Hi there guys, I booked a hire car through a 3rd party (indigo car hire) They used AVIS for the rental at Dublin airport and we agreed on taking out the extra CDW insurance meaning I didn't have to pay any excess or deposit. I was arriving at the airport on the last flight and the AVIS desk was closing at 11:30. I had to rush to make it there on time...I handed them my printed info from indigo car hire and she asked if I was taking out the CDW to which I replied "yes" She asked me to sign in 3 places...I made the payment and we had the key and we were on our way. On my return to the UK I checked my bank and I noticed the amount they had taken on my card was more than my original agreement. I queried this with AVIS and they stated that "personal accident insurance" and "windscreen insurance" had been added. I explained that I had not asked for this to be added and the person at the airport certainly didn't ask me if I wanted it added. AVIS stated...it doesn't matter...you signed the form so you have automatically agreed to it. And also...you cannot dispute a transaction once you have left the airport. Is there anything at all I can do? Do I have a leg to stand on? This was the first time I have ever rented a car and it has really put me off!! Any advice would be greatly appreciated!   3. Thanks for the reply...the LA is just a single female who has showed us the property, performed all the inspections and checked the house when we left. We asked her about painting the stairs when we moved in but that was in person. Is it not relevant to the evidence that the LA performed her inspections every 3 months, checked the house when we left and also provided a positive reference to our new landlord....surely based on this it cannot be argued that they weren't aware it was painted? Also, the house was put on the market before we left the property and photographs were taken by an estate agent and passed to the landlord then the photographs were but on rightmove to sell the house...the stairs are shown in three of these pictures and are clearly white. Is it worthwhile getting a copy of the 3 month inspection appointment letters along with a copy of the positive reference she gave to submit this as evidence? Thanks

Hi steve, Thanks for the reply: No, there was no check in/check out done at all...we did however take our own pictures on moving in and out. - The damage is to a small 2 brick high wall which fronts the main road. The wall has always been loose and probably required a new layer of cement to secure it (probably 5-6 bricks in total) - We asked if we could gloss the stairwell/spindles as the letting agent told us it had just been fitted and was in an unfinished condition, verbally the letting agent said yes. This is backed up by her inspections she undertook every 3 months without issue. The landlord states this is was an expensive oak staircase and it is now unrecoverable. - The house was cleaned but the landlord is stating the stairs carpet needed professionally cleaning. Allowing for wear and tear the carpet is in good condition and photos were taken on leaving the property. Also there is no mention of any specific cleaning instructions (ie get carpets professionally cleaned on exit) and no mention of decorating the house in the letting agreement. Thanks
  5. Hi guys, I'm sure these threads come up all the time so I'm sorry if you have to answer again! I have recently moved out from a rented property and after leaving the landlord is withholding the entire deposit. They didn't notify me of this and it was pure luck that I decided to log in to the dps website to see the dispute. I attempted to contact the letting agency but they wouldn't speak to me and didn't call me back. The dispute has now gone to the ADR stage and I wondering what is the best way to tackle this and strongest way to provide my evidence? In a nutshell the Landlord is claiming for one count of Damage, one count of cleaning and one count of unauthorised painting. I really would appreciate any guidance anyone could give. Regards
  6. Thanks for the reply...however I was not at work on Monday and my partner stayed in on Friday so there was no loss of earnings, it's more the fact that of the time we wasted staying in and the fact that there was never actually any delivery booked in the first place.
