  1. Hi, does anyone have an email address for Capital One, i accepted their offer of payment of my charges 2 weeks ago, the account i had with them was settled and closed in June this year so any monies owing should be paid directly to myself, i have heard nothing from them, i have written to them but still heard nothing, i know Barclays have an department that deals with these i was wondering if Capital One did?
  2. Take a Charge on the Property? Can you explain what that is
  3. To be honest she is very stubborn, and I wouldnt trust anything she says. She says she has, then she says she hasnt, the only ones likely to though i think would be the abbey given the history on the account. I think we will let it take its course, without signing the consent order. Least that way we still have a say over the house.
  4. It has been two years since he left her. She works as a personnel Manager for Asda and we assume her salary is around £28k, the house is worth £185 £190k Mortgage was £115k Secured loans of £10k and £30k on the property, My partners credit history isnt the best and as they are still financially linked, then I would assume hers would be in a similar state and it is also know that some of her debts are consolidated through the Credit Councelling Service. She has been Paying the Mortgage Since he left as well as the Secured Loans, plus she has recently got to the CSA as it now getting double what he used to pay her for maintenence
  5. One dependant who is 6, Lives with the mother in the marital home. All he wants is his name off the mortgage, so that we will find it easier to move out of the flat we are in. He is willing to walk away from the marital home, as long as his name comes off the mortgage
  6. I visited legalzone.co.uk free service posted the questions above, and got a response the next morning. They advised not to sign the consent order, for his ex partner to apply to the abbey first and she will have to go through credit checks etc and prove her finances that she can take it on. But we have doubts. Otherwise if i sign it, the deeds can be ammended (my partner would lose any right over the property) but he would still be on the mortgage so she would have it all as she wants. Liberty to apply then implies that it can go before the court then to let them decide.
  7. He has had two solicitors during the course of the Divorce. He hasnt benefitted from anything they have done, so once the actual divorce was finalised he finished with the later solicitor. So dealing directly with Ex Wifes Solicitor. I believe the consent order when its signed by my partner and Ex Wife then goes before the Judge is that correct?
  8. I will get my partner to discuss the Consent Order with His ex wifes solicitor as If he is removed from the deeds but still named on the mortgage then It doesnt benefit us really. He will lose anything he may have been entitles to regarding the house if its signed over to her, yet he still cant move on and get a further mortgage if its still taken into account. Thank you all.
  9. Hi Forum I am wondering if someone is able to offer any advice. My partner and his ex wife have recently got divorced. The marital home is still the remaining issue. The solicitor is drawing up a consent order, whereby my partner will not be responsible for any part of the mortgage or secured load on the marital home. As we are yet to receive the consent order.. .I am writing this in hope someone has experienced similar. Apparently my partners name is coming off the deeds, but due to his ex wife's current credit status cannot have his name removed from the mortgage as such. Is this possible to be removed from the deeds but yet still be named on the mortgage but not be responsible financially if it goes wrong while his ex wife is in the house? I am looking at this with a view to my partners credit score, if we try and move from the apartment we're in or generally apply for any credit.... obviously if I am not responsible for the mortgage then when lenders search, surely it should be discounted/overlooked but how is this done? Would he have to send a copy of the consent order to Equifax, Callcredit and experian to let them add something to his credit file. If anyone can shed any light on this matter it would be greatly appreciated.
  10. My sister is a Manager of a First Choice Travel Shop and i booked all my holidays though them, i have just booked an £1100 to Egypt and have had no confirmation of my booking only a copy of the invoice and thats it, you dont need a confirmation letter, you have an invoice with all the details on, you will get your tickets 4 weeks before you travel, you can either go in to collect them or they will send them to you....if you are truly worried about it go into the shop as someone else said and tell them your concerns im sure they will put your mind at rest for you!
  11. Yes they are, they said it was all in the small print but when we asked for a copy of the agreement and small print they said we should have one from when we opened the account...in other words its not in the small print they were talking out of there bottoms! I think its a joke, how they can do such a thing is beyond me im sure there are many other people its happened to aswell for no reason what so ever!
  12. Have you tried contacting the motor insurance company? Im assuming the payment is classed as a one off Direct Debit payment, you can go into your local Halifax branch and fill out an Indemity form, Halifax will then credit the amount back into your account and then request the money back from whoever the motor company was.....simple as, it happened to me last month and thats all i did took minutes!
  13. Next are a complete pain in the backside, my partner went through a similar situation, he opened an account no questions asked, spent on the account paid it off every month, the opening credit limit was £250 and after every month or so it would go up until it was £1000, we had never missed a payment never made a late payment at all so when we tried to use the card which you can apply for so you can shop in store aswell as on line, we were shocked when it was declined as in checking the balance that morning the limit was £1000 and balance was £500 leaving him £500 available, in calling Next we had been advised that something had come to light on his credit file (which we didnt agree to them checking again), which to us was rubbish as he had not applied for any credit since getting the card and like yourself if anything his rating was better than it was when the account was opened. All Next said in a letter is that they are entitled to do a credit check every month and that is what they had been doing but when asked what was the info that had come to light they had no answer...they put his limit from £1000 back down to £375 which ment as he has a balance on the account already of £500 that he was now showing as being over the limit....till this day we still have no clue as to what they were talking about, we also contacted Experian and they also didnt have any new info on his file so can only assume Next made it up.....also with regards to the credit check every month, when he signed the agreement he agreed to have one check for them to open the account not one a month this has now stopped and we have had several credits to the account due to Next being a nightmare, my suggestion is to write Next a letter or email them but im sure the answer would be the same as the one we got! Good Luck!
