hi all,have been following forum for a while and thought it about time i started a thread.

i hate mbna with a vengeance:x .to cut a long story short i cca'd them,and they have responded with an application form.two weeks later and they have upped interest rate and cut my credit limit in half.from here on in it looks like i am going for them with lack of executed agreement so as wednesday would say,gimme my interest.will keep posted with updates.

Yes, keep us posted. If it's two weeks later then the agreement is already unenforceable by virtue of s78(6) ofthe CCA 1974 - that means:

1) they can't ask for payment

2) they can't add charges or interest

3) they can't pass information to any 3rd party about the account

4) they can't put a mark on your credit file at any CRA

 

Write and tell them that.

Still waiting for response from mbna.Had a letter saying they would fully respond by sept 10th.Suprise,suprise no response yet.........

Cant believe its taken me over 2 years to update this one.

 

Didnt go for unenforcable in the end.Matter ended up at FOS,as a rate jacking complaint.As of today have an offer of a bit of interest back and rate reduced from 34.9% to 21.9%.
