Hi, I believe I am correct in understaning there has only been one case which has gone to court and the bank has won. I am very interested and would like to red more. Does anyone have the case information so I can google it or any links to detail on this. Thanks... Adam

Some people may think differently, but I would let them know you're serious... either way. Why don't you file the claim and tell them at the same time? If you do reply, maybe you could quote him... "...penalising all our other customers as a result." This is exactly what the banks are doing!

I read the following post in the litigation section. Hope I am posting this question in the correct section. " Nationwide v Disneyman - settled with Tomlin Order Nationwide given judgment 14th December 2005 - £2500 aprox 22nd March 2006 Application to set aside and defend for aprox £3000 Abbey settled agreed to set aside judgment and pay additional £600 aprox to Disneyman plus agreement to use reasonable steps to remove CCJs from register. Agreement recorded in Tomlin order" Could someone first of all tell me if the above was settled and they paid an extra £600? Also what does the term "Abbey settled agreed to set aside judgment " I understand this as they settled the amount, but what does "set aside judgment" mean? Thanks

Posted the DPA letter off 29/03/2006 recorded delivery. I did hold a current account, credit card and loan with this institution. I remember over a 2 year period they charged me a lot of money. The account was subsequently defaulted, due to extortianate charges and sent to a debt collection agency. I paid off this, but ended up still paying way more than the original loan was. I estimate Intelligent Finance ilegally applied charges somewhere in the region of £4000, but will need to wait until the paperwork comes throught to calculate it all. I will keep you informed....

TheGoodSamaritan, Thanks for that - I always wondered how it worked. One question, do you think it;s wrong? -
Thanks Seminole... but what forum would I post in? I thought it was just a general question?

Hi, Can anyone help? I had a loan with Intelligent Finance from 2000-2003. During that time I missed one payment and got charged a hefty "penalty". This turned into nearly two years of penalties and also my current account was getting battered as there wasn't enough funds to cover the loan payment. Got into a bit of a vicious circle as i couldn't afford to pay the loan and the extra charges on both accounts. Both accounts were sent to a debt collection agency and a default was put on my credit record. I paid the debt collection agency straight away, I understand that claiming back charges on my current account is ok, but am I able to claim for charges put onto my loan account. They were between 30 and 40 every month? Thanks in advance, Adam
