  1. I've just had a letter from Capital One, confirming the refund of PPI charges to an account which was sold to Cabot in 2007, and has been SB since 5th August this year. Are they allowed to do this, and if not what can I do about it? Not sure if this is the correct forum!
  2. Just having another magnifying glass moment! The application form clearly says, "For cover just tick the YES box, to confirm that you are eligible and have read and understand the terms and conditions". On another piece of paper, purporting to be the reverse of the application form, there are adverts for their PPI, it clearly says " Terms and conditions apply to all free insurances. FULL DETAILS WILL BE SENT WITH YOUR CARD" A bit contradictory, how can you understand T&C's when you haven't got them?
  3. Sent a letter, spreadsheet and FOS form to MBNA, they have refused my claim because it was a non-advised claim (pre regulation) and that I ticked the box. They sent a copy of the application form, and the box is ticked, but who knows whether I personally ticked it or not! I does state on the form (after studying with a magnifying glass), that "We strongly recommend that you take out this cover" Now my gut instinct is that I should take this further, but my head says I'm wasting my time, any advice please.
  4. I had a store card through GE Capital, I'm 99% sure it was pre 2005! I made a claim for the return of "sold over the phone" PPI, last year. To give them their dues, Santander dealt with my claim very quickly, and I got all my money back plus a bit extra.
  5. I have worked mine out at 22% APR. if it's anything different, they can make me an offer!!
  6. No it's not, it's just the payments, interest and charges applied - they're not the proper copies! I'll try 22% and see where we get to. Thanks again.
  7. I'm on a campaign of reclaiming PPI, just done MBNA, now it's Cap One! I reclaimed all charges in 2007, so I have their statements which doesn't show the interest rates, just what was paid in interest. Is there any way of working out what it would have been? The card dated back to 5/2000 so I guess it would have been around 14% APR???!!! Can anybody help?
  8. Thanks, problem being, I've only got the print out of charges/payments to the account as sent in the SAR, no monthly spend or balance!

  10. Between 2002 and 2007 I had a credit card with MBNA, the account defaulted and was sold to Arrow recently. MBNA were never able to produce complaint paperwork, so I have been in a stalemate situation with them for the past 5 years, so I am sitting it out until it becomes SB. I found up all the statements from when I SAR'd MBNA in 2008, unbeknown to me I had been paying PPI, so I have begun my claim. On the spread sheet, I have calculated the compound interest from 2002 to date, have it got right, or should I calculate for the duration of the account - 2008? If I had realised PPI had been added, it would have nearly cleared the balance of the account!!!!
  11. I've just had a letter from Debt Managers Ltd, when it was supposed to be Wescot, and, they're sending a doorstep collector all the way from Edinburgh!!
  12. We let our solicitor deal with the whole thing, which meant that we had to pay the full amount to have the restriction removed. I was however, successful in getting a big refund from the creditor afterwards, as I knew they hadn't taken into consideration what I had paid them since the CCJ was awarded, I did have to issue them with court papers though. It may be easier for you to let your solicitor approach the creditor with a F&F offer rather than do it yourself, you would have to be sure the restriction was removed with the land registry - it's like having a default marked as partly satisfied, as opposed to removed!
  13. Was in similar situation a few months ago. I had a restriction in my name on our property, which had to be removed as part of the remortgage procedure. We paid it off in full and our solicitor removed my name from the deeds so my husband could complete his small mortgage, no problem.
  14. My old MBNA account has also been sold on to Arrow/Westcots, both letters in same envelope, dated 15th Jan, and with unrecognisable account number!
  15. From my experience of Capital One, they do not just use one phone number to pester you with, it can be four or more - a complete nightmare to get rid of!
  16. Yes, they got back to me again with another poor copy of an application form, and T&C's from all over the place. The upshot of it was, there was an accompanying letter from B/Card confirming the account was unenforceable, and they were unable to pursue it through the courts - happy days! Only a few more months until is SB :O) Sorry to hijack your thread Hants.
  17. I can also verify that both HFO and Cabot add interest, and with alarming rates!!

I'm in a very similar situation, old Barclaycard, Cabot - they issued an SD in April 2010 which was easily dealt with as they had defective paperwork, and lo and behold FIRE have returned expecting me to pay them some ridiculous inflated amount, oh, but they'll take a reasonable offer - sorry muppets, you've lost out, this is nearly SB! I would imagine, FIRE and their "clients" are trying a last ditch attempt at getting people to pay on SB debts, or those that are very close - I am ignoring!
  19. I got a letter from shopacheck today, never had anything to do with them, never entertained a doorstep lender, where have they got my info from?
  20. Tried to copy and paste, but didn't work! OK, Good morning everybody - here I am again! This morning I've received a letter from Cabot under their guise as "FIRE", demanding full payment of the alleged account immediately, they've added another £1k by the way! Now I know they're hoping for donations to their Xmas club, do you good people think I should file under ignore?
