told there is nothing wrong with there meter and the readings were correct, we were told this on 4 occasions so we had to increase our direct debit from £30 per month to £108 to compensate for the debt, as we live in an apartment we weren't allowed access to our meter cupboard (which is rubbish) but as the apartments have been taken over by a new management company they gave us the code to check our meter and can you believe it, they Powergen dont even have us on economy 7 they have us on the same daily rate to night rate therefore our bills have been sky high, basically they are saying we use the same amount eletric as a 5 bed house would (i dont think so) we spoke with a really helpfull lady that took our meter readings and asked us to do an hourly test as she agreed that all our account info was a complete mess all wrong from the day we moved in, she is sending us out a bill and we are to call her back once recieved and they will credit all amounts owing to us and put us on the correct tariff, my advise to people is dont give up as they will try to rob you best way they can!

My partner has just got his divorce through yesterday, the house he shared with his wife is and was bought in joint names, we have enquired about taking his name off the mortgage, it cant be done, unless the other person agrees to this and signs to that effect if this has been done without your permission i think they are all in the wrong especially Northern Rock because they have to have written consent, we are having to apply to the courts for a Consent Order which costs £40 to have him removed completely again the other party has to sign to say they agree.

I have 2 defaults on my credit file which i wasnt aware of the debts that the defaults relate to have since been paid off so they also state satified next to them, i was never told by either company that they would be putting these defaults against me and as a result i can no long obtain credit, does anyone have the letter i need to send to these people to see if i can get these defaults removed? If you contact the people you got your credit report from and query whats on your report, they will do it all for you, they will contact the company and get them to amend it or delete it, it happened to me someone was allying for things in my name, i conacted Experian and they wrote to the company then had a letter through a few weeks later to say it had been removed.
  6. Im pretty sure that you cant claim bank the annual fee as it is in the T&C, and you did agree to pay the annual fee on the card, have a read through peoples threads im almost sure you cant.

I filed my claim with MCOL against Barclaycard alomost 4 months ago now, i got sent a letter from the courts which was Barclaycards defense saying my claim was to vague and i need to send in more details a AQ would be sent to me to fill out, i never recieved an AQ and was sent from the courts (Cardiff Court) a court date as the 14/08/07 i know quite a few people have had this date as they are doing there cases now in bulk to get them out the way, having won already with Nationwide last year i got a court date it was to be heard but they settled before this date, i was sent a link by someone else with reference to Cardiff court dates etc nearly everyone on there has had the questionnaire and they have filed it out as a prelim, im just a little worried as i've not had one, i have never been asked to back up my claim, could it be that the court decided i have provided sufficient info and there is no need for this? I have cintacted the courts about this but they dont seem to be worried about it do you think is because they know they will pay up before? Please advise.....????

Ahhhh thanks for that i am a little confused being blonde and all that, when i got the court date with Barclays i was under the impression i didnt have to do anything i never got an AQ through the post to fill out and they havent sent me anything other than the hearing date im not under the impression i had to attend....when i went through this with Nationwide last year i won £2000 was given court date etc but they settle before the date, do i have to now do anything for my Barclays one? I will be down the courts when i get a mo with my Cap One N1 form filled out signed sealed and deliverd with a big smile on my face!

Yeah Barclay Card one is, i filed it ages ago with MCOL and was sent to my local court Cardiff, Barclays then filed a defense said there wasnt enough info etc so i would have to fill out a Questionnaire that the courts said they would send but never did, then recieved a letter from the courts with a court date of the 14th August, havent heard anything since then! I did send the LBA to Capital One along with a list of all the charges etc this is when i recived the letter offering me £137, which i then sent the rejection letter!

I sent a letter to Cap One on the 19th June requesting they pay me the charges etc that were on my closed account going back the last 6 years, Cap One had 14 days in which to do this, I received a letter from Cap One on the 29th June (with 3 days to go before 14 day deadline) with an offer of £137 even though i was claiming £597, i sent them the rejection letter saying thanks but no thanks, telling them that my original deadline still stood 2nd July and i would give them another 7 days from this letter which took it up to the 8th July to reply before i commence court proceedings, well guess what the 8th July has been and gone and still nothing from the theiving gits....am i now ok to file the claim in court i wont be using MCOL as i done that with Barclay card and the court date is now not until 14th August it was filed 3 months ago!

We sent a letter a few weeks back to Lloyds to get a copy of the statements on my partners account it was the standard letter with the £10 cheque but we forgot to put the cheque in oops.........anyway we recieved a letter back from Lloyds today this us there response..... Dear Mr XYR We refer to your letter dated 15 June 2007. Statements were sent to you on a regular basis, whilst your account was still open and any interest and charges were added correctly in accordance wiht Banks' Terms and Conditions. We are, therefore, not prepared to re-request statements free of charge, as any dispute should have been lodged and resolved at that time. (all we have done is ask for statements how do they know that we are going to be claiming back charges they are just assuming and i love the way they get all defensive). A fee of £10 per statement, up to a maximum of £40, will be charged for any duplicate statements required. Upon reciept of the appropriate fee and the dates of statements require, we will action your request. Please feel free to contact us...blah blah blah..... Are they allowed to charge this amount of money for duplicates, i know it was our fault in forgetting the cheque but £10 per statement, we are not sure what to do next now as thats allot of money for pieces of paper, please can anyone help?????

