      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok just back.I am limited to what I can say-for reasons which I hope I can expand on later.

The position is this....the hearing was scheduled for 1 hour I expressed my concern for this from the start.Judge agreed to hear me out and decide if I had any case.

Anyway after hearing me out for over 2 hours he came to the conclusion that the arguements I was putting forward were valid ones and had validity outside Smiths ruling.

I supported everything I put forward with case law and also back up documents.

I think what threw the defence was a number of points that had not been used before -and so these were Ace cards so to speak.

After 5 hours the Judge decided there was not enough time to hear the case out in full.

A number of orders have been made to both sides.

I cant disclose details of those at this point.

What I will say however is that I am very happy with the day.

Please understand that I cannot be more specific-for a number of reasons.

Sounds like the Martin we've all gotten to know - brilliant Martin..if you kept a Judge listening for 2 hrs you've been doing something right. well done.

 

Probably only kept the judges attention 'cos he thought there were 19kg of Semtex in his case !! :D

About costs,

From going to court with Tiglet, may I suggest (in case you haven't done so) that you detail the time spent working on this in 10 0r 15 mns time "slices"? The judge in Tig's case felt that she couldn't have spent as many hours as she said working on her case, and I think that is she had it diarised as it happened, he might have been able to get a better picture of how much time a LIP actually spends on those cases. Just a thought.

Yep I would use a spreadsheet and itemise it.

Pretty much the same sort of thing as used in Wasted costs schedule-Ive done a couple of them and had no probs.

I wouldn't presume to tell you how to present costs, as I gather from your posts that you must have done it umpteen times before, but I find it useful to transfer spreadsheet data to the various categories on form N260 (Statement of Costs for summary assessment, which you can fill in on-line for neatness & legibilty). That way the judge perhaps wouldn't raise his eyebrows at 10 hrs for this, 14 hrs for that, 6 hrs for the other, whereas he might at a claim for just a lump of 30 hrs (ref.Bookworm's post quoted). Also, judges seem to like you to use proper court forms. I would attach the spreadsheet headed up "Bill of Costs" & the case ref.at the top. A "notes" column on the spreadsheet is useful to explain why something took such a long time, for example.

 

For those who might not know, a LiP can charge £9.25/hr for time spent on their case. For details see CPR 48.6 & PD 52.1. Car travel is 40p/mile; parking, miscellaneous expenses (postage, copying etc) and public transport at "reasonable" cost.

Yes costs have escalated on both sides during the course of the last 29 months.

Their last submission was just short of 2.4k and I expect this to rise.

In all 6 hearings costs have been reserved.

 

I am still not in a position to go into details,and anticipate there is yet some way to go.I think it will be around 6 or 7 weeks before I am properly able to evaluate the results of my efforts.

 

Neverthless I remain quietly confident,and determined to see this through and you can be certain their actions and tacs that have been much in evidence in many cases,have not had the desired effect for them in mine.:)

I may be able to give something new in 2 weeks-until then I am still in the dark myself.

To be honest I have no idea on what will follow-Barclays are giving nothing away.which is what I expected I suppose.
