We moved our mortgage from Kensington Mortgages a while ago. They were charging us 10.5% at a variable rate. The payments were so hard to meet that we had some late payments and minor arrears, all of which were heavily charged. Am I right in assuming that the same procedure can be used as with banks, in terms of reclaiming charges, and has anyone any experience of doing this with kensington or similar 'specialist' lenders?

Yes, you may claim the charges - Kensington will put up a fight however, but ultimately I believe they will pay. If I recall correctly, they charge £50 per month every month an account is in arrears. The interest rate you will not be able to do much about, but certainly on the face of it, a standard £50 a month charge would appear to be a penalty.

The procedure is almost identical and there are a number of threads where Users have claimed these charges back.

Look here for example - http://www.consumeractiongroup.co.uk/forum/mortgage-companies/

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

Yog. It is a relatively easy process and one that you do not need a company to do for you. We are all in the same boat and have dealt with mortgage companies so have a lot of experience between us all.

Using a company to do this for you means you will lose a lot of what you are claiming back, and after all it is your money so why give it away again?

Keep posting on here and you will be given everything you need to get your money back.

Ask away.....we are here to answer! However it really is important you understand the process and the laws it relies on. If you are stuck and cant get an answer from here then have a look in the weclome forum, there is a link which is an a-z.....fantastic for answering questions you may have.