  14. I would contact the FLA if i were you, i had a similar problem and they were really good you can fill out the details online and they will act on your behalf, it should take no way near 6 months mine was sorted within 4 weeks max.... Good Luck !
  15. I used to work for ******* Card Services and part of our job was to offer Card Protection it was exactly the same as CPP, as far as i was aware you have to be offered it again after it runs out, so basically you would get a warning on your system and the next time you called in we could give the customer an opportunity to renew there policy not only the price increase has to be notified to the customer well in advance......All you need to do is contact the card provider by phone and ask for the charges to be refunded as it wasnt your fault that they were there in the first place, there shouldnt be any problems in them giving them back they will probably say they will do it as a gesture of good will but thats just there way of not admitting its there fault!
  16. If i were you i would take it back to a different store and try there, i have never had a problem with taking items back whether it cost £3 or £300, is there anything in the store that clearly states no cash refunds will be given?
  17. Today i recieved a letter from Cardiff County Court, my Barclaycard claim that was due to be heard in court this Tuesday 14th August has been STAYED, is there anyone else that has had there Barclaycard claim stayed i was under the impression it was just bank account claims.....has anyone done a template letter to apply to the courts to have the stayed lifted??? What do i do next?
  18. My court date for my Barclaycard claim is Tuesday the 14th August, yesterday i sent an email to the Litigation Dept as i was previously advised to contact them before the date, i spoke with Emma which i have previously recieved letters/offers from, in speaking with her yesterday she said that they had previously offered me £172 as i have already been credited with £132 in which i told her i hadn't, i had the card registered to an old address and moved without telling them as i no longer used the card, a year after moving they found me and asked me to repay the £500 outstanding on the card by this time it had been passed to a DCA, i settled with them in June 07 the full amount, in speaking with Emma yesterday she didnt know the account was closed and i'd settled the full amount according to there system i still had an outstanding balance of £261 which i havent as its been paid in full, Barclaycard tell me that they did pay £132 off the card which the DCA didnt tell me as if they did i wouldn't have had to pay the £500 it would have been less! Now im wondering if when my claim goes through on Tuesday that they are gonna pay £392 im claiming off the card and give me the rest as they are saying the account is still open when its been closed! Any advice would be good!
  19. Its only fair you would jump on the defensive, i never said you were all monkeys just the 10 people we spoke to before we got anywhere!
  20. We live in a one bed flat also with storage heaters and we to recieved a high bill, we pay our bill monthly we were paying £40 pr month which didnt sound to bad, we then get a bill saying we are £400 in debt and our monthly payments will now need to be amended to £147 per month, as you can imagine we went mad, called Powergen in which they said there is nothing wrong blah blah blah, we managed to gain access to our electric cupboard which our previous management company wouldnt let us despite being the owners of the flat and took meter readings etc called up and found out from day one we had been on the highest elec rate, they hadn't had us on Economy 7 we were paying one flat rate for the hole flat, this only came to light when the advisor asked us for what the day and night readings were on the last bill in which we replied there are no day and night readings.....we spoke with a lady in the Consumptions Dept which i suggest you do as it sounds like your not on what you are ment to be on, after we spoke with them it works out they owe us money and our bill is now in credit and were back to paying £40...... dont let the fob you off as they will as to speak with a manager not a monkey!
  21. Even if you paid by debit card you can still get your money back, i bought a DVD over the internet which after emails and phone calls to this company it never arrived as they said they never recieved my order despite taking the money for it, i contacted my bank who told me i could go into the bank and fill a form out and the bank would credit my account with the money and get it back from the company, i paid by visa debit and working for a bank i know this doesnt only relate to credit card companys...have you called your bank or has your husband?
  22. Can someone clarify something for me... I requested a SAR for an account I had with lloyds they have replied returning my cheque for £10 advising the account was closed in March 2001 they no longer have access to this information and therefore cannot provide the statements requested. Is this correct? Do they only have to keep them 6years?
  23. I took out a loan with Welcome finance back in my younger days in 2003, the initial loan was only for £1000 to get me started in my new home, this was to be repaid i think over 2 years, the total amount payable was £1500 i had been paying this loan off for what seems like forever, i only really sat down and thought about it in November last year that i had been paying for 3 years and it must be finished by now, on contacting them to find out what is going on i find out they took it upon themselves to re-write the agreement and i still had an outstanding balance or £1600, as you can imagine i went mental blah blah blah.....i contacted the FLA and they took over the case for me and Welcome wrote the debt off cheeky buggers! Anyway the point of this thread is i got a copy of my credit file last week and found out the had put 8 default payments against me and the account is still showing as an outstanding balance, when really it should have been written off back in December last year, can anyone advise what i should do?
  24. When the tow trucked collected your car did they do a vehicle inspection on it, reason i ask is any car that is collected from anywhere they normally do a vehicle inspection, which basically is a sheet with a picture of a car on where they walk round and mark down any scratches, chips, dents etc, this is then normally signed by you and you have a copy, they also make note of reg, mileage etc..if they done one of these and there is no marks on the sheet then thats your proof it wasnt your fault. If i were you i would forget about the phone calls and write a stinking letter to Fiat's HQ regardless if it was the tow truck or Fiats fault at the end of the day Fiat employ the tow company so its there resposibility!
