CapQuest bought unknown Barclays Partner Finance debt

Letter from ccscollect

"Further to your recent communication with this office, we can confirm:

 

Above balance is for Club Account financed by Barclays Partner Finance 0211, last payment made **/Jan/09

 

Does not answer my request for proof the debt exists.

Write back again stating Capquest have not provided proof so s*d off, or ignore.

. Last letter from CApquest offered 30% discount!!

 

Son-in-law still as no recollection of debt

Experian states Capquest (formerly FTC) Account type Bank (my ???) started 03/04 current balance £309 Default date 30/11/09 default balance £445, account updated 18/11/12.

 

Account status code and balance for last 12 months has been 8 (in default) and starts at £296 and end at £309 (same as on last letter from ccs) couple of months show zero balance with a ?

 

for 13-24 it only shows one figure £445 with code 8.

 

Equifax shows Bank default, same start date, same defaullt date and amount but under effective date states End 30/11/2009 (no idea what this means). Has Terms as 0 @£0 monthly, balances as Limit £0 and start £0.

 

Son-in-law has no recollection of this account, had a tough time then trying to keep roof over head whilst his dad was nursing terminally ill wife, so have not pressed him on this.

 

No payments made to my knowledge - he has had no independent banking for 3 years. Was a debt from Barclays Partner Finance but sold to capquest.

 

At a loss to see what the info gives me - hoping it was statue barred but cannot tell

 

Advice as ever very welcome - will look at the other issues he has and post on relevant thread.

No change in situation - latest begging letter received,

 

still no proof,

 

letter states as legal owners they are using CRAs to assess current financial situation

- well I can tell them it is bad and getting worse by the day.

 

In addition state

 

"at this time we know of no defence to any such action and if you are unable to show a valid defence to the court a judgment could be awarded against you"

 

take it just a computer generated letter. Still no proof and had the discount offer so intens to ignore.

 

Have threatened to charge them for letter tennis so if i can be asked might send a speculative invoice.

 

Getting tired of it so will probably ignore.

New letter rec'd from Capquest, dated 16th August

 

- "despite several attempts to contact you, you have not made us aware of any circumstances to explain why your account has not been resolved"

 

- how about no response to prove it letter,

original debt with Barclay Partner Finance and assigned to Capquest.

Seen off CCS with one letter.

 

New letter states

"account will be transferred to Debt Partners on 14th August so already with them.

Not come accross these.

Would be useful to know their modus operandi and place in the food chain.

 

Advice welcome

- tempted just to ignore as discount been offered and no proof,

then if and when Debt Partners surface advise them no proof exists.

Just rec'd first letter from Debt Managers (Services) Ltd, acting for Capquest. They are threatening a doorstep agent visit, which I am keen not to allow to protect my daughter and her young children.

 

Will send off "still no proof" letter as sent to others trying to collect this. Wondering how best to stop any visits - if it was me would not be phased but need to try and prevent quickly.

 

All help gratefully received.
