I think you need to query your excess etc as you should have been compensated for that.

 

You never said if you paid for the physio or if it was on a credit basis. If it was then it wasn't really your money so to speak and it it standard practice to discharge your liability for it on your behalf.

as far as we were concerned they were claiming for physio through the other party, yer they asked for proof of us paying excess which we did send it off ( a photocopy) and she said she would claim it back for us but we haven't had it :@ so angry

You need to speak to you solicitor and specifically ask what is happening with your excess etc.

 

The physio is being funded by the other side, its just that technically it is a cost you have incurred and so they pay your solicitors who in turn send the money that you owe directly to the physio. As you have never paid the physio fees your not losing out.
