hi all,

i had mbna ppi which i cancelled in july 2005,despite letter of follow up it wasn't actually cancelled by mbna till a further phone call from me in may of this year.i have sent mbna letter asking for the twenty two months of payments back.i am waiting for their reply and pondering my next move.any suggestions would be appreciated.

Reply has now arrived from MBNA.

'Our records do confirm you called to cancel on **/**/**** to cancel the cover.However,during your conversation with one of our specialists,you discussed the benefits provided by the policy,and you subsequently requested the cover remain on your account.Therefore we are unable to refund premiums as cover was requested.'

 

I THINK THAT FROM HERE I NEED TO REQUEST COPY OF TELEPHONE CALL OR TRANSCRIPT OF THE CALL AS THEY ARE TELLING LOTS OF LIES .HOWEVER I DID NOT EXPECT THEM TO TELL TRUTH GIVEN THEIR REPUTATION THOUGH.

 

ANY REPLIES OR IDEAS ON MY NEXT STEP WOULD BE GREATLY APPRECIATED.

Did you do a SAR and get all the infor that they hold on you regarding your account:-o This will include all correspondence, transactions and recorded telephone conversations:D

 

If you did a sar and you have not received a recording of the call transcript, demand it as they have not fully complied with the sar:shock:

Hello Hellhas,

 

Firstly thanks for replying.

 

They have not fully complied with S.A.R. as i didn't receive any details of communication,or transcripts of telephone conversations.I shall now write to them reminding them of their obligations.Would i be demanding that straight away as time limit for S.A.R. has now passed.

 

I don't believe them,as at time of phone call the 'specialist' :-x threw the phone down on me as i politely kept saying that i wanted the ppi cancelled.

It's amazing the things MBNA will come up with. I mean why would you ring up to cancel the PPI and then not cancel it, and of course it was over the phone and not in writing so they can say what they like and it's their words against yours.

I'm starting a claim against MBNA for PPI as well as the halifax so I will watch your thread with interest and offer support where I can.

GOOD GRIEF,I.VE ONLY JUST GONE AND WON!!!!!!!!!!!!!!!

 

Left this on the back burner until earlier this year.

 

Went through MBNA's complaint procedure until i had a final letter of response.After i received this i took my complaint to the FOS in July of this year.

 

FOS replied after three weeks saying that they could not investigate my complaint as MBNA were not regulated in july 2000,(when the card was taken out).However the FOS said there was a possibility of investigating the insurer,who underwrote the PPI.

 

Wrote back to FOS in August stating that London and Edinburgh,part of A viva were the insurers.

 

Received letter today from FOS stating that MBNA wish to settle on a goodwill basis,but do not admit liability.

 

Now have to argue with the FOS regarding the calculation of redress,and leave myself the opportunity to go to court,if need be.

 

The fat lady is not yet clearing her throat!!!!!!!!!!!!!!!!!!

A short while ago my oh contacted Alchemy org to sort out her ppi ( Lloyds ) she never told me, anyway they never call us and I do all the chasing, 4 weeks ago after an abusive call to them they said that they had offered a payment £1900.00 on approx £2800. blah blah, since that day I have heard nothing since? have you any advice or a letter I could send them.

I've never used a claims management company to chase up ppi,as there doesn't seem to be anything they can do that we cant do for free.

 

Have you got a thread i can have a mooch at ?

 

Also post up on the PPI forum there are loads of helpful people on there.
