      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

yeah i would include the defence paers as part of the correspondence with aq too hey if your got that mercantile hearing at leeds others say you dont need to bother withyour bundle just get that cmi sheet down

Looks like this is it. Hope I wont be the one to set a presidence by because knowing my luck I will be.

Has anybody heard of a case going to court and the defence not turning up?

What happens if this is so?

Received chq. today for £4449.07 from Nobbetts.

Total claim amount was for £5225.56 not inc. admin charges.

There was also the standard letter saying that they reckon they would have won this case and i should accept this as full and final settlement.

Can anyone advise me on what I shoulkd do now.

Dear Sir/Madam,

 

Thank you for your letter dated 16/04/2007, I accept your offer of£4449.07as settlement of my claim up to 16/10/2006 on the basis of no confidentiality. This figure of £4449.07 does not include the amendment that I added for unlawful charges levied to my accounts since I started this claim.

 

I consider that your clients repeated representations that their charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them. I do not agree to any future regime of fees your client applies to my account/s in relation to direct debit refusals, exceeding overdraft limits and so forth, which are unlawful at Common Law, Statute and recent consumer regulations. If they say that they are not, then will you please ask your client to demonstrate this by letting me have a full breakdown of the costs to which they have been put by as a result of my breaches, in order to reassure me that their penalties really do reflect their costs.

 

If you do not agree to my terms then I will see you in court where you can explain to a Judge why you feel you can place conditions on my acceptance.

Aussie sorry no, haven't as yet needed to go to court,

 

I was just think the down side to the data being on a forum like this is that it breaks up the follow of information. What would be got would be a dedicated web site so you go a page at a time with source links, and less need to navigate thru the other forms. If that makes sense. I love teh forum and what it offers but intially it was a little overwhelming and when i came back to look for certain forms i got lost. Also would be good to get a bundle down. I.e. Step 1.zip etc, with the relative docs and a readme walking you thru it. The idea i have vaguely in my mind does heavliy depend on the forum being there.

 

Anyone think a flow diagram would be a handy thing to have. Like Step one do you have a list of all charges YES NO, YES ---> Have you created spread sheet YES NO etc. Thoughts anyone.

 

Sorry To have high jacked the threat for my ramblings.

I think a flow chart has previously been suggested.

 

Any suggestions you all have aren't going to get much exposure in the RBS forum. There is a THIS SITE forum at the bottom of the list where you can make suggestions for improvements to the site. It might be worth searching it first because a lot of what you guys are suggesting right now might already have been covered off.

 

The problem you have is that everyone on here is voluntarily here. Anything that might need setting up like a flow chart or new guides is done by people off their own back. So if you suggest something to be done, who is going to make it? A lot of what is there for the help of other people is what has been done by people (ie normal users) off their own back.
