  1. Mine letter which I received from Halifax dated2nd August is exactly the same as that letter word for word, including reply by 5th October. They have until 11th Aug to pay money into my account or I file judgement. So what next? Do we just ignore the letter or reply rejecting offer?
  2. I have received a letter from Halifax this morning stating they have asked the FSA to suspend any legal issues relating to bank charges and that they have agreed. It goes onto say they offered me £280 in full and final settlement and this is my last chance to accept that. Is this another standard letter from Halifax? Also, there is no mention of my actual court claim in the letter so if the bank has still chose to ignore the court claim but say they have asked the FSA to suspend all timetables relating to claims will this still mean as far as Hull Court is concerned that the Halifax have not responded to them and my claim will go ahead. Not quite sure who got the last say here, the courts or FSA? Any advise is a help.
  3. Hi all, just to let you know I rang HULL COUNTY COURT on 3rd August as not heared from Halifax and this was their deadline to reply to N1. Guy on phone informed me to continue with claim as they had not been instructed to do anything else and told me to send my judgement request off. I have decided to give bank a further 7 days first though to pay up as instructed by experienced Caggers on here. Good luck to everyone claiming.

  5. I mentioned this to the courts on the phone and they said why give them another 7 days when they haven't responded to the given deadline by them? What do you think, would you give them extra time anyway?
  6. Well today I rang Hull County Court as Halifax had to reply by today. Court have not heard anything from them and advised me to therefore send in my request for Judgement form which I will post tomorrow. It appears they are carrying on as normal and leaving the decisions to the judges. Just hope I get one whose being stung by Halifax, lol. I have ticked the Defendant to pay immediately box on the judgement, but was wondering how long before I hear something once courts received it. Any ideas?
  7. So if I ring the courts tomorrow to see what happening. Cant believe Ive got this far for this to happen. If courts get a stay what does this mean exactly. Does it just give them longer to delay? Deadlines for me where 3rd to reply and 17th if defending.
  8. Help! I dont know whats going on as heard so many different things. I filed N1 couple weeks ago (13/7) so Halifax have until tomorrow (3/8) to answer claim as to whether they will be defending or not. If they defend they get til 17/8, but due to post strikes and this OFT case I havent got clue whats going on. As I filed before this OFT case came in does my claim continue as normal or are all now on hold? What should I do tomorrow as far as not hearing from Halifax goes. Do I ring court and let them know? Thanks all:confused:
  9. I filed N1 Fri 13th July and it was deemed served 20th. Halifax have until 3rd Aug to respond and if they decide to defend they have until 17th Aug. Does this still stand or is it now out the window? I am relying on this money as had to borrow the £250 to file N1 so cannot afford to be kicked out
  10. The feelings mutual. Hopefully they wont take the £280 back off me they will just top up with remaining claim. Is that what normally happens?
  11. Well they've got til Friday to decide whether their gonna defend or not. Cash machine took my card today when I tried to get a balance to see whether they had taken any money from my account. Swines lol
  12. Well surprise srprise, I received a call from the Halifax this evening with some stuck up bint informing me that I am £200 over my overdraft and that I need to pay it back now. She then went onto say I have the relevant money in my other account which she will use. I told her to do one as they had never rung me before to pay back my overdraft and that the money in my account was a payment I had not accepted. She said she was in her rights to use the money at which point I erupted down the phone that I knew her game plan and that I would sue anyones ass that touched my account without my permission. She then agreed to give me til 31st July to pay overdraft (my payday so no worries there). She then rudely hung up on me. Just hoping she not gonna take it anyway. What an absolute moo!!!
  13. I filed at court on 13th and Halifax were deemed served 20th. They have until 3rd August and if they defend until 17th August. Yesterday 25th I received a letter from Halifax stating they would be depositing £280 into my bank account as full and final settlement of my claim (which is £6741.46). Sure enough on checking my account I have had the money put in. After excellent advise from Tilly (yet again) I will be sending my rejection letter by recorded delivery tomorrow and are going for 100% of claim. Will keep you all posted on my progress.
  14. Hi, I have already filed at court on 13th and Halifax were deemed served on 20th. Yesterday (25th) I received £280 into my bank with a letter on same day stating exact same wording as yours. As I have already filed at court I have added the interest on so like you will not negotiate for anything other then 100% which is £6741 for me. I will ring to do it verbally and then send rejection letter. Will keep posted on your progress and good luck.
  15. You are in control of the time so if they have taken longer then 40 days send them the non compliance of DPA letter. Its in the templates
  16. Hi Mike, like you I got the standard 'our claims are lawful sorry we cant help you' letter. I sent them the LBA giving them 14 days ro refund into my account the charges. After 14 days I had received nothing so telephoned them to give them the opportunity to pay up. They said to me after investigating my claim, they were sorry to hear I was unhappy with charges applied but due to the fact they were lawful there was nothing they could do. I then told them I would take them to court which is were I stand today. Do not let them bluff or put you off. I filed my N1 with schedule of charges including interest which now amounts to £6471 + £250 court costs. There is no way I will let them talk me out of my money. You do start doubting yourself but from the research Ive done we are entitled to it back. Keep at it and good luck
  17. Well I've done it, just hoping its gonna be the best £250 Ive ever spent. Handed my N1 in, POC and schedule of charges. I asked the guy behind the counter what happens now. He told me I should hear something within the next 14 days. He also said the banks will usually defend so dont be surprised at that but they then pay up in last week of defense needing to be in. Fingers crossed. Keep checking back for my progress.
  18. Well tomorrow (Fri 13th) is the day that I file at court. Just hope its gonna be unlucky for Halifax and not me. Will keep posted my progress throughout. Ive got my 3 copies of N1 completed, POC, Schedule of charges also showing interest and the money to pay for claim. Will I need anything else?

  20. How did you word your POC as the hard copy I have for the N1 does not fit on the MCOL version?
  21. Hi, I am at the stage ready to file at court and would like to know if anyone has been successful with MCOL. I went on line to complete paperwork and was stuck when I got to the particulars of claim. All the paperwork I have is worded for County Court therefore it would mean me cutting my particulars down and I dont want to end up ruining my chances. The good thing with doing it on line is I can pay now on card where as to go into court I dont have the money!!! Please help if anyone has won via this means. Thank you
  22. After finally adding on final lot of charges my claim is now £5570 + interest £901.46 = £6471.46. Looking to file at court sometime this week. Would like to have done it on line but not sure how guaranteed you are with MCOL. Anyone been successful?
  23. Hi Fairy, if you talk to people on this site you cant go far wrong. I am currently in same position as you. I am filing my N1 court papers on Tuesday I just need to have another quick tot up as since working out my figures Haliprats have charged me some more! Will keep watching your progress and see what happens along the way. Dont forget to add on your 8% when filing. The extra interest helps, mine came to £896.95 so always a nice surprise. As the Halifax says they like to give you that little extra!!! LOL

  25. Going for the one big one. Still entering my data onto the spreadsheet for interest. It is the Statutory interest spreadsheet i need to fill out isnt it?
