  2. Ok so on 11-08-06 I issused judgement on NatWest and I haven't seen or heard anything since the only button left to press on the court site is warrant and also it says on my request for judgement Northampton county court (far from local) so my question is what is next?
  3. Ok so I've recieved an acknowledgement but no defence yet they have 28days from date of issue which takes us to 2nd August if they haven't entered defence before then what do I do? Click Start under judgement?
  4. Ok so the time has come it seems I am filing a claim in court so I'm on Money claim Online but I'm stuck... Will my claim include any issues under the Human Rights Act 1998? and when I ticked yes for claiming interest it says I have to include: The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. so how do I word this since I am claiming interest from different dates?
  5. ok so I recieved a standard letter today (reading other posts i've seen very simalar letters) saying that they've formally withdrawn my goodwill gesture of £38 boo hoo!!! and asking me to reconsider legal action. I have two questions; 1. do I start legal action now or wait until 30 of June (14th day after LBA)? 2. I have since incured two more charges at £38 each can I claim for these too or do I have to go through the whole process again?
  6. MY letter xxxxxx xxxxxx xxxxx xxxxx xxxxx 2 High Street Wombwell Barnsley S73 0AB LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBERS: 51-61-35 7xxxxxx2, 51-61-35 7xxxxxx3 & 51-61-35 7xxxxxx5 I have received your letter dated 14 June in which you made me an offer of £38. As a matter of goodwill, I will accept this offer as an interim payment only. I will consider the matter resolved only upon receipt of £190 or, should my account be credited with the aforementioned £38, then £152. If I do not receive remittance advice of this amount within 14 days from the date of this letter, I shall proceed with Court action to recover any outstanding balance, plus costs, plus interest as provided for under s.69 of the 1984 County Courts Act. I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken a total of £190.00. I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 08 June 2006 I require repayment in full of this money and. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. Yours faithfully, Mrs A Hxxxx 16 June 2006 Schedule of charges 51-61-35 7xxxxxx2 12 Apr 2006 UNPAID ITEM(S) , D/D 3.96, PAYPAL PAYMENT £38.00 51-61-35 7xxxxxx3 27 Mar 2006 UNPAID ITEM(S) , S/O 460.00, MR & MRS Hxxxx £38.00 51-61-35 7xxxxxx5 24 Mar 2006 UNPAID ITEM(S) , S/O 145.00, MRS A Hxxxx £38.00 26 May 2006 UNPAID ITEM(S) , S/O 150.00, MRS A Hxxxx £38.00 2 June 2006 UNPAID ITEM(S) , S/O 150.00, MRS A Hxxxx £38.00
  7. cool thanks. I am sorry I know I can be think sometimes but this is going legal by looks of things and that actually worrys me so I want to be totally sure I've followed everything correctly so that they can't come back and use something I've done wrong aggainst me.
  8. there is a small propblem with that in that in the body of this letter it does say "acceptance by you of this payment will be in full and final settlement of all claims you may have relating to charges." does this change my next move or do I still go with accepting the payment as a intrim payment?
  9. Ok so I have just recieve a letter saying in this exeptional matter their prepared to refund £38 as a gesture of goodwill ummmm..... they've got my money and I want it back so I am going to respectfully decline this offer but what do I do then?...
