  1. Hi all, am I right in thinking the banks were at court sometime last week with the overdraft scenarios? I dont know what the outcome has ben but any information is much appreciated. Last I heard was their waiver had been extended a further 6 months. Basically just wanna know if we gonna get our money back or not. My claim back in July 2007 was for £6k so obviously the interest is adding up for me which is only good if we gonna win. Has anyone tried sending them a letter recently advising them to pay up on the off chance they dont want the interest adding up. Dont know if its worth a try or not? Cheers guys
  2. Hi all, as you can see from my thread it was September when I last posted a message. We are now well into January and I am absolutely non the wiser at to what is going on. Please can anyone update me with the latest news from this ongoing saga. Am I right in thinking the banks extension on there stay waiver is up this month? Thanks
  3. Hi to all. Can anyone tell me what the next important date is with the banks and their test case appeal. I have completely lost track with whats been going on and unfortunately can not see a light at the end of this very long tunnel. If someone could just give me a quick update that would be fantastic, thanks.
  4. Hi all please can anyone help. I had a Barclaycard and after getting into difficulty with it I got behind on payments and, long story short, ended up having a default notice in relation to the card. Since then I have made arrangements with Barclaycard to pay so much a month and since have looked on my credit file with experian. This shows I still have a card with Barclay but shows the status as 'satisfactory' yet still shows a default. If my account is 'satisfactory' how can there still be a default on it? Anyone any ideas how long they last and if there is any way of getting them removed. Thanks

  6. Well today's D-Day for banks appeal. Wonder what they have up their sleeve? Has anyone had a payout offer recently?

  8. Does it look like we maybe in with a chance of getting our money back now? I must admit I was getting rather despondant with the whole thing but was pleasantly surprised when the banks lost the first part. Fingers crossed. Halifax.....Show me the money!

  10. No your right, my mistake. I was thinking it was £28 missed DD but after looking back it was £39 before.
  11. Well I dont believe it. After keeping my head above water for the last few months I missed a DD last week. Not only has the Haliprats charged me for this but its gone UP, THATS RIGHT UP!!!! to £35. My mother in law has an account with A&L and they have recently reduced their fees to £5 for missed DD. The Haliprats are certainly 1 in a mill. Hope this test case comes out in our favour.
  12. Well I have followed suit and sent off my petition letter relating to the court case being moved in a Resolution Centre rather then the HighCourt. Hoping if enough people pass the petition on our voice will be heard.

  15. Hi Stone, So am I right in thinking I need to copy the letter devised by Penfold and then email it to all the newspaper links provided and anyone else I think it may help our case. How do I get hold of MP's email. As I live in Hull it may be wise for me to email John Prescott but wouldnt know where to start.
  16. It all seems to have gone very quiet now everyone is waiting for the test case. I havent heard of a stay been lifted for at least the last 6 months so looks like its going to be a long wait. Trying to look on the bright side that the longer it goes on my daily interest is getting added. Just as a matter of interest, if it turns out the courts agree the charges cost so much but not what the baks have said and we get refunded the difference, would we all have to start again or do you think those of us that have already got a claim in the courts we will automatically get paid out first? Was hoping to bring my wedding forward this year as I due £6k back but it not looking good at the mo
  17. Nice one. What would have been even better is if by £10k being drawn from his account he had gone into the red and been charged for it. Now that would have been justice, lol. You ready for the test case which starts soon? What do you reckon will happen?
  18. Hi all, anyone any idea to what may happen in January when this test case goes to court? Is it def set for Jan as some are saying Feb? Hoping it gonna get resolved but its been so long already. Are the banks just having to prove how much it really costs for unauthorised o/drafts, bounced cheques etc?
  19. Well in court the stay was allowed to remain so what a waste of a day!!! I took my statements clearly showing my struggle to get out of the red among other paperwork including a demand from a debt agency but the judge was not interested in the slightest and are not willing to make any decisions until the test case.   20. Hi, please can anyone help. I am in court tomorrow for my hearing to have stay lifted on my claim. I have printed out and have copies of all correspondance received and sent between myself and Halifax. I also need for my court bundle a copy of the DPA 1998 and Human Rights Act. As both are huge am I to only print out relevant sections or do I need to take the full lot? Any other advice for tomorrow would be greatly appreciated.
  21. Hi Jody, my claim is for £5354 and with interest added on plus court fees £6721. I filed at court using N1, it cost me £250. I have since had a stay put on my claim which I have filed a notice for removal (another £35) and I am in court on 31st October for my hearing. I have had no problems with the claim being over £5k it just costs a little more when filing. Don't cut yourself short just to get it under the £5k, its your money at the end of the day. Good luck. Keep your Fingers crossed for 31st as could do with some luck myself

Oh Oh, I just come off the phone with Hull Court and they say yes I got to go to the hearing on the 31st October and take with me anything I feel will make my reasons for wanting the stay lifted. Now I am freaked out!!!! Will be spending the next 2 weeks getting my stuff together and asking lots of questions on here. Anyone at same stage as me with advice would be greatly appreciated.
