Hi guys So, having received my second get stuffed letter from Citi Cards from the very busy Mark Clibbens, who, incidentally, was: 'sorry I had the need to write in again' and; 'hopes his letter clears up any remaining issues' and 'your request has been noted and we will advise you once our intended position is known'. Yeah, let me think about that one, ummm? nope, sorry Mark, not good enough so .... I have this morning filed my moneyclaim online form: Total Claim is £141.65 plus interest, plus my costs. Claim Number: 6QZ31914 will keep you posted! xx

Dear All Yesterday evening I returned home to find a letter from a Rachel Claridge, Customer Advocate Office Manager (my god, how MANY tiers of staff do they have in these banks??!!!) anyway, briefly, the letter says: Thank you for contacting us. We will ensure you receive a full written response within 28 days from the date of receipt of your letter. I have enclosed a copy of our internal complaints procedure blah blah. Yours sincerely Rachel Claridge This letter was in response to my initial letter for a refund. PLEASE can I just get your advice on one question? I'm wondering, now that I have this letter (which I am taking as a sod off letter), can I go straight to the LBA letter, or should I wait for the initial 14 day deadline to expire, then go to LBA, then to moneyclaim should I not hear anything further? what do you think? Many thanks guys, I hugely appreciate it!! lois xx P.S. on another note, issued my first claim form yesterday ... all very nerve-racking but exciting at the same time if that makes sense?!

Hiya Rachel Yeh, I got that same letter last week and so I fired off another letter saying that they have 10 days to reconsider their position (!!) and if they do not refund the full amount, I will issue court proceedings without further notice. oh but they did refund me £25.00 as a 'goodwill gesture' out of the £125 that they owe me ! GOOD LUCK!

    Hi guys So, after receiving a letter from Mr Pretty saying that he would refund my charges of £125.00. After getting advice from Lu, I sent a further letter to Mr Alan Pretty on Wednesday 3 May 2006, sent by guaranteed next day delivery, so he would have received it on the Thursday 4th May 2006, stating: Further to my recent correspondence, I notice a further charge was debited from my account of £39.00 on 7 Jan 2006 and I am also horrified to note that a further £50.00 is due to be debited on 8 May 2006. Therefore, the amount that I required to be refunded is now £164.00 and for the pending charges that are due to be debited from my account on 8 May 2006 to be cancelled. Under the terms of my letter before action, which you received on 20 April, you have until 8 May 2006 to complete that action. If you do not comply, then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. So what started out as such a swift conclusion to my HSBC matter, has now turned into nothing but a flat tyre .... not heard a dicky bird since my follow-up letter sent on 3 May 2006. So, I thought I have given him a couple of days extra grace and nothing, not a thing and therefore, this morning, I have filed a Money Claim Online for the full amount plus my costs and interest. I have to say that I feel empowered but very nervous at the same time?! maybe this is normal, this is my first ever claim in the county court and its all rather intimidating isn't it?! Claim details are: Claim Amount: £246.32 (inc costs) Claim Number: 6QZ29917 OMIGOD, am slightly crapping myself now ....! lois xx

  11. hi guys Made the DPA request for my statements and have still not heard anything back. BUT I did manage to download some visa card statements online so have sent an initial request for refund letter asking for £200 which has been debited from my account in the last four months alone If I ever do get my statements from MBNA, I will see if there are any charges which go back beyond October 2005 and if there are, I shall also be going back to them for those charges as well. will keep you updated, xx
  12. update: so, I finally got my DPA stuff through from Capital One Bank at the weekend and have totted up all those charges, it amounts to £72.00 in total. have fired off a initial request for repayment to Mr Udy. will keep you posted,
  13. another update: so, have heard absolutely zilch from the wonderful people at Citibank, they are clearly very busy ..... i have sent a final letter before action to Mr Clibbens giving him a further 14 days to have reflect on things, and asking him if you could kindly get back to me with my refund ... or I'll issue my claim. will update again if I get something back, xx

    quick update on HSBC: have written to Mr Pretty basically saying that since my initial correspondence, I notice that £39.00 charge was debited from my account in January:( , and that you are debiting a further £50.00 from my account in May. I have therefore asked for him to send me a cheque for £164.00 and to write off the pending charges. is it any wonder that i NEVER have any money?! will see how far I get and will update again when i get a reply,