I would just leave it, i filled a claim with MCOL quite a while ago, they to came back with a defence, its now in the hands of the court, having done the same with Nationwide they filled a defence blah blah blah about 5 days before the court date i got a letter they had transfered all the money i was claiming, interest and court fees into my account £2000, they say they will defend but trust me they wont, just stick it out and enjoy!

I need some help with regards to Capital One, i wrote them a letter claiming £597 worth of charges applied to the account, today i have recieved a letter saying they will pay me the difference between what they were are what they are now being £136 i am not prepared to accept this and want to write to them to tell them but im not sure what letter i should write any help would be great, i would like to get this in the post today because of the postal strike.

If you have a look at some of the other posts on hear you'll see that letter is a general response letter, people are saying to go onto the letter templates section pick one of the letters on the under rejections and file the claim in the court, doesn't matter if they've sold the debt on they are still resposible. I'll see if i can find the letter you need

Failure to comply with this request will result in legal action against you for full recovery, as detailed in my Letter Before Action. For the avoidance of doubt, I wish to stress that I do not accept your offer under the terms stated in your letter.   18. I would ackowledge the letter they sent you but however state that you are seeking payment of the full amount therefore rejecting there offer, then send them the LBA as they know whats coming they are trying to stop you from proceeding its a tough one.

Same goes you could either send the below letter or just go straight for courts, a little advise i read somewhere that people doing MCOL its is taking forever and cases are not being heard for months, my partners mother put a claim in back in March, Lloyds TSB have said they will defend the case isnt being heard by the judge until 14th August so you might wanna go to your local court to file the claim its 10 times quicker!! Account number: [iNSERT ACCOUNT NUMBER] I refer to default charges applied to my account amounting to [iNSERT TOTAL OF CHARGES PLUS INTEREST], which I have requested you pay back. I wrote to you on [iNSERT DATE], making the original request for a payment in settlement of my claim. As I have not heard from you/not received a satisfactory response [DELETE AS APPROPRIATE], I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court. This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour. I have attached a full schedule of the charges and interest with this document. [iNCLUDE THE PRINT OUT OF CHARGES FROM THE CALCULATOR AND BE SURE TO KEEP A COPY FOR YOURSELF] I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money. I have had a good read on Cap Ones sites they tend to make offers to people but not for the full amount to be honest if i get £400 back i'll be happy, i have them marked on my calender in big red pen that, that is there final day i've also typed the letter out ready as i know what the reply will be, this site is fab the advice you get on here is great its been a step by step guide since i first claimed £2300 back from Nationwide last September!!

Recently i cleared a debt with Capital One that had been passed to Lowell Financial after 5 1/2 years of me opening the account, they were chasing me for a debt going back to 2002 for £475, after much debating i opted to pay them to shut them up think i settled with Lowell at £380 whoopie! now i have paid them back and they're off my case its time to hit them where it hurts their tight pockets, my orginal credit limit with Capital One was £200 there was £275 worth of Late Fees and OL fees (the only reason there were OL fees was because they put on a Late Fee) i thought i would push my luck, i calculated on Money Saving Expert all the charges and interest that was put on my account and sent them a nice little letter on Saturday requesting they now pay me £597.00 back in charges and interest i wish i could be a fly on the wall when they get my letter, i've not doubt having won with Barclays and Nationwide that they will be paying me back i will most definately be having the last laugh, all the money, time and effort they would have wasted in tracking me down and trying to get me to pay them back will back fire big time!!! I'll keep you all posted, i know i'll get the Blah Blah Blah letter but they all pay up in the end!

Our current eletricity supplier is Powergen, we live in a one bedroom apartment so we have no gas in the apartment, when we first moved in and contacted Powergen they put us on a monthly pay plan of £40 we pay by DD and have never had a problem, then this morning we got a bill through from Powergen saying that they have reviewed our bill and they now want us to pay £147 per month due to the account being in arrears this is not out fault as the customer advisor said to us on the phone that when we first set it up we should have been paying £60 per month not £40 hence where the debt has come from, we told Powergen that we cant afford £147 per month but all they said they can do is reduce this to £108 Whoopie Doo or they can put us on a prepaid meter which is no good to us, basically they are wanting us to pay the £400 debt back over 4 months instead or dividing it over the next 12 enabling us to clear it...they just wont budge so now we have to find an extra £70 per month for a one bedroom flat! Is there anything we can do?
