      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I was wondering if anyone else has had issues with their PC insurance bought from PCW. I took out the protection package (paying monthly for a year) to protect my PC. I had to ring them several times within the first few months and ended up ringing a £1 per min hotline of which no-one told me was for customers who had not bought insurance until the call was nearly over!! then when i rang the correct number they just kept telling me there was nothing wrong with the PC and should re-boot it blah blah blah. Eventually I got a friend to fix it. Then last year (my insurance did not run out til Jan this year) my monitor broke and when I rang up to get it fixed they told me my monitor was not covered as I was a discontinued package I had bought and the monitor was a different brand to the PC so was not covered. I have wrote several letters to PCW but to no avail - can anyone help as I feel I have been conned somewhere along the line???

Surely the fact that the monitor is a discontiued line is irrealavent as is the insurance neither of which effect your consumer rights. It still has to be fit for purpose and last a "reasonable" length of time from purchase. How long have you had the monitor?

Pinched this from one of Bookworms post relating to a different thread, but the Sale of Goods Act applies to all items bought.

The Sale of Goods Act 1979 (as amended) says that goods should be as follows:

  • Of satisfactory quality. This means the goods must meet the standards that any reasonable person would expect, taking into account the description, the price and all other relevant information. In some circumstances, the retailer may be liable for any statement made by the manufacturer about the goods.

Satisfactory quality includes the appearance and finish of the goods, their safety and durability and whether they are free from defects (including minor faults)

 

  • Fit for the purpose that goods of this type are generally sold. They must also be fit for any specific or particular purpose made known to the seller at the time of the agreement.

Part of this is looking at the price and deciding how long it is reasonable for an item to work bearing in mind it cost/usage etc.

you said it broke. accident or just stop functioning?

 

electronics are suppose to legally last 12 months, hence why all electronics have a 12 month guarantee as standard. so the UPTO 6 years and 12 months as standard mean the same thing. go to monitors manufacturers website and see if you can see anything about a lifetime expectancy of the monitor. this may help exceed the 12 month threshold

 

UPTO i love how companies like insurers use UPTO

Save upto £300 on your insurance (i saved £21)

get upto 8MB broadband (my town averages 2MB (me 1.8MB))

 

but legally there nothing wrong with it.

secondly. i am not sure about pcworld stuff but when i bought the aftercare there was one price of like £6.99 for the PC and £1.99 for the monitor. obviously not explained that the one price you paying for does not cover everything on the trolley like the software printer cables and monitor. who's fault, no body knows. but after months of having the aftercare did you read the certificate at all? it was also explained to me that the after care continues for however long i want it for as long as the payments continue im covered not just 12 months but for life.

 

i know about SOGA rights etc but i took it for the data recovery, and the accidental damage which SOGA dont help with. i have 3 kids, its self explanitory.

 

i used my own data recovery software at home and it was $h1T so i took pc into the store and they used their software and WOW retrieved my 2 years worth of work. had private quotes for similar job in excess of £200 so i dont mind the £8.98. but if you dont have kids and you backup regularly it might not be with it.

I'm not sure what data recovery has to do with anything. The OP stated his monitor had broken not the PC. Given that most monitors cost around £100 at least I can't see a court accepting that 1 year is a reasonable time for it to last. Mind you by the same token 5 years is probably unreasonable. I think for most electronic items 3 years of usage at a min is reasonable, and could be argued before a judge. My understanding is any kind of guarantee/insurance provided by the retailer/manufacturer is above and in addition to these rights.

Not sure what don't get sorted is saying, do you work for PC work lol.

My hubby has his own IT company and does data recovery for much less than £200, and has recovered important docs and photos where certain larger companies have failed.

Wonder who he works for lol. If it is PC world what a joke. Anyone who knows anything about IT knows how little knowledge their so called advisors have. Just salesmen really. Hubby went with someone recently as they asked him to help them find a PC package, he actually laughed out loud at the rubbish advice being given.

Not the consumers fault it is reasonable to assume from the adverts and the shops that these people know what they are talking about, like the banks in this country we are brought up to trust these big companies. The trouble is when things go wrong, like the banks et al they just aren't interested. Thats why I say go CAG lets reclaim all our rights and give em a run for our money :)

Hey Demon, can I nick your piccy, I see sooo many posters on various forums that could 'benifit' from this :)

I see lots, if not most electronics coming with 3 years warranty now.

 

When the manufacturer themselves, put a 3-year warranty card in the box, you struggle to argue that 12 months is reasonable !
