I came home from holiday yesterday.And found that the court had made judgment in my favor as the halifax had failed to reply to the courts notice of issue.And they must pay in full by the 2nd of september or face a summons to court or the bailiffs:)

umm was this before OFT announcement ,, just wondering if so you could be 1st to have charges back after it ,, will give a lot of hope to ppl waiting to hear from courts

Yesterday i received a letter from halifax solicters optima legal services.giving there defence.I assume that this in relation to the claim to my claim to the court and not because of the judgement.Do i pass this on to the court or do i wait untill the time set in the judgment any answers please:)

Might take a bit longer mate im in the same position judgement in my favour from the 1st august and they still wont cough up. Keeping telling me their applying for stay on the grounds they didnt receive court documents(rubbish). Warrant is awaiting good luck in your case and let us know how it goes

This claim was started in the court 10th july and judgment passed on the 02 august as there had been noreply:)

Hi Mcadden, I also recently received defence from Optima Solicitors (8th Aug). I had just given Halifax a further 7 days to pay up and was ready to file jdgement on 11th but got the defence in between. I am going to contact HULL court on Monday to see whats happening as not heard anything from the court itself. Please could you check out my thread as I have written up the full defence supplied by Halifax and am interested to know if it is worded exactly same as yours. Thanks

As of todays date i have not received any offer for payment in full.Time limit has now expiered.I have only received letter from optima as previouly mentioned.I phoned kings lynn court today.And they are sending information as to what to do next.Any help and advice would be help full as to wich forms to fill out.

today I have recieved the form off court saying Judgement has been granted by default for claimant.

 

This was dated the 29th Aug so its nearly 2 wks ago.

 

Did you have a date set on yours and did you have to apply for a Warrant of Execution?

Sorry bout all the questions but Ive not got a clue.

 

Be grateful if you could give some advice.

I was feeling excited before I read your thread , you having to wait so long for yours and still no sign, now Im not so sure.

I am waiting for information and the relevant forms to be sent from the court.The lady i spoke to at the court did not think that there was any problem with the case

I think that this is where yours differs from mine , I have no date on mine and was told they have been ordered to pay out immediatly, YEA.

Dont know if it makes any difference but was yours for a specified amount cause mine was.

Who is going to be the first one to send the bailiffs into the Halifax?

 

 

I issued a warrant of execution on the 8th August following a judgement on the 1st August.

 

Little good it did just cost my another £55 which i havent got.

 

Haliprats have just applied for the judgement to be set aside on the basis they didnt get the original claims forms(rubbish).

 

Would love to know if anyone has succesfully received their money after judgement was issued after the 26th July 2007. Inmy case their time to issue a defence ran out on the 28th July. Seems like they just ignored it on purpose.

Could I ask you on what grounds the bank has asked for a stay to be put on your Judgement.

 

Just curious to know what excuse they could be using.

 

Would it be the same as Humleys.

 

I wonder if Humleys bank Acknowledged his claim, cause surely if they did how can they say they didnt get the original claim forms.

they havent applied for any stay to my court my judgment stillstands.and if they do try and us the excus that they havent received the papers i will object.and that is what all should do.

I have today posted my application for warrant of execution.So i should here from my court in the next couple of days.And then the halifax could have the bailf calling at there head office

I Received notice today from Kings lynn county court that a warrant has been issued on the 13th september and will be executed by the halifax county court.So the halifax could be receiving a visit from the balif soon.I hop to here from them soon.But i do expect they are very busy with all the work that this puting there way.
