To cut a long story short, I had a call from Cap One last week informing me that my account was in arrears. (yeah, I already knew that...thanks)

 

I think that the Customer Services Rep was all of about 12 years old, and boy, was he patronising.

 

So that decided me, I'm going in. I think my claim will be somewhere in the region of £600.

 

I've noticed from my statements that I have sometimes (often) been charged £20.00 for a "Reversed DD". Are they charging me because my bank has refused my DD! Has anyone else experienced that?

That's on top of a £20.00 late payment fee, and a £20.00 overlimit fee! PLUS I get charged £35.00 from my current account for an unpaid DD. It goes on and on.....

I had that. A Direct Debit was bounced by my bank. I got the following charges.

 

£35 from my bank for bouncing it

£20 from Capital one for bouncing it

£20 non-payment fee from Cap one

 

That's £75 for one failed transaction after my cowboy employer dumped me in the poo and didn't pay me. Hardly reasonable behaviour from these responsible financial institutions is it?

Update:

 

Sent LBA 13 July, so it runs out today...

 

However yesterday when i got home from work there was the dtandard letter from Mr Udy offering me £12 per charge.

he also apologised for not replying to my prelim, apparently he didint receive it - thank goodness i sent it special delivery!!

 

My question is this:

 

Do I respond to his letter rejecting his offer? (if so how should I word it? -something along the lines of thanks but your time is up I'm pursuing the full amount through the Courts) or

Do I go straight to Money claim? or

Both??

I refer to your letter dated 21 July 2006, received yesterday, 26 July 2006.

Whilst you state that you did not receive my letter dated 28 June 2006, I can confirm that it was sent by Royal Mail Special Delivery on 28 June, and that Royal Mail have confirmed safe delivery to your office on 29 June 2006.

Whilst I am willing to accept the sum of £216 as partial settlement of my claim, is my intention to pursue the full amount through the Courts, to the time scale detailed in my previous letters dated 28 June 2006 and 13 July 2006.

Letter received yesterday. I got all excited thinking this was THE letter. sadly no, just a reply from our friend Mr Udy. Apparently he is disappointed that I have rejected his kind offer and that I intend to pursue my claim through the Courts (did that weeks ago)...however his offer of £216 still stands.

When I got my pay out from Halifax, I decided to pay off my arrears with Cap One, it was only a small amount, and I'll get in back when cap one settle.

I didn't know how to deal with the phone calls. After every call I would be upset, shaking etc. I work long hours and my kids were taking some of the calls. the youngest were getting distressed and I just wanted it to stop!

 

I'm sure your advice will be helpful to others who are going through the same harrassment. Thanks again x;)

THE Letter I have been waiting for arrived today - as a "purely goodwill gesture" they will refund my full claim amount of £748.04.

Go after ALL the "fees" reversed fee, late payment fee, & £20 overlimit charge Also don't forget to add contractual interest compounded.

 

Whoever charges you for an unpaid DD in your current account (assume its the bank) are also making unlawful charges. Also any payee company who charges you a penalty for non payment is doing it unlawfully. ALL are recoverable +INTEREST

Does it include contractual interest. If not that could explain why they are offering to settle now.

 

Only a suggestion but I advise you refuse to accept a conditional settlement. Demand payment without condition such as "full & final" you may find out later its not. I just have.

 

A debt which was settled 2 years ago has just been reactivated by me with the intention of recovering contractual interest which wasn't included previously.

 

Thankfully I had signed reserving the legal position should I discover at a later date etc:

Confirm they didn't, maybe you're confusing my Abbey claim?

 

Anyway, they settled in full - I'm happy. Be happy for me!

When you claimed back the charges did you also include Special Purchase Interest and Purchase interest? I ask because these show up on my statements along with Late Payment fee's and Overlimit fee's and wondered if they can be claimed too?

I only claimed for late charge fees, Overlimit fees, and reversed DD fees. As far I understand, you can't claim for purchase interest etc.

YOU CAN YOU CAN please read the FAQ's

 

Any interest that is added to your account because of penalty fees can be claimed & they can call it Scotch Mist for all it matters it's still part of the unlawfull charges

 

The term "purchase interest" only indicates the high level of interest you are paying for incurring penalty charges not that you have necessarily purchased anything.
