  2. receved a letter from my mp today on offical note paper saying he is writeing to both the fos and the minister responsabel for them, asking what is going on and he will get back to me when he has a reply. gess he got my emails at lomg last>
  3. emailed my mp yet again with the following In February 2010 I wrote to the Financial Ombudsman Service about the service I am receiving from Lloyds TSB bank due to financial hardship. On the 18th June 2010 I received a letter from the adjudicator in this case that my complaint has been upheld by her on the 12 may 2010, but Lloyds TSB bank had not not replied to her and was ignoring her ruling, that they should pay back all bank charges from 22 may 2008 at 8% interest per year, correction of credit files, and £150 for distress and inconvenience. She then put this complaint forward to the ombudsman for a final ruling at that time, giving me a chance to add to my complaint, which I did stressing that I am in finical difficulty and the FOS own website states : we will make special efforts to minimise delays where it is clear to us that: The consumer would face particular financial difficulties because of any delay. This might occur, for example, where: – the consumer is already experiencing severe financial hardship that would be alleviated by a positive outcome to their complaint; nearly a year on and all I ever receive is a letter stating that my case is still in a que to be reviewed by a ombudsman, I am now asking you if can find out when my case will be looked at as according to my records I am now looking at over £ 4000 in compensation which will greatly help me in resolving my financial difficulty’s hope this does something!.

  5. ok recived their letter and a ie form, but a cannot find there address on there page only their po box number even in the stuff on the bottom of the page isnt this a no no now? i have this ready to send back to them I do not acknowledge any claim made by you or any other party. You have contact me regarding the account with the above reference number, which you claim is owed by me. I would point out that under the limitation act 1980 Section 20[1] "no action shall be brought to recover (a) any principle sum of money secured by a mortgage or other charge on the property (whether real or personal)...after the expiration of twelve years from the date on which the right to receive the money accrued". As the last correspondence/payment or acknowledgement of this debt was made over 12 years ago and no further acknowledgement or payment has been made since that time I suggest that you are no longer able to take any action against me to recover the alleged amount claimed. I would further point out that the Council of Mortgage Lenders (CML) has agreed that with effect from 11 February 2000, anyone whose property was repossessed and sold and has not been contacted by their lender within six years of the date of sale, will not be asked to pay the shortfall. Whether or not you are a member of the CML, I consider this policy to be an indication of good practice and urge its adoption. I would also point out that from 31 October 2004 The Financial Services Authority (FSA) has issued ' The Mortgage: Conduct of Business Rules' which say that if a lender decides to recover a mortgage shortfall debt they must make sure the borrower is informed of this within six years of the date of the sale. As you are the second company in as many years that this alleged debt has been given to, I now require in writing undertaking that this will be the end of this matter within 30 days or I will log complaints with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, and Solicitors Regulation Authority I hope that this will not be necessary. Please be advised that I will only communicate with you in writing. All phone calls will be treated as harassment and will be reported to the relevant authority’s. Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc. (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.   8. yer i told them and my mp has not seen fit to answer my letter to him, he spends so much time asking questions about the nhs he forgets why he is there
  9. well got yet another sorry its takeing so long letter today, even had the gaul to say they relise that its nearly a year since i started this process but they are working as fast as they can.....
  10. i keep on the road with the case and if things dont go well and you lose the complant the fact you went through all resnoble actions to settel before you took it to court can only help your case.
  11. so it look like another wait for my case as it was not sent to the adjudicator untill june 2010 on a case the frist level said i had won my case but lloyds totaly ignored
  12. have been reciving phone call from red since october but i never answer there security questions, and they have never written to me, so i dont know why they are chaseing me, well today somebody from them range me at 08.30 this morning and they said "mr lenny100, this is red dept collection calling i see you wont answer my questions will you do so today?" whell i did my usual and just put the phone down, but it just shows we are starting to get to them now by not answering their phone calls. 8)

I find that after over 10 months of what is clearly a hardship case as defined by your own website :- The consumer would face particular financial difficulties because of any delay. This might occur, for example, where: – the consumer is already experiencing severe financial hardship that would be alleviated by a positive outcome to their complaint; That this is beyond a joke considering Lloyds tsb bank has already ignored one judgment by yourself which you informed me of on 18 June 2010 Could you please let me know how much longer I am expected to wait? And will the on-going charges made by Lloyds tsb will also be paid up till the day of any judgment by your ombudsman
  14. well now its October and still nothing, so much for there stated allocation rules Of course, we can’t prioritise every case. This might occur, for example, where: – the consumer is already experiencing severe financial hardship that would be alleviated by a positive outcome to their complaint; – there is an imminent threat of a lender taking possession of the consumer’s home; – a significant and damaging financial loss is expected to occur in the near future; or – the outcome of the complaint will decide the consumer’s main source of income.
  15. i wish i had those figures but i dont and i dont know were to get them it would probably take my claim over the £20,000 mark, and for a disabled ex serviceman that a lot of cash
  16. i have my spreadsheet up and running which goes back until 10/06/2002 as far as the data i got on my data request goes to and up to today including interest at 8% stands at £1307.31 they say they dont hold data older than that, pity since i have had this acount since 1990 and must have charges quite a bit as a serviceman who only way of getting cash most times was a cheque cash at the unit pay office and at times they dint process them until the end of the month meaning sometimes you were overdrawn for a few days, and got the £50 letter charge every day.
  17. well today's post had yet another sorry but your still in the que letter from the fos, but since the news today stated lloyds have more complaints against them than any other bank what a surprise it is i am still in the que
  18. i have successfully up to now gone to the fos due to hardship with lloyds. if you have proof that you have informed them you are in hardship and they have done nothing about it then fill in the form on the FOS website and include all your data also. were i am up to at the moment http://www.consumeractiongroup.co.uk/forum/showthread.php?264167-ok-so-they-say-i-have-a-case-BUT.....
  19. Well i am still waiting although i have gotten my monthly sorry you still waiting letter i reckon that i am up to a payout of around £ 3750 at the moment pitty it dosnt go back to 2002 when i started to record these charges that would be around £13500
