  1. Once you receive your statements you need to go through them and jot down all the charges. (date, details, amount) then apply them to the spreadsheet.(use the one in the tempates library, it is easier). Then send your prelim letter off giving them 14 days to comply. After 14 days, if you haven't had your charges back and just received normal " we are looking into your claim" letter. Send LBA (Letter before action) gives them another 14 days to refund charges. If no refund, file a claim. It would be a good idea to read up on the FAQ's and many threads as possible to get an idea on how things are done.

  3. Hi hedgey. I agree with you totally. I have pointed her to this website, but she is still a bit unsure. I have advised her to read, read and keep reading loads of different threads and if she has any problems to put them accross, but she is very new to all this. I think that once she has got used to this site she will get a bit more confident.

  5. Is it wothwhile trying to claim the charges bakcck for ks676.(she is a friend of mine and is a bit shy) I am trying to help out as much as poss but am unsure with Natwest, (I have successfully claimed agaignst Halifax) Can someone please help her.
  6. Take the date on your prelim letter as the date of your letter and not the date that they received it

  9. With your LBA just send a revised schedule of charges. This will inform them of the current situation.

  11. Hi Zootscot. ks676 did inform the bank of change address and got a receipt from them when she did it. The bank did not update their records so therefore the debt increased without her knowing about it. Only found out when enquiring about the account last year and since then has moved house again.
  12. Hi ks676, If you get to MCOL stage you are entitled to calim interest on the charge @ 8% APR. I will tell you how to calculate this over coffee during the Easter holidays.

  14. If you go to the bank templates there is a spreadsheet to help you calculate the interest. My claim was for £3500 and my 8% APR interest was only £560. I think your calculations are a bit out lol. If I did it your way it would be £1686. Mind you I think that I prefer your way lol
  15. If you go on to Money Claim Online. You can register with them and start to complete it (make sure you don't press "submit"). This will then give you a guideline on how much the court fees will be. What interest are you claiming ? Is it the 8% APR?

    What interest are you claiming, as you can only claim the interest charged for the charge they levied and not the total interests debited from your account.
  17. AGHHHHHHHHHHHHHHHHHH They will be taking another £150 from my account tomorrow! Is there anyway I can stop this? Should I start the ball rolling with another claim?
  18. Well, I spoke to my brother on Sunday and he is willing to take the risk of his overdraft being withdrawn. He also is going to open up a parachute account just in case. So off went the prelim letter yesterday and I have had confirmation via Royal Mail that it was delivered today.
  19. Hi welshbaba, I have just had a quick look at the Martin Lewis website and it looks like the calculation part you used was calculating the interest @ 8% APR. The amount will differ slightly if the calculations are done on different days as it works out how many days have gone by since you were charged.
  20. Hi Lattie, I sent 3 copies of my schedule of charges + interest to the courts the day after I did my MCOL. Should I send them again or do you think that they will attach the ones I sent first to my claim.

    JW 'v' MBNA

    Received a letter from R Vernon in the compliance department acknowledging the receipt of my £10.00 and the copies of my i.d I sent. Apparently MBNA only requires one form of i.d and sent back the copies of my utiliy bill and my tax credit form. So for those of you just starting to send a SAR, enclose a copy of your drivers licence as this seems to satisfy them. They are going to provide me with a copy of all my information within the 40 days allowed by the terms of the Data Protection Act 1998. I hope they realise that the 40 days started 25.02.07. I will keep you informed as and when things happen.
  22. Received letter today confirming the offer of £761 as full and final settlement. They will be crediting my account with the refund within the next 14 working days. Sent acceptance back (recorded delivery) so now I shall sit and wait. If money not received by 9th April, I will be sending them a letter informing them that I will now pursue the claim through the courts and claim for interest aswell.
  23. Many of the banks are being swamped by the prelim letters and many people do not get any response at all. If you have proof that they received your prelim letter, then count 14 days from the date of that letter and then send your LBA. As long as you have proof of them having received your letters, just stick to the timescales. Prelim 14 days LBA 14 days Claim
