  3. I would be amazed if they actually go to court. They haven't gone to court to defend against ANYONE else. So I can't see that they would start with you. It's not like you are asking for bundles and bundles They cannot aford to set a precident. Say they do defend and lose. They then would not be able to charge any of their customers £30.00 to bounce a dd it would be around £2.00/£4.50. Also all the previous charges could be claimed back. Not with all the aggro we have had, but with a simple letter. they really really don't want that. well that is how I understand it
  4. So the date of service was 20.02.07 - and then you have 28 days 20.03.07 is the latest time they have to file their defence I have heard nothing, I have been checking but they haven't acknowledged my claim yet.
  5. Sent SAR 16.02.07 to Capital One Credit card. I must admit I am looking forward to seeing just how much I have been charged. You could have knocked me over with a feather when I started against A&L £4K I have claimed for. Issued and deemed served 20.02.07 so waiting for my cheque I only asked for 8% on the A&L. I think on Cap 1 I will go for contractral int cos they have charged me at 24.89%. I have had the account since March 02. Well I will keep you all in the loop as it goes along. I have a feeling I may be asking a few interest questions. Maths never mine strong point.

I received a letter thanking me for taking the time to highlight my concerns They enclosed a leaflet explaining that they are comitted to resolving complaints as fairly as possible I can call on 0151 966 2983 if I want Yeah right! Do people really get put off at this stage :? I will just sit quietly and wait for my money to be returned to me

  9. Yes the MCOL site calculates it for you. You put all your details in and it just pops up with the amount and adds it to your claim. Make sure you put the claim in before 0900am then it will go through that day.
  10. MCOL charges depend on how much you are claiming. I claimed just over 3K with interest £4K It cost me £120.00 court costs. MCOL are in Northampton. You actually pay on line with a credit or debit card, not in person at the Court. As for further advise, it depends what stage you are at. Have you sent the Prelim letter the LBA etc, to get you to this point?
  11. I have received a letter today from A&L dated yesterday 19.02.07 Thanking me for taking time to highlight my concerns:? They have been sent the Notice of issue and it is deemed served today. Talk about more stalling:rolleyes: They have sent me a guide to complaints, telling me how long they have to deal with my complaint:rolleyes: Well A&L I would get a wriggle on, if I was you. As the clock is ticking, pay up, or explain why your charges are fair

  13. It is deemed as served 5 days after the filed date. I also filed with MCOL on 15.02.07 and received a hard copy from the court explaining that it will be deemed served 20.02.07. The defendant has until 6th March 2007 to reply Hope that this helps
  14. Hi Ros Nope heard nothing yet. You can bet your bottom dollar that they will not defend against you. That is to give them extra time. You will now get a chq shortly, if they run true to form. They cannot afford to defend the case. Look at it this way, pay you and I just over 3k, or lose to either you or me and then pay EVERYONE with a bank account back, and no longer be able to charge £30 everytime that back a dd. Sit tight, they are trying to rattle you. I am quite prepared to go to court. All the info needed is on this site. I would rather enjoy it. Always wanted to be a legal eagle!!!
  15. From reading the other posts, they always say that they are defending and then they send you a cheque before the time is up. This I think is another tactic to frighten people into backing down and accepting a lower amount. Stay with it - You have already done all the hard work. I have also claimed filed claim on MCOL this morning (Got up early to do it)
  16. This morning at 0845 I filed my claim with MCOL against A&L for £4149.49 incl interest. So know I shall sit and await my cheque.
  17. I see your point, I work on the same maxim. However, it seems in this case. It is GOOD & it is TRUE. I have read through nearly all the posts on this and other sites! I like you thought NO CHANCE!! My bank has always had the upper hand, after all my money just goes straight in, they take what they want and I get whatever is left over. As I understand, legally they can charge you what it costs them, not penalise you. So in a court of law, they really do not want to say how much it actually costs to back a Direct Debit etc. So if they they can't say ok we will give you say 1/2 of the money back, because then they have to explain to the judge why, and how much they pay for the failed transactions. Then everyone will say, "hold up then, why am I paying this much? Give me my money back!" It is way way easier just to pay you and get rid of you. Yes they get nothing for your overdraft, however they are still getting the full amount of their really really expensive charges from everyone else. Why rock the boat for pennies (cost that is just what your claim is to them)
  18. They can't afford to fight back, if they lose to you. They could not charge anyone those charges again!!!! They cannot take that chance. Your claim is such a small amount to them. Think about it, pay one person their charges back, or take a chance that you have to pay EVERYONE of your customers their money back. I know which one I'd choose!!!! Tomorrow is the day I file my claim for over 4K, I will then sit back and await my cheque. I am sure that they won't choose me to make a landmark decision with. Hang in, I would lay money on it, that your cheque is winging it's way to you.

  20. I have already started to re claim from A&L. I would now like to tackle my Capital One card. I have been trawling around, but cannot find any template letters for credit card reclaims. I may be being really thick - So if someone could point me in the right direction I would be obliged - Thanks in advance
  21. I would also be interested to know about this as I have exactly the same date ie Dec 2000, as that is when I asked for my statements. I am waiting for the response to LBA. I know that I will have to go the Court Route. So would be interested in the response to this, as I can then leave out the charges from Dec 2000 if I have to, when I claim

  23. I sent the LBA to A&L yesterday, I am claiming £4593.27 on an old account. Which was closed Oct 05. I hadn't used the account since Feb 05 and in one month they whacked on charges of £660. I paid them and miscalculated leaving an overdraft of £20.45 so the hit me with another £101.23 in charges. I paid all the costs and they closed the account!!! I have had a letter in response to asking for my money back, which outlines the Guide to Bank charges! Also saying I can use their online service to move money into my account. What the one that's been closed for over a year! I am really looking forward to filing the county court claim, and I am prepared to take it all the way. When I have finished with them I am going onto Capital One, whom I have a credit card with. Will keep everyone updated as it goes along. As I am enjoying reading all the info from others who have boldly gone before me!

  25. Must be the day for blah blah letters from A&L cos I got one today too. I am claiming £4593.27 on an account I closed in Oct 05. I hadn't used the account fr03 Feb 05 and they had whacked on £660.00 worth of charges in a month!!!! I paid up, and miscalculated leving a balance of £20.45OD so they then charged me another £101.23 in charges. So I am prepared to go as far as it takes!!I have given them 7 days to respond (Got the template letter off another site before I found this one) So it looks like I will be filing out court claim forms the day after Valentines day.
