      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm not sure I understand what you are trying to achieve? Got to agree with MOTB, what benefit does this provide? If you don't hear from them, take it to the next stage, if you don't hear from them again, file a court claim, it's as simple as that.

 

You aren't achieving anything by doing this.

 

I believe the regulatory body is the Financial Ombudsmen who state that a bank must respond to a complaint within 8 weeks. Why would you want to speak to them?

 

Just interested who it was so I can do a bit of research. I take your point though T4FF. I'll end comms with Tommy as of now and file a claim on the morning of the deadline if nothing is recieved.

Here we are ladies and gents - The night before I take the Bank to court! I'm strangely excited actually! To date, I have had no letters from the bank in regards to the claim itself, which I think is shocking really! As you can all see, I've had a few e-mails from good old TOmmy - but that's about it.

Dean, from what I've picked up from other people lately, there are a lot of offers and such waiting in a pile at RBS for some stationary - what I don't know, a leaflet? an envelope? - I'm not entirely sure if it is stalling or genuine, but I kinda think Tommy is pretty genuine. It may be worth trying to get as much info from him as you may have a settlement on the way.

 

That of course does depend on whether you want to wait or whether you want to go ahead and get the extra money.

May as well get the extra Money. I called Tommy, but he was 'in a meeting'. I spoke to his PA, Jonathon Beckett, who was as helpful as he could have been and did seem to suggest that they were under a significant amount of pressure. I did advise him that irrespective of pressure, any kind of letter/e-mail/carrier pigeon advising me that they were looking at it, even a generic mail-shot, would have been preferable to nothing whatsoever.

 

Anyway - Off to court people so I can now whack on that 8% :D

Tommy could just have a look in their database and advise if an offer is on its way. Sandy did that (informally) for me the other day, and told me (again informally) what the offer would be.

 

Personally, I'd feel a bit silly if I walked into court, and RBS came in too waving an offer saying, yes, but we WILL be giving him the amount he's claiming as per his POC.

Well,

 

I did speak to someone (before I got through to Tommy's PA) who advised nothing had been done whatsoever, but my claim did have a number and it was on their system - So God knows what they're playing at. I wonder if as soon as I file my claim they'll pay out asap?! Be funny that ehh?!

Have pmd you but am going to put a few bits of it on here to cover my own back....

 

You seem to have a few charges @ £10 that are charged at the same time each month. Are these royalties account charges? You aren't able to claim these if they are.

 

I would have a read of this and determine if you have attempted to claim for any charges that you shouldn't have.

 

If you are claiming charges you shouldn't be you may have to put the MCOL on hold and you may have to send out a prelim & LBA again with revised figures. Another option is to wait for the offer to materialise and see if it is close to your amended figures (minus any charges you shouldn't be claiming) and consider accepting it if it's close.

I don't have a Royalties account so I think it's just coincidence that they charge me the same time on a few of the months.

The one question I would ask is on my statements I am charged interest ('INT'). Am I able to claim this back as well? Also, how can I calculate the 8%? Is it just a standard 22p per day?

If you haven't put it in at prelim or lba stage you can't really add that now.

 

As advised in pm, I would transfer your charges to mindzai's spreadsheet as it does the 8% calculations for you.

I am at a similar stage Dean so I wouldn't be too dis-heartened by it all. Everybody who has sent the Prelim and then the LBA around the same time as us (dangler8, countryrbake, benn1) has still to receive anything back from RBS, even an acknowledgement, so I wouldn't worry that it is just your claim not being looked at or ignored.

 

Personally, I am going to give them a little while longer to reply. Here in Scotland we have been advised to go through the Ombudsman for claims over the £750 small claims limit anyway. Meaning I need to wait 8 weeks from the inital complaint letter so I have nothing to gain really from pushing them unfortunatley unless I want to settle for £750! Which I dont!

 

On a side note, I am claiming from FD and I have to say they did acknowledge my letter within a couple of days and say I would receive a decision within a further 10. They must not have as many disgruntled customers :)!

Right!!!

 

Finally got an offer, which means we are getting somewhere - £617.32. I am going to reject it of course, but I am please the claim is moving forward at least.

 

Does anyone have a good letter they used to 'accept offer as part settlement only' please?

Thank you for your letter dated 4/05/07

 

I respectfully decline your offer of Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totaling £XXX.XX

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

 

I have been very disappointed with the way this claim has been handled up to this point by your team. I am aware that there is currently a massive influx of claims at the present time due to media coverage, however, I believe my claim has been handled particularly badly.

I have waited patiently, due the high demand of charge claims, for over 8 weeks now, and only the threat of court action forced an ‘offer’ by yourselves. I am aware of the pressure you must be under, but this is simply unacceptable in terms of levels of service to your customers. I was told on three separate occasions that a manager would call me back to discuss my claim, these phone calls never happened. I was also informed by a member of your staff that the claim would be ‘Escalated’. When I called back a week later not only was there no escalation, but there was no record of my call whatsoever!

I do hope this e-mail is dealt with as a personal matter of urgency by yourself Sandy, and your team members. If I do not receive a full and final offer of £XXX.XX by 18/05/07, I will be forced to begin legal proceedings. This would be a real shame as I have always been very happy with my branches in XXXXXXX and XXXXXX. The staff have been very helpful in branch at every stage, and I have no desire to leave the bank due to this reason. This date of 18/05/07 will have given the bank over 10 weeks to deal with this claim, and return all charges back accordingly. Both myself, and the regulator, believe this is more than a reasonable time for this to be dealt with.

Great news! Remember you don't HAVE to sign their agreement, you could write up your own if you are not happy with the terms of the agreement.

 

 

I had a brief flick through it last week, apparently it's not worth the paper it's printed on anyway from a legal standpoint. Did you re-word yours?
