Having filed my claim some time ago I recieved a letter from the Abbey stating that they would be asking for all cases to be stayed. I guess they're sending out a lot of these as it was just a photocopy and not even on original letterhead paper.

 

Now I'm coming very close to the end of the initial 28 day period when they have to file their defence.

 

They've not done so yet and nor has the court told me they have placed a stay on my case.

 

When can a case be stayed?

 

What if the Abbey dont enter a deffence? Will this affect their chances of getting a stay?

A case can be stayed at any time.

 

However, if Abbey don't enter a defence it may be worth applying for Judgement against them.

Sadly they have now entered a defence :(

 

In which case, you should hear from them shortly to say that they're applying for a stay on your claim. Once this happens - and if the DJ grants their application - you can (if you wish) apply to have the stay lifted. :)
