      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you for your comments. It's not my money:(

Belongs to my son but he has promised his old mum a small reward. It's my Birthday tomorrow so may be treated to a small piece of jewellery. :D

 

On another note; money not yet in bamk so have sent a reply to Abbey stating if not in the account by the 7th July court bundle will be submitted and court process followed.

Thing is Abbey did exactly the same thing to me. Made an offer to settle in full before I sent the court bundles but no cheque yet.

 

My court day is (was) 25th July, just after yours and I'm hoping this is not a ploy by Abbey to stop me submitting my bundle so they could then apply to strike out my case.

 

Does anyone know if the offer to settle letter is legally enforceable?

Could they wait until after the deadline for submitting the bundle has passed and then start argueing?

 

I think I'll send in the bundle anyway just before the deadline if I haven't actually received a cheque.

 

What are you going to do?

I haven't heard of this before. Is it a new strategy? I'm nervous 'cause I wouldn't trust them as far as I could throw them which isn't very far!!!

Apolgies for not replying sooner.

No money in account as yet. Son will phone Abbey tonight to ask when it will be paid in or court bundle will be sent in on 7th and 'see you in court'. Like you don't think they will pay up quietlydespite the content of the letter.

Is your letter from Location Code TS6 BO3 c/o Abbey National House and signed on behalf of Abbey?

If so these are the solicitors acting on behalf of Abbey. My son has just phoned them and he was told that Abbey have sent cheque to them and when they receive it they will send it on to him. Could be another 7 - 10days before he receives it. They said that Abbey had definitely agreed to settle. My son informed them that if cheque wasn't in by 7th July then court bundle is still going in for the 9th as court case is the 23rd July.

I can't believe that so many people are getting different responses and outcomes from the same bank. He goes on holiday on the 16th and returns 22nd. Won't be much of a holiday if he has to prepare for court at the end of it. :-x

Soooo pleased .

My son came home from work last night and said he'd had his money paid in. Now I can relax and choose the piece of jewellery he promised me. :D

 

Glad it's all over us and hope others waiting stick to their guns and get the money they deserve.
