  12. 28 days in total from the date the notice was deemed served - so it doesn't really matter if they acknowledge after three days or thirteen - the timeframe will automatically be extended to 28 days from deemed served date to submit defence.
  13. Please check your information is correct and accurate before asserting your knowledge. Natwest Bank is a registered UK PLC. Just because it is part of the Royal Bank of Scotland Group has absolutely no bearing on its PLC status whatsoever. Just to clarify this point: Regulatory Information 20 National Westminster Bank Plc. Registered in England and Wales (Registered Number 929027), Registered Office: 135 Bishopsgate, London EC2M 3UR. Authorised and regulated by the Financial Services Authority. Thus I would suggest my earlier advice that cheques be made payable to "Natwest Bank PLC" would be deemed acceptable.
  14. That is absolutely outrageous. Go over your calculations just for peace of mind. Then send the decline letter as you intend, though I might be minded to include the fact that should this matter reach court you willbe submitting to the judge copies of ALL of your previous correspondence undertaken in attempt to settle this dispute, and then allowing the Judge to conclude where the balance of mediation lies.... Further, I am sooooo incensed by that particular statement, that I personally would be including in my decline letter the fact that I intend to copy the previous correspondance to the Law Society for reference with regards a blatant abuse of the "Without Prejudice"" priviledge - this letter is intended to be written without prejudice to protect our client, but we will remove that priviledge where it benefits our client should you not conform with our request?!? How can you have one-sided, restrictive application of a fundamental, ethical (and legal) principle? I particularly like I would love to see how a judge view such an admission as "reasonable" on any grounds. How delightfully arrogant. Good Luck:)

  18. Just a waste of paper and postage really. Basically saying: "Dear Reload, we acknowledge your request and will effectively grant it in full by supplying your statements. We are too lazy to bother saving the rain forests and shareholder costs (cos we already make a mint from unlawful charges). Ya we probably intervened on your account, but have no real record, in the same way that when you walk into a branch and up to the counter we "manually intervene" via the bank teller, but don't really record this. Oops, we've just realised, the whole thing about manual intervention is stupid. We are a bank. Therefore we have certain overheads. One of which is employing people, real live human beings, to provide our operations support. This is an accepted cost and overhead of any business. It is far too remote to attribute to you as an inidividual customer, I mean we would still have to employ physical entities even if you didn't go over your limit and incur charges. We are of course trying to reduce the number of human beings we employ, hence the automated services, Indian call centres, and online systems. But damn it. We still find that we have to actually employ real people to provide our service. And so this whole issue of manual intervention really is annoying us, because we would like to blame you the customer, but realise that this sounds ludicrous. Therefore, you are right, we don't have any record of "manual intervention" on your account, but we assure you it does take place.   19. If you have 4 years worth of statements already from online, might I suggest commencing action immediately rather than waiting for the remaining 2 years of statements. There is nothing to stop you initiating the Prelim letter requesting refund of £1000 based upon your calculation - it will only receive the standard response, you can the send the LBA again stating that amount (or an ammended amount in light of receiving your data). You may ammend your claim amount right up until you file, indeed after if you are willing to pay £35 to change the amount for which you have filed. Either way, it ensures you get the ball rolling, and their admin does not delay your action - the result of which will be the same in the end. You can choose to mention in your prelim letter that you are awaiting the full disclosure and will contact them regarding any outstanding balance or you can just leave them in the dark until you receive your full statements. it's a win win as they say...
  20. you don't NEED to supply the bank with a schedule of charges or how you arose at your calculation in your initial correspondance. They have access to all the same information and can refer to it if they wish to query the amount. It might, however, be prudent to include a polished up copy of the interest calculation spreadsheet (see the library) at this stage just to eliminate any possible procrastination by the bank. At a later stage, perhaps after filing any claim, or when you receive your court allocation questionnaire if it goes that far, it would be time to think about supplying an accurate breakdown of your calcuation. But, to be honest, your priority at the moment must be to make an accurate and honest calculation and approach the bank with an initial figure that you wish to dispute and thus claim for. So just get your highlighter out and start using the ink!

Send it to either branch address for the attention of "The Manager" as it will be forwarded by internal mail to the correct department - ensure that you quote both account numbers and that you are requesting data disclosure pursuant to the 1998 Data Protection Act.
  22. I might be tempted TBH to just file now - as the letter you have received can clearly be accepted as the response to your LBA and represents the bank's position. Therefore there is no requirement to wait until the deadline is expired. Also, just whack on the two £38 charges - and advise the bank in a one paragraph letter referring to their earlier letter in which they withdraw the offer. Inform them of the fact that you have filed against them, and include a summary/schedule of charges from which you calculated the amount you are claiming (including the latest 2 x £38).
