Hi,

 

I have been given a hearing date of 21 Sept at Bristol County Court. I wrote a nudge letter to DG sols some weeks ago offering to accept £1600 against a claim of £1800. Heard nothing back.

 

What is likely to happen next? Given that the hearing is only just over a month away, I'm not sure it's worth applying to bring the date forward. But are DG still likely to roll over as the date looms nearer? Or will they let it pass and I win by default? Surely if I ring them up they will be amenable to settle earlier?

 

Any advice greatly received.

Hi Pike. It´s difficult to predict what willl happen now since the OFT case was announced - most bank are now applying for Stays (postponement) of all cases. You can apply for this to be rejected if/when you get notification. In the meantime I would suggest another letter to HSBC Using the courts is just a way of pressurising them to pay out asap - so keep the pressure up

No, you just need to ensure you are prepared to go to court. Basically you are waiting to see if the Judge stays the claim, if he does this link may help.

I believe that the judge is Bristol is likely to stay claims.
