The final repayment of a business overdraft will be made soon. No statements or balance confirmations have been received from the bank since 2008.

Should I just make the last payment? Should I write to confirm that I will not be paying any more? Views and/or comments would be welcome. Thanks

How do you know it's the last payment.

 

Because the total amount I have paid off will be equal to the last balance that the bank communicated to me in 2008.

You really should demand statements from the bank it would be unwise to assume anything.

They may have imposed charges interest etc.

 

Have you moved at all? Seems odd that they have just stopped writing in respect to an overdue overdraft. They are obliged to send a financial summary annually so something is amiss here.

 

You may want to do a subject Access request.

 

From experience things do nto normally just vanish into the ether. (unless your a quark or some other sub atomic particle)

Not moved!

 

Quite an involved situation I suppose. I do have other threads on here.

 

I had/have 5 accounts with Nasty. 1 of which is a business account. I have been repaying on all accounts. 2 are credit cards, for which no threatograms or defaults have ever been received, these accounts have never ever been listed by any CRA's, even when they were "current".

 

I received a "Notice served under Section 76(1) and 98(1) of the CCA 1974" for the business and current accounts. Both had terminated overdrafts. As post #1 I have not received any statements for the business account. I received a "Notice in Compliance with the CCA 1974" for the current account in February 2009, nothing since.

 

There is stayed court case for a current and loan account, stayed since 2008.

 

Nastywest do not respond to my requests, so I suppose an SAR would be the way to go. I did have one from them a few years ago, but a current one may be of interest! Thanks t

SAR made and response received. Surprise! No statements for this account received, although paperwork indicates that "statements annual" and a balance for the account is shown, but no date for the balance that I could see, and balance does not agree with my payments. I will ask again! Meanwhile, last payment (according to me) has been paid.

I suggest you send a formal complaint to their head office asking them to confirm that they have now received the final payment. You might want to point out to them that it is in breach of their statutory duty to not provide you with at least an annual statement.

 

The letter should be headed Formal Complaint and send it by one of the tracked methods.. Recorded or Special Delivery.
