  2. Yes to responding back, quoteing it does not apply - refer them to CPR 27.2 section 2(f) I would not chance a CPR Part 18 back as of course it will not apply anyway! Thirdly, do you think they really can;t find your account when they have your name, address, etc.? Come on, they have been corresponding to you for the last 4 weeks reagdring the claim. This is them just been pedantic, but you could put it in brakets at the bottom of your letter I have just done exactly the same..

  4. I have received the same defence paperwork from the solicitors. They state "without prejudice" on a lot of the forms... doesn't everything have to be done through the courts with full transparency?

  6. Hi, i got this back from IF. I wrote a letter back thanking them for doing this, but stating that although statements are not part of a DPAR, I actually asked for a list of ALL transactions and charges from my account. Write something along the lines of the above and re-enclose the fee. Remind them f the 40 days from the original request. Don't worry about the manual intervention part, if it ever gets to court, you have tried but they have refused. It will not look good on them. I hope this makes sense...

    An accessible period yes, but I am sure they need to keep them longer for other legal reasons too... if you can get access to these then there maybe problems... but if the subject has these already(beit past statements etc) then we have a case, maybe..

    I think though, the longer we go back the more chance of manual intervention. There must of been a time when people actually had a list of overdrawn accounts and did some semi manual intervention. I suspect that they have wongly upped the charges to justify IT systems been put in to place.
  14. So far, I have tested the spreadsheet and it looks very good and works Ok, the amount will generally be quite small, but it is up to the individual whether they want to claim the interest. The spreadsheet which Vampiress has created makes calculating it one hundred times easier. I think if anything it will clear the water... Watch this space.
  15. Well to be honest, for £25, I wouldn't start quoting legal jargon unless you totally understand it because you could end up hitting a brick wall. Instead, you should just ask for it back nicely. Explain to him that it was an accident and you would like it refunding as a gesture of goodwill as you are running on a tight budget this month and you don't want to have it end up snowballing next month. If that doesn't work, get a letter fired off to him.
  16. What do you want to tell them? Are you wanting the £25 back? If so, say that, if he is a manager then I am sure he will be able to authorise a refund that small. Be nice, polite, explain.
  17. How owuld you know the exact rate of interest in that particular month? If you would like a seond set of eyes over it, then i would be pleased to lend a hand. I mean, erm, eye.
  18. You won't need the account application form, you can claim the £70 back if you had an overdraft or not! Just send the 1st letter...
  19. IF you're asking do the laon comapnies provide statements? Yes they should. if you don't have details just send them a DPA request with the ten pounds and get adding the charges up!

    Maybe you cannot reply on the unfair charges argument at law, but there would be no harm writing a letter to them stating that you think it is unfair, etc. Ask them to explain their costs in writing and see what happens.
  21. Exactly the same rules apply, same letters too. The only thing you might want to change in the letter is where it refers to the type of charges, but even that you don't need to change. good luck!
  22. Sorry, we use it here in the forums a lot! A parachute account is essentially a backup account. A bank account that you have opened, just in casethe bank you use threaten you with closure, overdraft removal etc. The parachute account would obviously be with a different company to the one you are claiming against!
  23. This would nearly pay off you overdraft, which is good. When i was a student, only 4 years ago... They would let you transfer to another bank, no matter how much into your overdraft was. In the end, you are a student, you are meant to be in debt and that;s why banks want your business. There is no harm in trying. ps. I had 3 student accounts, all with overdrafts. I recommend you don't do that though!