  7. Hi there guys, I wonder if you can point me in the right direction... I purchased a pram from Asda direct back in march 2013, over time it has developed a number of faults. I rang asda direct and explained the problems, I was given the choice of a refund or a direct replacement...due to the nature of the faults I chose a refund. We were told to package the pram up and we would receive an email with all the details and the arrangements for the manufacturer/courier to collect the pram. We never received the email. We rang again around 22nd January and we were told the adviser hadn't put it through properly, so again we would receive an email the next day. Guess what?? No email! So again we rang on Thursday 23rd January and we were told the previous adviser had again done it incorrectly. She managed to arrange the courier and said they would collect the pram on Friday 24th January between 8am - 8pm. So I arranged to be there all day....Guess what??? Nobody turned up...I'm sure you can see a pattern arising here! So obviously very annoyed and without a pram for my daughter for a whole week now I rang that evening asking for an explanation and they told me the adviser had forgotten to forward the reference number to the manufacturer so the courier could not be arranged! WOW 3 different advisers were unable to their jobs properly! She said that the manufacturer/courier was closed during the weekend so she would arrange for it to be collected on Monday 27th. I asked if they could confirm on Monday via email for peace of mind. Again I arranged to be there on Monday and waited in all day, I did not receive an email so I rang around midday to confirm that the courier was still coming...I'm sure you can guess what happened next...that's right, the adviser I had spoke to on Friday hadn't even put the request for the courier through! So another wasted day and even more time without a buggy! The adviser then said she would send the relevant email through to them to arrange the courier and it would take between 24-48 hours before I hear back from then. I told them this was unacceptable and this was going to be the last chance. I asked to log this as a complaint and she said she would. On Tuesday 28th I managed to email the courier/manufacturer...they are a company called Obaby, they emailed back the same day and said due to asda directs strict policies they were unable to arrange collection until they receive the correct details, she said she would send asda direct an email again requesting they send over the info they need. In the meantime I had rang Asda house and they explained they were unable to help with Asda direct problems...I also sent an email to the head office CEO of asda but they failed to even bother to reply. I rang Obaby again on Wednesday 29th to ask if they had received anything back from Asda and surprise surprise they hadn't! I explained to them that I will give Asda until Friday 31st and if I hadn't heard anything then I would be sending the pram to the manufacturer myself using a signed courier service and once they are in receipt of it I will give Asda direct 7 days to make the refund before I will be starting proceedings in the small claims court for refund + costs + compensation. I also rang asda direct making them aware of the same thing. I spoke to their legal team to collect the address for making such claim. I have made so many calls and wasted so much time on this...meanwhile our 8 month old has had no buggy at all and we have had to pay additional transport costs. I have just ordered a new pram today as we cannot do without any longer...needless to say we did not buy this from Asda! What I wanted to ask is am I well within my rights to do this? What sort of things can I claim for under the small claims court? Is there a template letter I can use to send Asda threat of legal action? I would appreciate any input anyone can give on this matter. Thanks for taking the time to read this!!

  9. Hi, Just after a bit of advice really. I bought a laptop on finance for a good friend of mine and her partner. They agreed to pay me a set amount every month (only £12) however we have fallen out due to this and they now refuse to pay any amount at all and are also refusing to hand the laptop back. She is 16 and her partner is 18...I was just wondering is she to young to take to the small claims court? Thanks
  10. Hi, I have been through the stages of claiming charges back a couple of times now and my question is as follows... I wish to start the process for my mother who finds it all very confusing, for this reason I would like to know if there is any way to do the whole process from start to finish on her behalf, therefore helping her greatly.   11. Hi again, Sorry It has been so long! Anyway, I recieved my call back from a manager and I was told that the cheque had come from an unlimited fund account, so it was impossible for it to bounce. He told me It must had been an error from my parachute with halifax, and that I would have to wait until I recieved the bounced cheque back to inform him of the reason. I explained to him that the reason was irrelevant and if he wanted to wait for me to recieve the cheque back then by all means he could, but bear in mind the claim date is ticking away...He gave me his direct number and the call was ended... I woke up the next morning to find the money in full was deposited as a cash transaction into my parachute account! I assume my two banks must have contacted one and other to arrange this? I still don't quite understand how it was done with cash but never mind. All is well and I WON!!! Thanks to all in this site, It has been a great help!!! THE END
  12. Hello again, Well It's been a long time since I posted last and alot has happened!!! So I issued my claim which was deemed for the 9th of march...recieved a cheque for the full settlement on the 14th of march...yay!!! But wait, their cheque bounced and was returned?? So now what? I contacted a+l today and apparently a manager is going to call me back on the matter. Any advice here would be greatly appreciated! Thanks
  13. Hi, thanks for the reply. They managed to find me after another 10 minute call of arguements! Anyway, they said i have paid up along time ago and are going to send me a settlement certificate. But as far as t-mobile are concerned, they have never recieved the money from moorcroft? The main problem is that this has been on my file all these years without me knowing and has effected my credit rating badly as I have found out the hard way. Is there anything i can do in terms of claiming against them for this? Thanks
  14. Hi, Please help I am very stuck!!! About a year and a half ago i defaulted with t-mobile. They referred me over to moorcroft debt recovery and I paid off the debt in 3 months. Now recently when i applied for credit I was refused so i took at look at my credit report and found that it still says i owe t-mobile £250!!! Now as I dont have the moorcroft reference number anymore as it was a good while ago, moorcroft explained there is no way of finding me without it? now even if i do sort it out due to moorcroft not passing the money on to t-mobile it will still show on my credit record that i have not paid it for 1 and a half years? Is there anything legally i can do about this? Please help Many thanks
