Have sent the 2 letters and now the 14 days is up I was ready to file court papers today. However yesterday I got letter saying that they are investigating my complaint and have 8 weeks to investigate this. Do I still carry on and file court papers or I they allowed this 8 weeks (Ithink not but am not sure).

Keep to your own timetable. You are not making a complaint, you are claiming back unlawfully applied charges.

 

The 8 weeks is a diversion in the hope that you go away.

 

File the court papers and wait for your money

Letter they have sent you is standard compliance with FSA regulations with regards communicating with customers (under FSA regs the Bank has 8 weeks to resolve an issue/complaint to a customer's satisfaction before further action may be considered through the Financial Ombudsman).

 

Just ignore. No need to keep your fingers crossed. If they choose to reply with only automated responses then more fool them.. if (and this is very very unlikey) it ended up in litigation then the court would view them very very dimly as this proves that they failed to take necessary steps to avoid litigation. You almost win by default!!

BARCLAYS settled in full 2 days prior to submission of defence by Barclays

CAP ONE settled in full on day 14 of LBA (£210)

Also have you not thought of amalgamating the two claims - saves you money and time...?