  16. since when does a letter before action have to be signed by a solicitor? what utter horse**** ... pardon the language! My god, they really have NO idea do they? I do feel for that poor guy though, maybe he's like one of the poor little people that have to just tell you what his boss says ..! as for waiting until 31 May 2006 - whats that got to do with anything?!! IDIOTS ... tinkerbelle, I'm hating Citibank almost as much as Abbey at the moment and thats saying something !!! You go get them ... will keep an eye on your thread to see whats happening with citibank xx P.S. Citicards are going to love me then, I didn't send the prelim request for refund but instead accidentally sent the LBA - not that I imagine this makes any difference at all. I'm sticking to my timetable so they've got till the 2nd May to get back to me with a response ... not that I have had ANY response as yet from them, perhaps they're ignoring me in the hope that I might just 'disappear' .... which of course would be the WRONG assumption for them to make ..!!
  17. hiya i'm making a claim too from Citibank, I sent them my LBA on 18 April so they've got until 2 May to get back to me. I think I am right in saying that the advice generally, is that we should stick to the timetables that we set, If you sent the LBA template letter (as I have done) which gives them 14 days to get back to you, then your next step would be to lodge that claim with the Court. GOOD LUCK!
  18. you think thats bad ... when I spoke to Smile (who are owned by Co-operative Bank) the supervisor there told me that the Data Protection Act doesn't apply to them !! joker material !
  19. oops, just realised something, i issued the letter before action giving them 14 days, of course what I should have done (and what I meant to do) was sent the preliminary letter requesting the refund first and THEN to follow up with the LBA. bugger .... I cannot believe I've done that, how stupid of me ... :-| Anyone out there think this will make any difference to the claim? any advice would be greatly received!! xx

  22. Hiya I had a similar problem with Smile, except they wanted £10 per statement! I sent them this (mixture of two letters): Thank you for your recent correspondence. I repeat my request that I would like to make a formal request under the Data Protection Act for a complete list of transactions and charges from xxx to xxx. Alternatively a complete set of bank statements for that period will be acceptable. Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you. If you are of any doubt that this information is covered by the said act, may I respectfully draw your attention to the case of Durant v FSA 2003 in this case the judge ruled that bank statement information is indeed personal information and thus covered. I authorise you to deduct the statutory maximum fee of £10 as set out under the Data Protection Act, for this information. You have 40 days in which to comply. Should there be any further attempts to delay compliance, I will be left with no alternative but to escalate this matter into an official complaint to the Information Commissioner and/or the County Court under s.7 and/or s.13 Data Protection Act. Furthermore, if I discover that you have levied disproportionate penalties against me then I shall be reclaiming them and also reclaiming the enclosed £10 DPA disclosure fee. This letter has been sent by first class recorded delivery, and therefore should have reached you by xx/xx/xx (insert next working day after posting) – as you will be aware, as of this date you have just XX days (insert days remaining since they received your original request) in which to comply with my request. As stated above, a complete set of account statements for the period in question will be acceptable; however, I expect this to be provided within the time period for DPA compliance. I look forward to receiving the requested information by (insert date of the 40th day plus I added on 4 more days to allow for them to deduct the £10.00 fee and also to allow for postage) This is a mixture of the letter that Alan done and the DPA letter. I got a second reply back from Smile stating that the information would be provided within the 40 day time limit so it worked for me! good luck!

    Hiya guys thanks for this BUT, guess what, surprise, surprise, god, there is always a surprise with HSBC, I would really appreciate your input on my dilemma ... so here it is, I've just gone through my statements again, and they actually owe me as follows: 7 Jan £39.00 charge debited 7 Feb £25.00 charge debited 7 April £100.00 charge debited 8 May £50.00 charge (pending but will be debited on 8 May) TOTAL £214.00 (including the pending charge) so, my question is (1) do I go back and tell Mr Johnson at HSBC that they have actually debited a total of £164.00 and not £125.00 as I had orginally thought; or (2) should I forget about the £39.00 that I neglected to include and which was debited from my account on 7 Jan (and its my fault I guess for not realising this had been taken and therefore not including it) and just accept the £125.00 as this is what I asked for; and/or (3) should I accept the £125.00 but also write back and tell them that I am due to be debited a further £50.00 in charges so I require them to either cancel these charges or add this amount to the £125.00 making a total of £175.00 in settlement of my claim. PLEASE HELP !!! thanks a million, xx

    Hiya guys Guess what? today, I received a letter from HSBC and they are refunding me the FULL AMOUNT that I claimed ...!!! usual blah, cost us more money to defend rah rah rah, no admission of liability rah rah rah .... I have to say, I was beginning to buckle with the whole thing of being overdrawn without realising and so thought would have to pay the charges because of it etc, etc. So, thats one down and four to go! xxx
