    Cheers Pete, think i better get my other claims going, got a couple which are all pre 6 yrs, so better start them get them in the system, mind you they are bth business & no clarification on those, also my personal claim back to 1990 but includes recent charges, where the hell did this suddenlry come from CM
  2. Keep on with your claim, until told different, what is happening is the usual headless chickens, nothing changes until . when & if there is case. Think about it, banks say they are going to come to court............. we all stop claiming, well that worked ! Just my take on it CM

    Hi DS, not the result looking for. Cant think why apart from that the courts are so busy, but with draft orders they could bring things to a close much faster. Looks like a 4 month wait. My HSBC claim filed march had mid july court date, so was quite a wait. Have you not got any other claims you could start just to amuse yourself, you know have a few arguments with the bank, time will fly if you are enjoying yourself If you cant find one, you can have one of mine , i still got either 5 or six others, not inc the newest one on the go, so you can borrow one if you like CM

  12. Would still send extra copies to court IF you get a change of venue to local court, they have been known to go missing as for some reason they seem to be very busy CM
  13. Yes thats the correct address Make sure you also send 2 copies to the court as well asking to have put with claim, if they allocate change of court, safe bet send new court 2 copies as well CM
  14. Hi, With credit cards you can charge CI on the charges, so add it on at the start with your pre lim letter. Just make sure you use a good spreadsheet like Mindzias ( well i lke it and its easy to use) as now you must list each charge with the description as shown on your statements (MSE one doesnt show that, so no good) Make sure your claim is accurate & no estimated charges etc. http://www.zen122856.zen.co.uk/CompoundSheet_v1.9.xls You will find what APR to put in, in the hsbc forums. Be prepared to get near court date, ie when you submitt bundle before they pay up (presuming CC are same as bank accounts & using DG solicitors) Other things are stick to your timescales, not theres as they will prob use stall tactics. Hi, you can use the limitations act s32 part 1 (B) & © to argue your case for pre 6 years, carry on with your claim, they will have to pay up. 32.-- (1) .... where in the case of any action for which a period of limitation is prescribed by this Act, either- (a) the action is based upon the fraud of the defendant; or (b) any fact relevant to the plaintiff's right of action has been deliberately concealed from him by the defendant; or © the action is for relief from the consequences of a mistake; [*]the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it. .... (2) For the purposes of subsection (1) above, deliberate commission of a breach of duty in circumstances in which it is unlikely to be discovered for some time amounts to deliberate concealment of the facts involved in that breach of duty. . . . (5) Sections 14A and 14B of this Act shall not apply to any action to which subsection (1)(b) above applies (and accordingly the period of limitation referred to in that sub-section, in any case to which either of those sections would otherwise apply, is the period applicable under section 2 of this Act). Try the link below for more info http://www.consumeractiongroup.co.uk/forum/general/3598-do-you-have-charges.html Halifax seem to think that by paying into your account, that its a closed matter, use a rejection letter from the templates library (see blue link in my signature below) to say that you accept as part payment only and you will continue to court for the rest. You will need to add into the template, why & how you invoke the limitations act, not as easy as cut & paste, you need to understand how it applies to your claim, so read up & learn. Use the search box 'limitations' act to find other threads relating to that & you may even find a template 'paragraph' to add to your rejection letter. As a point © is the stronger argument, as it was a mistake on your part that you believed that they ( the bank) had the right to levy the charges, so you allowed it to continue, and that it was not brought to your attention until either april 2006 or march 2007, depending on whether you use the OFT report or i think it was the BBC whistleblower program.   17. Hi, some how nobody replied to your post. Firstly welcome to CAG, you will find a host of forums on her that you can source information for getting your money back from the bank. Firstly have a read of this thread, it will explain most things http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/25457-guide-reclaiming-bank-charges.html Has your girlfreind EVER had the same sort of charges put onto her account. Check back statements as far back as you have them to find out. If she doesnt have copies of statements, you can request a list of all charges from her bank. If so, post on here and will point in right direction with template letter to send etc. Next thing to do is to write to your girlfriends bank using the Pre lim letter in the above link. Advise you read up and learn as much as you can and stay ahead of what the banks response will be. Post on here your progress and any questions and you will get help. I will get notice of any posts on here now, so you will be answered.... eventually You will get your money back if you follow the correct procedures. Celicaman

    Hi, Any news on your business claim Ive just started one with HSBC and had 50% offer within a week of prelim, with usual we dont pay OD interest back on charges.... wrong answer and some blurb about the oft statement not referring to business claims....... wrong answer. So polite LBA and explanation of why they are wrong on both counts incuded with thanks no thanks. CM

Well today went to court office with my amended cpr18 request with hopefully the correct info all put in, and asked to have it added to my file, Lady says' is it for bank charges claim' seems they must get quite a few in LOL Also sent NR a copy of same. Looks likely i will have to go next week for the hearing to see what the judge wants to do. If nothing else this has been a steep learning curve of having to actually understand exactly what and how we are claiming and presenting it, so instead of half understanding why,and answering things incorrectly, i now think i understand it fully. The banks know all the arguments, but it is up to us as claimants to prove why we are claiming it and how. Wait & see how this all pans out now. CM

I reckon they will still wait for the bundle, its just the way they do it now, same as it appears initial offers are now only about 50% of claim (at least that is what they have offered on my business claim and have seen at least one other offer for same %.) and it doesnt seem to matter how many nudges you send, well thats this week anyway, maybe change of tactics next week, keeps us on our toes LOL Good luck CM
