Hi everyone,

 

This is my first post in this, or any other, forum so please excuse me if i make any faux pas' or ask for information that is available elsewhere or been covered before.

 

I've been down the claiming my bank charges route and unexpectedly had to issue court proceedings. NatWest has not only decided to defend the claim and instructed solicitors, siting all sorts of inexplicable gobbledy gook, but they've also issued a "Request for Further Information and Clarification". This asks for lots of info about whether I am claiming it is a breach of contract, which term has been breached, identify the contractual provision(s) that the claimant alleges are invalid by reference to the Regulations and other such scary and intimidating stuff. They state that I must supply replies to all their questions within 14 days or they will ask for the claim to be struck out.

 

Now I realise that this is just posturing on their part in an effort to get me to cave in but I'm not sure what I am obliged to do. Can I just wait for the Allocation Questionaire and ignore all this stuff until we get to court (heaven forbid!)? Or do I really have to find out all this stuff in which case I think I may need legal advice.

 

Sorry to be so waffly, feeling a bit intimidated.

Hi sarah, welcome to CAG!

 

My first piece of advise would be to start a thread in the NatWest forum, all banks deal with these claims slighlty differently so if you post in the relevant forum you will find an obundance - sp? of people who've been through, and are going through, exactly the same thing as you.

 

Have they but in a defence yet or just said they're going to?

Did you send the letters from the library - prelim and LBA?

Thanks for the directions. I think I've found all the info I need and I now feel confident about how to proceed.

 

They have actually entered a defence. Yes, I did send the letters from the library, they certainly made life much easier.

hi sarahgore, first thing is don't worry to much about this as natwest are about to start to play there ( we will scare you) game, in the hope that you will give up. i have just got back £1750.00 from natwest & £1350.00 from halifax and both time i have taken them to court. i will need to see what you have done so far, if you would like me to help you?
