The judge awarded us our full claim amount (£4000) plus extras for travel expenses and a day's wages to be paid within 21 days.

Now I just need to get Barclays to pay up.

 

You should have no trouble getting your money now.

I would be on the phone 9am Monday morning to remind them of the courts decision.

I would predict 10-14 days for cheque to arrive..

They will have to get court instructions first which will take a week or so.

 

I see you are in Derby

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

Well done barney.bradshaw!! This is great news, Barclays have not submitted thier bundle in my court case which is scheduled for Sept 11, I have written to them asking for it which was due on Aug 15. I recieved the standard leter a week ago from Barclays stating that they would be asking for a 'stay' on all claims, I am just hoping and praying my judge feels the same way yours did! At my pre-lim the judge was ****ed at Barclays for asking for more time and for the games they have been playing etc... fingers crossed!!!

You've made me feel a lot better now Tony. I've been thinking that Barclays are going to continue playing games and we'll end up back at square one. I've been reading your thread and was so pleased you got your money. I shall do as you've said. Can I just ask, do you know why they don't put the money straight into your account?

 

Are you in Derby too then tony?

Maybe they will put the money straight into your account. Personally i dont bank with them anymore, so that would be difficult.

Was the 'he-he' you posted earlier said as a Spurs fan? I understand Derby were pants but couldn't bear to listen after the first 20 minutes. MOTD was full of cliches too!!

Not yet doefar. I keep checking our account just in case.

 

21 days is up next Friday and I've already filled in a 'warrant of execution' form. So if I've not heard anything by then I shall get my husband to call Barclays and give them one last chance to pay up or I shall take the form to court by hand.

 

I shall of course keep you updated.

 

I take it you haven't heard anything either?

You should consider using an enforcement officer once you get the warrant.

The benefits are; Court Baliffs usually inform the Defendants before they call on them....Enforcement officers dont.

Court Baliffs only work Mon -Fri 10-4

Enforcement officers work Evenings and weekends.

Court Baliffs dont usually make multiple visits

Enforcement officers will do this.

Court Baliffs will not usually break into commercial premises to seize goods.....Enforcement officers dont think twice if they need to.

The only downside is that a fee is payable to an EO before they collect,however they add this to their total so you do get it back.

Well worth considering as they are very quick to get the cash.

Make sure that you have the registerd office on your application....it can only be acted on using that address.

Have you contacted the Litigation Team and suggest they save themselves the embarrassment of being on SKY NEWS by settling before you send in the boys..

 

Im not kidding either, if they do push it to the max, get as much media coverage you can on the day they crash the doors, I know SKY and BBC will be interested in covering it.

Just thought I would update with latest developments.

 

Friday 7th was the last day for Barclays to pay up. I checked our account a few times and nothing in so we thought we'd leave it until today to contact the Litigation team.

 

Anyway, this afternoon I called Kate from the Lit Dept, but it was on answerphone. Called the other numbers but same thing. So I thought I'd try sending an email - something along the lines of 'if the monies owed is not in our account by the end of today I shall serve the warrant of execution'.

 

I had an email back within 20 mins saying to check our account as it had been credited on Friday.

 

Checked our account promptly and sure enough the money had been credited to our account (and looking very healthy I might add).

 

I can't believe I'd not checked over the weekend but it was a nice surprise.

 

So, my journey is now over, a lot of hard work and stress but all worth it in the end.

 

Many many thanks for all the advice etc given, I couldn't have done it without this site!

 

And Good Luck to everyone else with ongoing claims.
